AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT
211-213 S. Michigan,
IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of South Bend, Indiana:
SECTION I. Ordinance No. 4990-68, as amended, which ordinance is commonly known
as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is
amended in order that the zoning classification of the following described real estate in the City
of South Bend, St. Joseph County, State of Indiana:
A part of Lots Numbered Two Hundred Eighty-four(284), Two Hundred Eighty-five(285), Two
Hundred Eighty-six(286)and Two Hundred Eighty-seven (287)as shown on the Original Plat of
the Town, now City, of South Bend,which part is bounded by a line running as follows:
Beginning on the West line of Michigan Street, in said City, at a point 87 feet, 5 7/8 inches
South of the Northeast corner of Lot Numbered 283 as shown on the said Original Plat; thence
running South on said West line of Michigan Street, a distance of 192.2 feet to a point 5 3/8
inches South of the Northeast corner of Lot Numbered 287 in said Plat; thence West 165 feet
more or less to the West line of said Lot 287; thence North along said West line 73 feet 5 3/8
inches to the centerline of a vacated 14 foot alley lying between Lots 285 and 286; thence East
44.72 feet; thence North 117.55 feet;thence East 121 feet to the point of beginning.

SECTION II. This ordinance shall be in full force and effect from and after its passage
by the Common Council, approval by the Mayor, and legal publication.

We the undersigned make application and petition the Common Council of the
City of South Bend, Indiana to amend the zoning ordinance as herein requested.

5) This rezoning is requested to allow the following uses:
approximately 10,000 square feet retail/commercial 1st floor
92 efficiency,one-and two-bedroom apartments floors 1-6
5) Attached is a copy of(a) legal description of the•property; (b)a list of the names and
addresses of all property owners within 300 feet of the petition property; (c)six(6)site
plans; and(d)addressed, stamped envelopes for all property owners within 300 feet of
the petition property.
6) By signing this petition, I and any contingent purchaser understand that if the Council
approves this petition to rezone, it may be approved subject to the submittal of a final site
plan. A final site plan must be submitted to the Area Plan Commission within one(1)
year of the Council's action. Failure to submit a final site plan within that time period
causes the rezoning of the petitioned property to revert to the initial zoning classification.
Time extensions on the submittal of the final site plan may be requested.

RE: A proposed ordinance and site development plan of South Bend Redevelopment
Commission and South Bend Heritage Foundation to zone from "C" Commercial, "G"
Height and Area to "A-3" Mixed Use Multi-family Residential and Commercial, "G"
Height and Area, property located at 211-213 S. Michigan Street, City of South
Bend - APC #1712-96
Dear Council Members:
The above referenced ordinance and site development plan of South Bend
Redevelopment Commission was legally advertised April 4, 1992. The Area Plan
Commission at its public hearing on April 16, 1996, took the following action:
Upon a motion by Joseph Serge, being seconded by George Hill and unanimously
carried, the proposed ordinance and site development plan of South Bend
Redevelopment Commission and South Bend Heritage Foundation to zone from "C"
Commercial, "G" Height and Area to "A-3" Mixed Use Multi-family Residential and
Commercial, "G" Height and Area, property located at 211-213 S. Michigan Street,
City of South Bend is sent to the Common Council with a favorable recommendation,
subject to a final site development plan. Rezoning of this property would allow
for the restoration and adaptive reuse of a long vacant building in downtown
South Bend. The A-3 zoning classification would allow retail space on the ground
floor and apartments throughout the remainder of the building. In the
Commission's opinion these proposed uses are consistent with the surrounding area
and would meet the City of South Bend's goal of creating more housing in the
downtown area.
PLEASE NOTE that the Ordinance has been amended by the petitioner and is
different than that used for the Common Council's first reading. The amended
Ordinance was the Ordinance legally advertised and heard by the Area Plan
Commission.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will be
forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

REQUESTED ACTION: The petitioners are requesting a zone change
from "C" Commercial, "G" Height and Area to
"A-3" Mixed Use Multi-family Residential and
Commercial, "G" Height and Area to allow
apartments and retail and commercial uses.
EXISTING LAND USE: The property contains a vacant commercial
building.
SURROUNDING LAND USE AND ZONING: Located to the north is a bank zoned "C"
Commercial, "G" Height and Area; to the east
are retail, commercial, and office buildings
zoned "C" Commercial, "G" Height and Area; to
the south are office and commercial buildings
zoned "C" Commercial, "G" Height and Area; and
to the west is the Federal Courthouse and a
parking ramp zoned "C" Commercial, "G" Height
and Area.
ACCESS: Access to the site is from Jefferson Boulevard
and Michigan Street.
WATER SOURCE/SEWAGE DISPOSAL: Water and sewer is available to the site.
DRAINAGE: The drainage has not been addressed by the
petitioner.
SITE DATA: The total site to be rezoned is 26,161 square
feet. Of that, the buildings will occupy
22,525 square feet, or 86 percent of the site
and 3,636 square feet or 14 percent of the
site will remain as open space.
ENVIRONMENTAL DATA: A check of the Agency's maps indicates that
the site is in a wellfield area, but no public
wells, wetlands, flood or environmental hazard
areas are present.
SITE PLAN: The site plan is preliminary.
