DORAU This is EXHIBIT K, consisting of 3 pages, referred to in and part of the Agreement between Owner and Engineer for Professional Services dated April 10, 2018. AMENDMENT TO OWNER -ENGINEER AGREEMENT Amendment No. 1 1. Background Data: a. Effective Date of Owner -Engineer Agreement: November 12, 2019 b. Owner: Board of Public Works, City of South Bend, Indiana ("Owner") C. Engineer: Chistopher B. Burke Engineering, LLC (CBBEL) ("Engineer") d. Project: East Race Sewer Analysis m(1m18-034) ("Project") 2. Description of Modifications: a. Engineer shall perform or furnish the following Additional Services: 1) Task 1— Revise Report: CBBEL will revise the current draft of the report based on the following new information: a) Updated SDC tables and numbers provided by the City b) New routing of sanitary sewage from Cascades Phase 2 & 3 which will result in a new Colfax Lift Station upgrade schedule. c) Pump data provided by the City that will replace the previously Population Equivalence (PE) calculations. CBBEL will utilize the updated calculations and the City's lift station standards to provide a revised report that will include updated recommendations. 2) Task 2 — Bid Documents and Permits: CBBEL will prepare plans and specifications for bidding purposes. CBBEL will use existing aerial images as the base for the plans. The project specifications will utilize INDOT standard pay items and special provisions when applicable. No topographic survey will be obtained as part of this project. CBBEL will prepare and submit permit applications to IDEM for the new lift station. 3) Task 3 — Design Coordination with the City: CBBEL will meet the City to discuss review comments on the plan submittals. The City anticipates three submittals and will include 30%, 60%, and 90% plan sets. A field check is also anticipated. At total of four (4) meetings have been included in this task. 4) Task 4 — Bidding Services: CBBEL will provide "As -Needed" Bidding and Services that include: a) Attend a Pre -Bid Meeting b) Respond to contractor questions and issue addenda (if needed). All rights reserved. c) Compile a certified bid tabulation sheet and assist City staff in analyzing the bids provided for an award recommendation. 5) Task 5 - Construction Engineering Services: CBBEL will provide "As -Needed" Construction Engineering Services that include: a) Attend the pre -construction meeting, review project submittals, and respond to design questions that come up during construction. b. The Scope of Services currently authorized to be performed by Engineer in accordance with the Agreement and previous amendments, if any, is modified as follows: N/A c. The responsibilities of Owner are modified as follows: d. For the Additional Services or the modifications to services set forth above, Owner shall pay Engineer the following additional or modified compensation: 1) Task 1: $$13,40 2) Tasks 2 through 4: J,20,000 3) Task 5: $5�,0 0 e. The schedule for rendering services is modified as follows: + Revised Report — four (4) weeks from receipt of updated data from City • Final Bid Documents — eight (8) weeks after approval of final report (dependent on City review process) f. Other portions of the Agreement (including previous amendments, if any) are modified as follows: 5. Agreement Summary (Reference only) a. Original Agreement amount: $ 25 000.00 b. Net change for prior amendments: $ 0.00 c. This amendment amount: $ 48 400.00 d.
