AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, AMENDING VARIOUS SECTIONS WITHIN CHAPTER 2,
ARTICLE 6, ENTITLED TAX ABATEMENT PROCEDURES OF THE
SOUTH BEND MUNICIPAL CODE REPEALING ORDINANCE NO. 8668-96
STATEMENT OF PURPOSE AND INTENT
The Indiana State Legislature has given to all communities the
ability to enhance development through a myriad of economic
revitalization programs .
The City of South Bend believes that its current guidelines in
this area should be upgraded in the effort to provide additional
incentives for some of the residential areas of our City to be
developed. The City believes that this ordinance meets the
definition of "economic revitalization area", and further believes
that there are additional factors which have prevented a normal
development of property or use of property which have resulted in
a lack of development and a cessation of growth.
Through the joint efforts of the city administrative branch
and the city legislative branch working together with concerned
citizens, this proposed ordinance is filed in the interest of
providing an additional tool to assist the City in combating the
restrictions imposed by state law addressing annexation, which have
also limited the growth and development of the City.
The areas designated in this ordinance are within the ten
percent (10%) guideline permitted under Indiana Code §6-1 . 1-12 .1-
2 (c) . It is believed that the following ordinance is in the best
interest of the City and would help bring needed economic
revitalization and development .
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, as follows:
Section I . Chapter 2, Article 6, Section 2-76 . 1 entitled
"Definitions" subparagraph (a) (20) of the South Bend Municipal
Code shall read in its entirety as follows :
(20) Residentially Distressed Areas (RDA) shall mean the
areas located within the City of South Bend as designated on the
attached maps and legal descriptions which are incorporated herein
by reference, are maintained in the Office of the City Clerk and
are available for public inspection during regular business hours .
RDA' s are generally described and labeled as follows :

(I) Are comprised of parcels that are either unimproved or
contain only one (1) or two (2) family dwellings or
multifamily dwellings designed for up to four (4)
families, including accessory buildings for those
dwellings; and
(II) Have dwellings which are not permanently occupied and
are:
(i) the subject of an order issued under Indiana Code
§36-7-9; or
(III) Have parcels of property in the area which:
(i) have been sold and not redeemed under Indiana Code
§6-1 . 1-24 and Indiana Code §6-1 . 1-25; or
(ii) are owned by a unit of local government;
or are found in the alternative to:
(I) Have a significant number of dwelling units within the
area which are not permanently occupied or have a
significant number of parcels in the area which are
vacant land; and
(II) Have a significant number of dwelling units within the
area which are:
(i) the subject of an order issued under Indiana Code
§36-7-9; or
(ii) evidence significant building deficiencies; and
(III) Have experienced a net loss in the number of dwelling
units, as documented by census information, local
building and demolition permits, or certificates of
occupancy, or the area is owned by Indiana or the United
States; and
The RDAs designated herein (plus any areas previously
designated under Indiana Code §6-1 . 1-12 .1-2) will not exceed ten
percent (10%) of the total area within the Council' s jurisdiction.
SECTION II . Chapter 2, Article 6, Section 2-77 . 1 entitled
"Single-family Construction" of the South Bend Municipal Code shall
be amended by the addition of the additional language:
(c) The grant of a residentially distressed area
designation is subject to the following conditions :
(1) The deduction will not be allowed unless the
dwelling is rehabilitated to meet the local code
standards for habitability.
(2) If a designation application is filed, the
Council may require that the redevelopment or
rehabilitation is completed within a reasonable
period of time.
SECTION III . Ordinance No. 8668-96 passed by the South Bend
Common Council on April 15, 1996, is hereby repealed.

First District
I am submitting for your consideration an amendment to our current
Charlotte Pfeifer provisions of the South Bend Municipal Code as it relates to action taken by the
Second District Common Council on April 15, 1996 regarding the granting of residential tax
abatements.

Third District The newly proposed Bill would repeal Ordinance No. 8668-96 and
further fine-tune our efforts to prevent continued decline in our City's
John Broden residential tax base in accordance with current state statutes.
Fourth District
Although our attempts to provide incentives for residential development
David Varner have met with some limitations,we have made tremendous progress in creating
Fifth District new housing opportunities in South Bend. The challenge that remains is to
increase awareness and appreciation at the state legislative level for the new
Thomas Zakrzewski housing dilemma South Bend faces. Through the first five (5) months of
Sixth District 1996, housing starts in unincorporated areas of St. Joseph County had
outpaced the City of South Bend 341 to 44(almost 8 to 1). Our state legislators
Sean Coleman must be persuaded that the health of our city is directly related to our ability to
At Large provide new housing opportunities across the broad spectrum of our population
base. Tax abatement will be required if we have any hope of protecting our
