HomeMy WebLinkAbout9528-04 Amend Various Articles of Chapter 6 - Addressing Builiding Codes and Permit FeesORDINANCE No. Passed by the Common Council of the City of South Bend, Indiana September 13, Attest: Attest: 04 20 Presented by me to the Mayor of the Ciry of South Bend, Indiana Ciry Clerk President of Common Council September 14, 04 20 Ciry Clerk Approved and signed by me September 15, 20 04 ~~~ Maym Ordinance No. l s Zg AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, TO AMEND VARIOUS ARTICLES OF CHAPTER 6, BUILDING, OF THE SOUTH BEND MUNICIPAL CODE ADDRESSING BUILDING CODES AND PERMIT FEES STATEMENT OF PURPOSE AND INTENT On December 31, 1991, the City of South Bend and the County of St. Joseph entered into an agreement to merge their building departments; and further created the "Consolidated Building Board" . In 1993, by Ordinance No. 8412-93 subsection 1, the Board created the Building Department as an enterprise fund. It has been determined that in order to maintain the enterprise fund, a fee increase would be needed as set forth in this ordinance. Furthermore, the State of Indiana has revised the building codes to be followed by the State and local jurisdictions. Now, therefore, be it ordai~:ed by the Common Council of the City of South Bend, Indiana, as follows: Section 1. Chapter 6, Article I, Section 6-4(b)(1) shall be amended as follows: (1) The fee for permits issued for new construction and building additions shall be based upon the square footage of such new construction or addition at the rate of °~° ^°^*° yen n~` e cents ($0.08) per square foot for the first one hundred thousand (100,000) square feet and x$9:94) six cents ($0.06) per square foot for each additional square foot, with a minimum permit fee of $20.00. Section 2. Chapter 6, Article I, Section 6-4(b)(11) shall be amended as follows: (11) The fee for installation of a wood burning stove shall be ~'~°°~ a~"^r~ ~~' c nn twenty dollars ($20.00) per flue (including chimney and chimney connector). Section 3. Chapter 6, Article 2, Section 6-5(a) shall be deleted in its entirety and replaced as follows: (a) Pursuant to IC 22-13-2-3(B), the rules of the Indiana Fire Prevention and Building Safety Commission as set out in the following Articles of Title 675 of the Indiana Administrative Code are hereby incorporated by reference in this code and shall include any later amendments to those rules. (1) Article 13- Building.Codes (1) Fire and Building Safety Standards. (2) Indiana Building Code. (2) Article 14 - Indiana Residential Code (3) Article 16 - Indiana Plumbing Code (4) Article 17 - Indiana Electrical Code (5) Article 18 - Indiana Mechanical Code (6) Article 19 - Indiana Energy Conservation Code (7) Article 20 - Indiana Swimming Pool Code (8) Article 22 - Indiana Fire Code (9) Article 25 - Indiana Fuel Gas Code Section 4. A portion of Chapter 6, Article 2, Section 6-6.3(c) shall be amended to read as follows: (c) All persons performing demolition work within the City shall be registered with the Department. Registration shall be on forms provided by the Department and shall be accompanied by payment of a registration fee of one-hundred dollars ($100.00). Said registration shall be for a term of one year from the date of issuance. However, an owner of the property performing their own demolition work shall be exempt from the bonding and registration requirement, with the exception of buildings or structures being demolished which are over six hundred (600) square feet, the owner shall be subject to the bonding requirement set forth in subsection 6-6.3(d). Section 5. A portion of Chapter 6, Article 2, Section 6-6.6.5(c) shall be amended to read as follows: (c) All persons, firm, or corporation erecting signs in the City for renumeration shall be registered with the Department. Registration shall be on forms provided by the Department and be accompanied by a five thousand dollars ($5,000.00) bond made payable to the City of South Bend indemnifying the City against all loss or damage to public ways, public places, and other public property during the course of the work under the sign permit and further conditioning that the applicant will indemnify the City and pay any and all personal and property damages caused by any negligent act or omission in the erection of such sign, insurance certificate as required by Chapter 21 of the South Bend Municipal Code, and payment of a registration fee of °°•~°^*•~ ~~~° a^"^r~ ie~c nn` one-hundred dollars $100.00. Said registration shall be for a term of one (1) year from the date of issuance. Section 6. A portion of Chapter 6, Article 4, Section 6-10(c) shall be amended to read as follows: (c) Schedule of permit fees. Permits issued for plumbing work within the City shall be subject to the following fee schedule, with a minimum permit fee being ~~°°~ a^"^~~ ~Q' c nm twenty dollars $20.00 . Section 7. A portion of Chapter 6, Article 4, Section 6-10(d)(2)(b) shall be amended to read as follows: b. Registration shall be on forms provided by the Department and shall be accompanied by payment of a registration fee, as follows: Plumbing Contractors ....................................$~A9-$100.00 Excavators (as defined in Sec. 6.10(d)(1)(b)..........Q'~ $100.00 Sewer cleaners .............................................-$100.00 Section 8. A portion of Chapter 6, Article 6, Section 6-23(1) shall be amended to read as follows; (i) License fees: (1) Class A New ......................................$100.00 Renewal .................................~--~-~:9~-$100.00 (2) Class B: New and Renewal ......................y-~`-~=~-$100.00 Section 9. A portion of Chapter 6, Article 6, Section 6-24(c) shall be amended to read as follows: (c) Fees. Each application for a permit for installation or alteration of electrical wiring or equipment shall be accompanied by fees in accordance with the schedule below; with a minimum permit fee of X98 twenty dollars ($20.00). Section 10. 'A portion of Chapter 6, Article 7, Section 6.36.2(1) be amended to read as follows: (i) License Fees: New .......................$100.00 Renewal ...................$^?~.-~-$100.00 Section 11. A portion of Chapter 6, Article 7, Section 6-36.3(c) shall be amended to read as follows: (c) Fees. Each application for a permit for installation of heating, ventilating, air conditioning, and refrigeration equipment or systems shall be accompanied by fees in accordance with the schedule below, with a minimum permit fee being ~~°°^ a^"^r~'Q' ` nn` twenty dollars ($20.00 When the total capacity of any system in any single installation is provided by more than one (1) unit, the sum of the capacities of each unit and the total number of such units shall determine the fee. Section 12. Chapter 6, Article 11, Section 6-48. Fees shall be amended to read as follows: Sec.6-48. Fees. (a) The annual fee for a building contractor's prelicensing registration shall be sevent3F- ~;.,° a^,,.,,.~ ie~c nm one hundred dollars ($100.00), and placed in a special nonreverting fund to assist in the implementation of this article. (b) Any building contractors performing electrical, plumbing, heating, air conditioning, or ventilating services shall be subject to the applicable fee requirements addressed in section 6-10, 6-23, or 6-36.2 of this Code, instead of the °°•~°^*~~ ~•~° ~'^"^r~ ie~c nn` one hundred dollars ($100.00) fee addressed in subsection (a) herein. Section 13. BUILDING COMMISSIONER RE: Proposed Fee and Building Code Ordinance Dear Members of the Common Council: Attached is a proposed ordinance to update our building codes and fees. BRENT M. BAJDEK Asst. Zoning Administrator First, the State of Indiana has updated the building codes to be followed by all jurisdictions in the State. A portion of this ordinance is to bring us into conformance with the State regulations. Second, this ordinance is to keep us in compliance with Ordinance No. 8412-93, subsection 1, which established the Consolidated Building Department as an enterprise fund. It is our responsibility to monitor fees in order to assure that we continue to be self-supporting. If you have any questions regarding this matter, please feel free to contact me.
