DUB ' f h Approved and signed by me Mayor BILL NO. 50-96 ORDINANCE NO. 6�(� " 9C AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS OF FIREFIGHTERS OF THE SOUTH BEND FIRE DEPARTMENT FOR CALENDAR YEARS 1997. 1998. 1999 AND 2000. Statement of Purpose and Intent The South Bend Common Council has the responsibility for fixing, by ordinance, the annual compensation of all member so the South Bend Fire Department pursuant to Indiana Code § 36-8-3-3 (d). On March 25, 1996, the South Bend Common Council adopted Resolution No. 2350-96 which appointed Kathleen Cekanski-Farrand as their agent and an advisory City Negotiating Team to negotiate on their behalf. On April 10, 1996, the Board of Public Safety adopted Resolution No. 27-1996 which appointed Kevin Horton as their agent and four (4) resource persons to negotiate on their behalf working conditions of the South Bend Fire Department. The City Negotiating Team and the Wage Committee of the South Bend Firefighters Association,Local 362 reached a tentative agreement on all pay and monetary fringe benefit issues and working conditions on June 25, 1996. The members of the Union will complete voting on the ratification of the wage and benefit package on July 18, 1996. The following ordinance sets forth the details of the first four-year wage and benefit agreement in the history of the City of South Bend. The City Agents and the City Negotiating Team unanimously recommend that this ordinance be passed by the South Bend Common Council, if the wage and benefit provisions are ratified by the members of the South Bend Firefighters Association,Local No. 362. Designation of Officers. Employees. and Sworn Members. (a) The South Bend Common Council recognizes the Wage Committee of the South Bend Firefighters Association, Local No. 362, as the sole bargaining unit for the annual pay and monetary fringe benefits which are addressed in this ordinance for the Employees of the South Bend Fire Department. "Employees" are hereby designated as all firefighters of the South Bend Fire Department excluding the Fire Chief,Assistant Chiefs, and Battalion Chiefs for calendar year 1997, 1998, 1999, and 2000. (b) The Fire Chief, Assistant Chiefs, and Battalion Chiefs of the South Bend Fire Department are hereby designated as"Officers". (c) Employees and Officers shall be collectively referred to as "sworn members" of the South Bend Fire Department. (d) Service Year Requirements: The following service year requirements shall be in effect: Firefighter: For those Employees hired after December 31, 1996, date of hire until the completion of one(1) full year of service. First Class Firefighter: Upon a Firefighter's completion of one (1) full year of service from the date of hire,he shall become a First Class Firefighter. Engineer: Promotion to the rank of Engineer shall be dependent upon the satisfactory completion of three(3)full years of service. The Fire Chief shall forward to the Board of Public Safety the names of those firefighters eligible for the rank of Engineer not later that the date the the individual becomes eligible. Section II. Annual Salary Classifications. Specialty Pays and Eaugnment Allowances. (a) Medical Specialty Pays: Specialty pays shall be paid to the sworn members of the South Bend Fire Department who meet the department's requirements for each specialty and are regularly assigned to perform such special duties. All specialty pays shall be prorated to the date of the regular assignment for such special duty or duties and paid accordingly. Individuals performing any of the following Medical Specialties, shall be paid at the highest certification only. Tactical Rescue Team Members: $ 1,100 $ 1,150 $ 1,200 $ 1,200 (c) Swiftwater Scuba Divers shall be entitled to a $ 350.00 per year swiftwater scuba equipment allowance utilizing a purchase order system through the South Bend Fire Department. (d) Tactical Rescue Team Members shall be entitled to a $ 250.00 per year tactical rescue equipment allowance for calendar years 1998, 1999, and 2000 utilizing a purchase order system through the South Bend Fire Department. (e) Payment of Specialty Pays: All specialty pays shall be paid on a bi-weekly basis except the following: First Responders On or about December 15 of each year EMT On or about December 15th of each year AEMT On or about December 15th of each year Reserve Paramedics On or about December 15th of each year Special Response Team Leaders On or about December 15th of each year Special Response Team Members One-half(1/2)on or about June 15th and remaining one-half(1/2)on or about December 15th 1997-2000 South Bend Fire Department Salary Ordinance Page 5 Section IV. Other Monetary Benefits. (a) 8-Hour Incentive Pay: An 8-Hour Incentive Pay of a total of$ 1,022 in 1997, a total of$1,055 in 1998, a total of$1,098 in 1999, and a total of$1,154 in year 2000 shall be paid to those individuals regularly assigned to work a forty (40) hour work-week (not to include temporary duty assignments (TDY). Said 8-Hour Incentive Pay shall also be paid to Officers in calendar years 1997, 1998, 1999, and 2000. (b) Inspectors: Those Engineers qualified and regularly assigned[not to include temporary duty assignments(TDY)] as an Inspector, shall be provided with duty shirts and badge, and shall be paid at the Inspector's salary classification. (c) Instructors: Shift Instructors qualified and selected to teach on-duty in-house instruction programs for rookie schools, driving, confined space rescue, rope techniques, water safety, watercraft techniques, CPR,and other authorized departmental instruction, shall be paid at the rate of$ 10.00 per hour up to a$ 1,500.00 maximum with any teaching thereafter requiring the approval of the Fire Chief. Other instructors qualified and selected to teach on-duty in-house instruction programs for rookie schools, driving, confined space rescue, rope techniques, water safety, watercraft techniques, CPR, and other