ORDINANCE NO. 6
An ordinance to vacate all streets and alleys south of vacated Elder Street, east of Michigan
Street, west of Carroll Street and north of first east/west alley south of Pennsylvania, including
all streets and alleys south of Ohio Street, east of Carroll Street, west of Fellows Street and
north of first east/west alley south of Pennsylvania Street. Further including Keasey Street east
of Fellows and west of Marietta. All more particularly described as follows.
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority
to hear all petitions to vacate public ways or public places within the City.
A petition has been filed with the Common Council to vacate the public property described
herein below.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend having held a public hearing on
the petition to vacate the following streets:
A PORTION OF PARIS STREET
A parcel of land located in the East Half (E'/) of the Northwest Quarter (NW%4) of Section Thirteen
(13), Township thirty-seven (37) North, Range Two (02) East of the Second Principal Meridian and
as shown on the recorded Plat of Elder's Addition Book 3, Page 4 and all being in the City of South
Bend, Portage Township, St. Joseph County, Indiana, and more particularly described as follows:
Beginning at the east right of way line of Carroll Street; thence east a distance of 416 feet, more
or less, and a width of 40 feet to the west right of way line of Fellows Street, to the line of terminus.
A PORTION OF WENGER STREET
A parcel of land located in the East Half (E'/2) of the Northwest Quarter (NW%) of Section Thirteen
(13), Township thirty-seven (37) North, Range Two (02) East of the Second Principal Meridian and
as shown on the recorded Plat of Elder's 1st Addition, Book 3, Page 4 and all being in the City of
South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described
as follows:
Beginning at the east right of way line of Carroll Street, thence east a distance of 416 feet, more
or less and a width of 40 feet to the west right of way line of Fellows Street, to the line of terminus.
PORTION OF KEASEY STREET
A parcel of land located in the East Half (E'/) of the Northwest Quarter (NW%4) of Section Thirteen
(13), Township thirty-seven (37) North, Range Two (02) East of the Second Principal Meridian and
as shown on the recorded Plats of Elder's 1st Addition Book 3, Page 4 and all being in the City of
South Bend, Portage Township, St. Joseph County, Indiana and more particularly described as
follows:
Beginning at the east right of way line of Carroll Street; thence east, a distance of 416 feet, more
or less and a width of 50 feet, to the west right of way line of Fellows Street, to the line of terminus.
A 20 foot wide street consisting of the following eight (8) sections:
1. Beginning at the north right of way line of the first east/west alley north of Broadway Street,
a distance of 158 feet, more or less to the south right of way line of Pennsylvania Avenue.
2. From the north right of way line of Pennsylvania Avenue, north a distance of 130 feet, more
or less, to the south right of way line of Paris Street.
3. From the north right of way line of Paris Street, north 130 feet, more or less, to the south
right of way of the first east/west alley north of Paris Street.
4. From the north right of way line of the first east/west alley north of Paris Street, 132 feet,
more or less, north to the south right of way line of Wenger Street.
5. From the north right of way of Wenger Street, north 132 feet, more or less, to the south right
of way line of the first east/west alley north of Wenger Street.
6. From the north right of way line of the first east/west alley north of Wenger Street, north a
distance of 132 feet, more or less, to the south right of way line of Keasey Street.
7. From the north right of way line of Keasey Street north 132 feet, more or less, to the south
right of way line of the first east/west alley north of Keasey Street.
8. From the north right of way line of the first east/west alley north of Keasey Street, north 132
feet, more or less, to the south right of way line of Ohio Street and the line of terminus.
A PORTION OF ST. JOSEPH'S STREET
A parcel of land located in the East Half (EY2) of the Northwest Quarter (NW%) of Section Thirteen
(13), Township thirty-seven (37) North, Range Two (02) East of the Second Principal Meridian and
as shown on the recorded Plat of Haney's Addition, Book 6, Page 13 and being in the City of South
Bend, Portage Township, St. Joseph County, Indiana and more particularly described as follows:
Beginning at the north right of way line of Broadway Street; thence north 153 feet, more or less, and
a width of 60 feet to the south line of the first east-west alley, north of Broadway Street.
Also:
Beginning at the north right of way line of the first east-west alley north of Broadway Street; thence
north 165.6 feet, more or less, and a width of 60 feet, to the south right of way line of Pennsylvania
Avenue, and being the line of terminus.
A PORTION OF PARIS STREET
A parcel of land located in the East Half (E'/) of the Northwest Quarter (NW%) of Section Thirteen
(13), Township thirty-seven North, Range Two (02) East of the Second Principal Meridian and as
shown on the recorded Plat of Elder Place Book 5, Page 13 and all being located in the City of
South Bend, Portage Township, St. Joseph County, Indiana and more particularly described as
follows:
Beginning at the east right of way line of Michigan Street; thence east 195 feet, more or less, for
a width of 54 feet, to a line of terminus, said line of terminus being the westerly limit of a vacated
portion of said Paris Street and described in Resolution No. 3425, 1975.

