This Special Meeting was convened pursuant to a duly dated and signed Notice of Special Meeting which was mailed and telephoned to each Commissioner in due time, form, and manner as required by law. The Special Meeting was also announced in the prior Commission Meeting of May 18, 1973. Said Notice read as follows: NOTICE OF SPECIAL MEETING TO THE COMMISSIONERS OF THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT Notice is hereby given that a Special Meeting of the South Bend Redevelopment Commission, Governing Body of the City of South Bend, Department of Redevelopment, will be held in Room 1200, County -City Building, 227 West Jefferson, in the City of South Bend, in the regular meeting place thereof, at 10:30 A.M., on the 22nd day of May, 1973, for the purpose of acting upon items as listed in the agenda and such other items as may pro- perly come before the meeting in accordance with provisions of the By -Laws. Williams, seconded by Mr. Chenney MINUTES APPROVED and unanimously carried, the Minutes of Regular Meeting of May 18, 1973 were approved. 4. I NEW BUSINESS a. Contracts for Phase III, Pedestrian Way, R -66: Commission authorization was received in prior Commission meetings, covering extensive alternate biddings. Advertise- ments have appeared in The South Bend Tribune and Tri- County News on April 6, 13, 20 and 27, 1973. The bid opening was May 15, 1973, at 10:00 A.M., E.S.T., in the Office of the Dep rtment of Redevelopment, with eight (8) firms submitting bids) out of twenty -five (25) receiving bid documents. The Ifollowing firms submitted bids: 1) Carl J. Reinke & Sons 721 N. College Street South Bend, Indiana 46619 2) The Hickey Co., Inc. 403 East Madison Street South Bend, Indiana 46622 3) Schumacher & Sons, Inc. 321 South Spring Street Mishawaka, Indiana 46544 In Joint Venture with: C. As and NEW BUSINESS (Cont'd) he bids cover the base bids, Alternates No. 5, and the Jefferson Street Alternate, and are not being listed in the minutes, due t ityof the bids. The tabulation totals six tacked to the original copy of the minutes 1,2,3,4 combinations, o the complex- pages, copy at- for the record. President Helmen, in addressing the audience, advised the matter of new business for which the meeting was called, and in fact the only business this morning, has to do with the award of the contract for the Pedestrian Way. The Com- mission spent a lot of time last Friday, and again today, stu ying the bids and asked the Commissioners whether some- one lwill make the award? Mr. Wiggins made the motion that the contract for the Pedes- trian Mall, Contract No. 5, be awarded to the lowest bidder, Hickey Construction Co., Inc., subject to the Department of Housing and Urban Development approval, our Legal Counsel ap- proval, and an approved, by the Department of Redevelopment, work schedule between the General Contractor and all Subcon- tractors, and Contract No. 2, and an acceptable negotiation with the Hastings Company complex as it relates to all the brick work, and acceptance of the Jefferson Street Alternate negotiation and the final approval of our consulting engineer. Said motion was seconded by Rev. Williams. The Chair requested an individual poll of each member: Each of tie five Commissioners cast their vote as "Aye "; none ab- stai ing or "Nay" votes. Motion unanimously carried. Mr. 4iggins further made the motion that the contract for the Pede trian Mall, Indiana R -66, Contract No. 2, be awarded to the low bidder, Exterior Designing, Inc., at: $206,474.00, subj ct to approval by the Department of Housing and Urban Development, to our Legal Counsel approval, an approved work schedule between the contractor and all subcontractors and Contract No. 5, acceptance of the Jefferson Street Alternate, and final approval by our consulting engineer. Said motion was seconded by Rev. Williams. Again the Chair made a poll of the individual members. With each of the five Commissioners again casting their vote as "Aye"; none abstaining or "Nay" votes, the motion was unani- mous y carried. The Inc. Comm. if hf ;hair said a representative of Hickey Construction Co., Mr. Gerald A. Hickey, is present and will meet with the ssion at a later date. President Helmen asked Mr. Hickey would say a few words. - 4 - PEDESTRIAN MALL CONTRACT NO. 5, R -66, AWARDED TO: HICKEY CONSTRUCTION CO., INC., AS STIPULATED PEDESTRIAN MALL CONTRACT NO. 2, R -66, AWARDED TO: EXTERIOR DESIGNING, INC., AS STIPULATED 4. NEW BUSINESS (Cont'd) Mr. Gerald A. Hickey, The Hickey Construction C "At this time, I don't feel I have anything to say. I will wait until we meet with the engineers and the Redevelopment Department in developing the work sche- dule and I am withholding comments at this time. "I want to thank the Board at this time and want to carry out as expeditiously as possible and with as little inconvenience to the Downtown merchants as we possibly can." Mrs. Janet S. Allen directed several questions to the Commission and he Executive Director, Mr. Charles F. Lennon, Jr.;In brief summ tion: 1) What is the amount of the Contracts? Mr. Lennon stated the first award to The Hickey Construc- tion Company, for the General Contract, is in the amount of $2,815,348.00; the next, the award to Exterior Design- ing, Inc., for the Landscape Contract, is in the amount of $206,474.00; or a total of $3,021,822.00, with the Alternates subject to negotiations. 2) Mrs. Allen's concern was to eliminate some of the wells, as the Paraplegics would not be able to go down in these, climb the bridges; saw no necessity for these things and the fountains, and certainly not when we were considering curbs for Paraplegics. President Helmen advised Mrs. Allen the Commission has been concerned with the Paraplegics, and the curb situa- tion is taken care of and in the Mall plans, and as to Mrs. Allen's request for the elimination items, the Com- mission will study and consider. 3) Engineer's estimate, her surprise that the four blocks were not included, and why we started out with the entire Mall at 2 -1/2 Million, made it 3 -1/2 Million, and now eliminate four blocks. She said she didn't care how much money we had allocated for interest. Mr. Lennon advised her this has all been public informa- tion, just as the information was in the two blocks on Michigan Street and two blocks on Washington Street- - these plans being tentative to correlate with Associates' plans. The engineering estimate was approximately $230,000 for basic things; adding the alternate items, the total was $3.5 Million Dollars over a year ago. The low bid is under our and the Engineer's estimate. It would be difficult to - 5 - 4. INEW BUSINESS (Cont'd) come in with $3 -1/2 Million Dollars and include the four blocks. Mr. Lennon advised interest is accruing with $3.8 Million Dollar Bond -- gaining approximately $180,000 - -that is pertinent -- adding interest to the cost of the bond. The accruing interest can be used to pay for the additional cost on the four blocks. 4) Mrs. Allen strongly opposed, as she stated: "We are duplicating what Michigan City has ", and firmly opposed the types of places for the people to sit, fountains and boulders, and above all the upkeep of the Mall, stating the Park Department has $180,000 *budgeted to take care of it and we should certainly consider this cost. Two of the Commissioners responded to her arguments against the Mall plans: a. Mr. Wiggins said to Mrs. Allen: We have taken action to move forward and have dealt in as realistic a fashion as we could. I take it you are opposed to the Mall, and you have every right to your opinion. b. Mr. Wade informed Mrs. Allen the Commission is here to protect the taxpayers' interests and will not let the taxpayers' money be dissipated, and have no in- tention of letting anything like that happen. The Commissioners have spent a lot of time on this. We have the best firms that money can buy to help. Officially, we are saying that this is going to be worked properly, efficiently, and economically. The Commissioners- -also as taxpayers - -are interested in the welfare of the people and are very interested in this Mall. 5.
