ORDINANCE NO. 307-96
AN ORDINANCE AMENDING ORDINANCE NO. 8525-94
OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA TO ADDRESS THE ANNUAL PAY AND MONETARY
FRINGE BENEFITS FOR MEMBERS OF THE SOUTH BEND
POLICE DEPARTMENT FOR THE CALENDAR YEAR 1997
Statement of Purpose and Intent
Indiana State law (Indiana Code § 36-8-3-3 (d) ) provides that
the "annual compensation of all members of the police department
and other appointees shall be fixed by ordinance of the legislative
body before August 2 of each year for the ensuing budget year."
On July 25, 1994 the South Bend Common Council passed
Ordinance No. 8525-94 which set the annual compensation for all
members of the police department of the City of South Bend.
Since that date certain issues have come up concerning equity
of pay in the Investigation Bureau and through Labor/Management
meetings within the South Bend Police Department a solution has
been found for those inequities which involves an amendment of the
salary ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I . A new section III (m) shall be added for the year
1997 which will read as follows:
(m) Investigative Division Corporals. In 1997
Corporals in the Investigative Division who have
been in the Investigative Division continually
since at least January 1, 1996 shall receive as
additional compensation as an incident of their
assignment the amount of $1, 050. 00, which shall be
paid as part of their regular paychecks .
SECTION II . In all other aspects Ordinance 8525-94 remains
unchanged.
SECTION III. This Ordinance shall be in full force and effect
from and after its passage by the Common Council and approval by
the Mayor.

Dear Mr. Kelly,
I am attaching for filing, the above-referenced ordinance
which amends Ordinance No. 8525-94 to increase the annual salary of
South Bend Police Department Corporals in the Investigative
Division a total of One Thousand Fifty Dollars ($1050) for calendar
year 1997 . The proposed amendment has been determined by the
Police Department Labor/Management Committee as an equitable
adjustment to the salary of the affected position.
