AN ORDINANCE OF THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND, INDIANA, APPROVING
THE SALE OF PARK PROPERTY
STATEMENT OF PURPOSE AND INTENT
The City of South Bend, Indiana, for the use and benefit of
its Park Department and/or Board of Park Commissioners
(hereinafter, the "Park Department") owns certain real property
located in the 900 block of West LaSalle Street, and being more
particularly described as follows :
Lot Numbered Fifty-nine (59) as shown on the recorded
Plat of Cobb' s Subdivision of Bank Out Lot Numbered
Thirty (30) of the First Plat of Out Lots of the Town,
now City of South Bend, as platted by the State Bank of
Indiana, recorded in Plat Book 2, page 20, in the
Office of the Recorder of St . Joseph County, Indiana,
(hereinafter, the "Real Property") . Pursuant to I .C. 36-10-4-
9 (a) , said lands are under the exclusive control of the Board of
Park Commissioners of the Park District of the City of South Bend
(hereinafter, the "Park Board") .
The Real Property is located on West LaSalle Street within
an area being revitalized by the South Bend Heritage Foundation,
a non-profit corporation. The property is equipped with certain
pieces of playground equipment, but is no longer needed for park
purposes .
At its meeting of February 19, 1996, the Park Board
determined that the Real Property is not required for park
purposes and authorized the sale of the Real Property upon the
following conditions :
A. That the Real Property be transferred to the South
Bend Heritage Foundation for the sum of One Dollar ($1 . 00)
for use in its West LaSalle Street revitalization project .
B. That the playground equipment located at the Real
Property be relocated by South Bend Heritage Foundation to a
location serving an eligible South Bend neighborhood.
Pursuant to I .C. 36-11-1-3, Common Council approval of the
Sale of the Real Property is required.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AS FOLLOWS :
Section I . The disposal of the Real Property is approved,
subject to the following conditions :
A. That the Real Property be transferred to the South
Bend Heritage Foundation for the sum of One Dollar ($1 . 00)
for use in its West LaSalle Street revitalization project .
B. That the playground equipment located at the Real
Property be relocated by South Bend Heritage Foundation to a
location serving an eligible South Bend neighborhood.

Re : An Ordinance of the Common Council of the
City of South Bend, Indiana, Approving
the Sale of Park Property
Dear Mr. Kelly:
I am attaching for filing an ordinance approving the transfer
by the Board of Park Commissioners of the real estate located at
936 West LaSalle Street to the South Bend Heritage Foundation for
use in its West LaSalle Street revitalization project . South Bend
Heritage Foundation intends to construct a home on this lot, which
will then be made available as affordable housing. The park
playground equipment currently located on the site will be
relocated to an appropriate neighborhood location.
