Dear Mr. and Mrs. Underly,
Enclosed please find a copy of the Notice to Bidders for the sale of 901 E. Miner St. This property
is being sold under Indiana Code 36-1-11-4, where authority is granted to the Board of Public
Works to sell abutting parcels of land to homeowners with properties in good standing, who may
wish to acquire that property, all in the best interests of the City. You are receiving this notice as the
petitioner and/or the abutting property owner.
The minimum offering price and the basis for that price is more thoroughly described in the Notice
to Bidders.
Bids must be submitted using the attached Property Disposition Bid Evaluation Rubric template.
Bids are due on December 19, 2019 at 10:30 AM, at Ste. 1316 County -City Building, 227 West
Jefferson Boulevard, South Bend, Indiana 46601. Any bid received after that time will be returned
unopened.

NOTICE TO ABUTTING PROPERTY OWNERS
SALE OF CITY -OWNED PROPERTY
Notice is hereby given that the City of South Bend, Indiana, through its Board of Public Works, is
offering for sale the following parcel of real estate located in South Bend, Indiana:
901 E. Miner St.:
Parcel No. 018-5026-0920
Legal Description: Lot 25 Lederer & Longleys Sub
This parcel is being sold under Indiana Code 36-1-11-4, where authority is granted to the Board of Public
Works to sell parcels of land to property owners in good standing, who may wish to acquire that property,
all in the best interests of the City.
The Board of Public Works has determined the best use of the property is its sale to the highest and best
bidder. The parcel is approximately 00.10 acres. The cost to the public of maintaining the tract over its
lifetime equals or exceeds the estimated fair market value of the tract. The tract's assessed value is
$6,000.00 for property tax purposes. The average of two appraisals conducted for the tract is $13,000.00.
The minimum calculated offering price is $12,650.00. Bidders will also be responsible for the cost of
appraisals, advertising, a sales disclosure form, transfer, and recording upon a successful negotiation and
sale of the tract. The cost of two appraisals is $575.00, the cost of advertising is estimated between 40.00
and $90.00, a sales disclosure form is estimated at $10.00, transferring is estimated at $5.00, and recording
is estimated at $25.50.
This parcel may not be sold to a person who owes delinquent taxes, special assessments, penalties, interest
or cost directly attributable to a prior tax on a tract of real property listed under Indiana Code 6-1.1-24-1.
An offer to purchase the parcel that is submitted by a trust must identify each beneficiary of the trust and
settler empowered to evoke or modify the trust.
Bids to purchase said parcel must include bid amount for the property plus an explanation of the bidder's
intended use of the property and be received in the office of the Board of Public Works, Ste. 1316, 227 W.
Jefferson Blvd., South Bend, Indiana 46601 on or before:

Property Disposition Bid Evaluation Rubric
Should the Department of Community Investment determine that it is in the best interest of the City, it
may set forth the following evaluation criteria for bids submitted to the Board of Public Works for the
purpose of purchasing City owned property.
To be eligible to bid on the property, the bidder must not:
1. Own property that is delinquent in property taxes;
2. Own property with an outstanding code violation;
3. Have a negative history with the Department of Code Enforcement or Building Department;
o Negative history includes, but is not limited to, repair orders, notices, violations,
continuous enforcement orders, and /or complaints currently or previously on file.
4. Have a direct past or current affiliation or association with any individual, group, organization,
company, or entity (collectively, "entity") that has managed, owned, or had pecuniary, business,
or similar interest in any entity that has a property with delinquent property taxes or property
with a history associated with repairs, violations, or complaints on file with the Department of
Code Enforcement or Building Department; or
5. Have any unpaid fines or fees in the collections process with or a judgment against the bidder in
favor the City of South Bend.

The City reserves the right to reject any and all proposals, incomplete proposals submitted by bidders
will not be considered.
It is the bidder's responsibility to complete due diligence prior to submitting a proposal. This includes,
but is not limited to, the following:
1. Receiving a title report for the property in question.
2. Receiving an environmental report for the property in question.
3. Hire a professional surveyor to conduct a survey of the property in question to confirm property
lines.
4. Checking the zoning to ensure their proposal is an allowable use at the property in question.
The winning bidder will be subject to a purchase agreement that fully stipulates the criteria set forth in
the bidder's proposal. If, at any time, the winning bidder does not follow through on the items stipulated
in the bidder's proposal, the City reserves the right to repossess the property for the original amount
paid by the bidder minus legal fees. If at any time the winning bidder desires to sell the property without
first completing the items stipulated in the proposal, the City reserves the right to repossess the
property for the original amount paid by the bidder minus legal fees.
Each proposal received in pursuit of purchasing the property in question will be sent to a committee for
independent review and scoring, comparison, and then a recommendation to the Board of Public Works
regarding the bid award.
