1. The South Bend Redevelopment Commission, Governing Body of the City
of South,Bend, Department of Redevelopment, met in a Special Meeting,
in Room 1200 County -City Building, 227 West Jefferson Boulevard, in
the City of South Bend, at 2:00 P.M., E.S.T., on the 2nd day of
February, 1970 - -the place, hour, and date, duly established for the
holding of such meeting.
The President called the meeting to order and the following Com-
missioners were present for the roll call:

2. This Special Meeting was convened pursuant to a duly dated and signed
Notice of Special Meeting which was hand carried and telephoned to
each Commissioner in due time, form, and manner as required by law.
Said Notice read as follows:
NOTICE OF SPECIAL MEETING TO THE COMMISSIONERS
OF THE SOUTH BEND REDEVELOPMENT COMMISSION,
GOVERNING BODY OF THE CITY OF SOUTH BEND,
DEPARTMENT OF REDEVELOPMENT'
Notice is hereby given that a Special Meeting of the South
Bend Redevelopment Commission, Governing Body of the City of
South Bend, Department of Redevelopment, will be held in Room
1200, County -City Building, 227 West Jefferson, in the `City of
South Bend, in the regular meeting place thereof, at 2:00 P.M.,
on the 2nd day of February, 1971, for the purpose of:

a. Urban Design Review Committee Procedures:
Mr. Ashenfelter presented the Regulations and.Guide-
lin s for Signs, Canopies, Awnings and Building
Facades, as prepared by Mathews, Purucker & Associ-
ates, Inc. and represented by Mr. Joseph Mathews in
this meeting. A memorandum prepared by Mr. Bruce
C. Fammerschmidt, Commission Legal Counsel, quoting
aut ority of the Redevelopment Commissioners to ap-
pro a proposed rehabilitation of existing structures
fro the Burns Indiana Statutes was distributed.

Hammerschmidt stated it is his feeling that the

Mr. Hammerschmidt said he also discussed with.Miss

It is believed that we can condemn over any mortgage,
public or private. Aesthetics and design can -be a
new trend in the law. He said this is his legal
opi ion; however, the Supreme Court.will be the
final determining factor. The same.`philosophy has
beei tested and there has been no violation of the
con titution. He said the language in the Urban
Ren wal Plan is sufficient and specific enough for
sta dard guidelines that can be up `in Court.
Mr. Hammerschmidt further said the joint venture
brochure sections on Signs, Canopies and Awnings are
excellent. However, relative to the Building Facades,
although not illegal, we are minimizing what the owner
has to accomplish. He would like here to:go back to
the urban renewal manual.
The Urban Design Review Committee analyzes each pro-
posal on an individual basis. If they are not comply-
ing.--either in Code or exterior aesthetics - -the Com-
mittee states in writing why the plan does not comply
with the urban renewal plan. The Committee should meet-
within two weeks of the submittal of proposals and plans.
The Commission should request the owners to submit under-
sta dable and specific plans and specifications, as well
as their financial plans and schedule for completion, so
the whole thing can be reviewed by the Review Committee`
and returned to the Commission with recommendations. There
is a definite commitment and understanding; i.e.`, the Com-
mission's power of enforcement is spelled out both'in the
Urban Renewal Plan and in the Indiana Statutes, along with
its power to acquire the property, refinish and sell it.-
Thi should be in the package we give to each owner. Keep
the standards high; you can always come down, but can't go
up.
Mr. Mathews advised we should not give them- too.many differ-
enct kinds of alternative's,-and was :- delighted at the restrictive
suggestions and was hoping this would be brought'up. The
Urban Renewal Plan provides that the Commission will provide'

Fessional architectural services when the owner
jests it. Mr. Wiggins advised in LaSalle Park
services were on a'consulting basis only, and
i on a per -hour basis. Mr. Matthews said some

Mr. Hammerschmidt said if an owner would do the
interior now and commit himself for the exterior
and not do it, the Commission's only remedy would
be to acquire the property, refinish and sell it.
We, however, must have a good reason for condemning
it. Mr. Mathews advised the building codes will take
care of the facades. Mr. Hammerschmidt advised we
must work with the Building Commissioner through a'
building permit to exercise our jurisdiction
A discussion followed. on making up a list of archi-
tects from which the owners could select. It was
stated many architects would not want to do this
type of work, but may wish to have their name on
the list.
Mr. Mathews advised they have to work with the South
BenJ BOCA Code and the Indiana State Legislation
usi g the more stringent rule. This is basic over
the whole county.
Mr. Hammerschmidt suggested that the Commission has
ample power under the Indiana Law to go ahead and use
the Urban Renewal Standards, and it be a matter of
pro edure that the.staff be instructed to contact the
own rs as soon as possible with a procedural package--
coda of operations- -get together a.;package of regula
d o s, rules, etc. The owner should furnish definite
pla s and specifications so the architects and engineers
will know exactly what will happen to the building.
Thef should have working drawings, and should also sub-
mit a financial plan, what their financing is, what is
ava table to do the work and time of accomplishment.
When this is submitted to'-the staff, it should immedi
ate y be referred to Review Committee and they then have,
som thing definite to analyze and can approve or refuse.
If ejected, in writing, state where the owner is not
complying with standards we have set up-and; if possible,
any suggestions for correct ion thereof. We can offer
the services of an architect up to four (4) hours of
consultation at our expense. It was recommended by Mr.
Wiggins and passed by unanimous'-consent to add one more
arc itect, Mr. Joseph Mathews,to the Urban Design, Review
Com ittee.

It was suggested to hire additional staff,.or have by
agreement one responsible for the i- nspections of.these
Downtown buildings to be rehabilitated. Mr. Hammer-
schmidt recommended hiring someone very competent for
legal reasons. Mr. Mathews suggested Mr. James McCarthy.
Mr. Hammerschmidt advised he did not believe we would
get into any legal probl,ems:;if. we do some of these
thi gs while going to the owners with friendly persua-
sio .
On motion by Mr. Helmen, it was recommended Mr—James
McCarthy be hired on a consulting basis and add a,.,
staff member in the office to administer rehabilitation.
This was passed by unanimous consent.
A s t of standard procedures will be given the owners
in rder to avoid litigation and to assure good public
relations. It was recommended that two more architects
be fired to evaluate the buildings in depth, at an hourly
rat E, bringing their findings back to the Urban Design
Rev ew Committee. This motion was passed by unanimous
con lent.
Mr. Hammerschmidt requested Mr. Barbe and Mr.;Bill Hammes,
fro his office, work together in assembling the proper
edures.
