AN ORDINANCE OF THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND, INDIANA,
APPROVING THE SALE OF PARK PROPERTY
STATEMENT OF PURPOSE AND INTENT
The City of South Bend, Indiana, for the use and benefit of
its Park Department and/or Board of Park Commissioners
(hereinafter, the "Park Department") owns certain real property
bordering the former Calvert Street between Rush Street and High
Street (hereinafter, the "Real Property") . Pursuant to I.C. 36-10-
4-9 (a) , said land is under the exclusive control of the Board of
Park Commissioners of the Park District of the City of South Bend
(hereinafter, the "Park Board") .
The Park Board has previously transferred property north of
Calvert Street to the South Bend Community School Corporation
(hereinafter, the "SBCSC") for use in the construction of the new
Riley High School.
Calvert Street, from Rush Street to High Street, was vacated
by the South Bend Common Council, in Ordinance 8707-96, on August
12, 1996. Upon said vacation, the Park Department acquired, by
operation of law, the southern half of the former Calvert Street,
bordering the Studebaker Golf Course, more particularly described
as follows:
Commencing at the Northeast corner of now vacated East
Calvert Street and South Rush Street, being the Point of
Beginning; thence South 30 feet along the East right-of-
way line of South Rush Street to the Centerline of
vacated Calvert Street; thence East approximately 898
feet along the centerline of vacated Calvert Street to
the West right-of-way line of South High Street; thence
North 30 feet to the North right-of-way of vacated
Calvert Street; thence West along the North right-of-way
line approximately 898 feet to the Point of Beginning.
Part situated in Henry Studebaker Park and South East
Addition to the City of South Bend, Indiana.
At its meeting of September 24, 1996, the Park Board
determined that the aforementioned property is not required for
park purposes and authorized the sale of Real Property bordering
the former Calvert Street between Rush Street and High Street to
the SBCSC.
Pursuant to I .C. 36-10-4-18, once the Park Board has
determined that land under its control is no longer needed for park
purposes, the Common Council shall determine whether to approve the
sale of such land.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I . The sale of the southern half of the previously
vacated Calvert Street, between Rush Street and High Street, as
described hereinabove, is approved.