authorized departmental instruction, may be paid at the rate of$ 10.00 per hour, upon the approval of the Fire Chief. Said hourly rate shall be paid over and above the individual's salary classification and shall be paid consistent with applicable regulations of the State Board of Accounts. (d) Certified SCBA Repair Specialists: Those Employees qualified, certified, and regularly assigned by the Fire Chief to perform self-contained breathing apparatus (SCBA) repairs shall be paid at the rate of$ 10.00 per hour up to a $ 1,000.00 maximum with any repair service thereafter requiring the approval of the Fire Chief. Said hourly rate shall be paid over and above the individual's salary classification and shall be paid consistent with applicable regulations of the State Board of Accounts. (e) Special Assignments: Employees assigned by the Fire Chief to perform special assignments (not including light duty) including but not limited to watercraft maintenance, apparatus maintenance,mapping,or other authorized departmental assignments, shall be paid at the rate of$ 10.00 per hour while performing such special duties. Said hourly rate shall be paid over and above the individual's salary classification and shall be paid consistent with applicable regulations of the State Board of Accounts. 1997-2000 South Bend Fire Department Salary Ordinance Page 6 (f) Clothing/Uniform Allowance: Clothing/Uniform allowance shall be $ 795.00 per year for calendar years 1997, 1998, 1999,and 2000. Clothing allowance shall be paid in four (4) equal payments payable on or about March 15th,June 15th, September 15th and December 15th of each year. Clothing allowance shall be pro-rated to the date of termination of employment for all qualifying sworn members. Clothing allowance shall not be paid during the individual's first year of employment. It shall be pro-rated from the sworn member's first anniversary date until the end of that calendar year. (g) Holiday Pay: Holiday pay is established and shall be paid as set forth in Article 26 of the 1997-2000 Collective Bargaining Agreement approved by the Board of Public Safety of the City of South Bend,Indiana,and as may be amended from time to time. (h) Deferred Compensation: The City agrees to establish, effective January 1, 1997, a deferred compensation program whereby for the first one hundred dollars ($ 100.00) deferred by a sworn member each year, the City will match said amount $ .50 on the dollar, and for the next three hundred dollars($300.00) deferred by a sworn member each year, the City will match said amount,dollar for dollar. (i) Other Monetary Benefits: The following monetary benefits, namely: overtime, station allowance, sick leave buy-back,insurance, neo-natal pay, flexible time accounts, working-out-of- classification pay,and specific types of leaves are established;and any monetary payments shall be paid as addressed in the 1997-2000 Collective Bargaining Agreement approved by the Board of Public Safety of the City of South Bend,Indiana,and as may be amended from time to time. Section V. Effective Date. Stein, Vice- John Broden President of the Union; David A. VanDeWielle, Federico Rodrieguez, Ed Fourth District Hernandez, Scott Webber, and Joseph V. Simeri, Chief Spokesperson for the Union. David Varner Fifth District The City of South Bend was represented by a joint team representing the Board of Public Safety and the South Bend Common Council. Its members Thomas Zakrzewski were Roland Kelly, Council President; Councilmember Steve Luecke, Kevin Sixth District Horton, City Controller, Thomas Bodnar, Attorney to the Board of Public Safety,and myself as City Spokesperson. Sean Coleman The overall package meets the objective established this spring by Chief At Large l g obj ,sP g y Luther Taylor and his staff, namely to make the department's number one John Hosinski commitment,the Fire Department personnel At Large The salary ordinance establishes salary classifications for calendar years Cleo Washington 1997 through the year 2000 that are competitive with other fire departments. In At Large order to properly and fairly address the pension base, both Teams negotiated to convert 200.00 each year from the Firefighters clothing allowance into the Kathleen Cekanski-Farrand pension base in the last year. The ordinance also establishes speciality pays for Council Attorney the City's three (3) Special Response Teams, namely the Hazardous Materials Response Team, the Swiftwater Rescue Team, and the Tactical Rescue Team; as well as the medical specialties of First Responder, EMT, AEMT, Reserve Paramedic, and Paramedic. In addition to other monetary fringe benefits established,the City will establish a deferred compensation program whereby it will match $ .50 on the dollar for the first $ 100.00 deferred by a Firefighter, and will match dollar for dollar up to $ 300.00 for every dollar deferred by a Firefighter. Recommendations from Isabel Gonzalez and Ronalda Minnis were also Charlotte Pfeifer instrumental in developing a true team effort. Second District Through the hard-work of both the Union and the City, the first four- Roland Kelly year wage,benefit and working conditions package was achieved. Both sides Third District were determined to reach their goals and remained focused on their objectives throughout the negotiating process. John Broden Fourth District We have the most trained and professional fire department in the state of Indiana. The South Bend Fire Department is made up of dedicated David Varner firefighters who strive twenty-four hours a day to provide quality fire and Fifth District emergency medical services to our citizens. This ordinance, and the Collective Bargaining Agreement which will be acted upon by the Board of Public Safety Thomas Zakrzewski on Wednesday,will set the standard of excellence so that the South Bend Fire Sixth District Department will be the model fire department of its size in our nation by the year 2000.