A parcel of land located in the East Half(E11) of the Northwest Quarter (NW%4) of Section Thirteen
(13), Township thirty-seven (37) North, Range Two (02) East of the Second Principal Meridian and
as shown on the Recorded Plats of Haney's Addition, Book 6, Page 13 and Wenger& Krieghbaum
1st Addition, Book 9, Page 74 and Elder Place, Book 5, Page 13 and Elder's 1st Addition Book 3,
Page 4 and Kirby's Addition Book 2, Page 56, all being in the City of South Bend, Portage
Township, St. Joseph County, Indiana and more particularly described as follows:
Beginning at the north right of way line of Broadway Street; thence north to the south right of way
line of the first east-west alley north of Broadway Street, and having a width of 46.33 feet;
Also:
Beginning at the north right of way line of the first east-west alley north of Broadway Street; thence
north to the south right of way line of Pennsylvania Avenue, and having a width of 46.33 feet;

A parcel of land located in the East Half (%) of the Northwest Quarter (NW%) of Section Thirteen
(13), Township thirty-seven (37) North Range Two (02) East of the Second Principal Meridian and
as shown on the recorded Plats of Elder Place, Book 5, Page 13 and McComb's Subdivision, Book
5, Page 41 and Haney's Addition Book 6, Page 13 and Wenger & Krieghbaum 1st Broadway
Addition, Book 9, Page 74 and Elder's 1st Addition, Book 3, Page 4 and all being in the City of
South Bend, Portage Township, St. Joseph County, Indiana and more particularly described as
follows:
Beginning at the east right of way line of Michigan Street, thence east to the west right of way line
of Fellows Street, a distance of 1442 feet, more or less and a width of 53 feet, to the line of
terminus.
A PORTION OF KEASEY STREET
The street to be vacated is described as East Keasey Street from the east right-of-way line of South
Fellows Street to the west right-of-way line of South Marietta Street for a distance of approximately
863.1 feet and a width of 50 feet. Part situated in Wenger's Fourth Addition to the City of South
Bend, St. Joseph County, Indiana.

The first north/south alley west of Carroll Street and extended north 264 feet, more or less, from the
north right of way line of Paris Street to the south right of way line of Elder Street and being 10 feet
wide.

The first east/west alley north of Paris Street extended west 116 feet from the west right of way line
of Carroll Street to the east right of way line of the, vacated, first north/south alley west of Carroll

The first east/west alley north of Paris Street, extended east from the east right of way line of
Carroll Street, a distance of 198 feet, more or less to the west right of way line of Columbia Street,
and being 14 feet wide.

Bend, Portage Township, St. Joseph County, Indiana and more particularly described as follows:
The first east/west alley north of Pennsylvania Avenue, running east from the east right of way line
of Michigan Street, for a distance of 160.5 feet, more or less, and having a width of 9 feet; thence
continuing east for a distance of 827.28 feet, more or less, to the west right of way line of Carroll
Street, and having a width of 14 feet.

as shown on the Recorded Plat of Elder Place, Book 5, Page 13 and all being in the City of South
Bend, Portage Township, St. Joseph County, Indiana and more particularly described as follows:
The first north/south alley west of St. Joseph Street and lying between the south right of way line
of Pennsylvania Avenue and the north right of way line of the first east/west alley north of
Broadway Street, said north/south alley being 12 feet wide and running 172 feet south to the north
right of way line of said east/west alley.
hereby determines that the above-described right of way shall be, and hereby is, vacated.
SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and
the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not
limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and
ditches, within the vacated right-of-way, unless such rights are released by the individual utilities.

vacation of certain alleys and street in the Southeast neighborhood of
the Sample-Ewing Development Area. The purpose of this vacation is
to prepare a site for the development of Indiana Vocational Technical
College.
