General Provisions, Sec. 21-5 . Adoption of "Book of Maps. " by adopting a new set of maps. The Area Plan Commission of St . Joseph County, Indiana (hereafter, the Commission) heretofore adopted a Comprehensive Plan for South Bend, Indiana, pursuant to which the Zoning Ordinance (hereafter, the Ordinance) was adopted by the Common Council of South Bend, including and incorporating zone maps (hereafter, the Old Maps) . The Old Maps consist of two books of maps: the first being the book of "Zoning District Maps" , which were copies of "Sidwell ' s, Inc. " base maps with the zoning districts outlined with colors and the second being the book of "Height and Area Maps, " made by an "acetate shading pattern and film" process. The Old Maps are more that thirty years old and have become worn out, create maintenance problems, and no longer are satisfactory. The Book of Maps (hereafter, the Book of Maps) to be incorporated into this ordinance will replace the Old Maps. The Book of Maps will be identical in all respects to the Old Maps, but different only in that the Book of Maps are to be computer generated, consist of one Book of Maps, and have both the zoning districts and the height and area districts indicated by letters, or letters and numbers, placed directly on the Book of Maps . The Book of Maps therefore will be easier to maintain. The individual original maps which constitute the Book of Maps are dated April 22, 1996 and have been updated continually since. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS: • Section 1: 1 . The substitution of the Book of Maps showing zoning districts and height and area districts by letters or letters and numbers placed directly on the Book of Maps is ratified, approved, and confirmed. 2 . The Book of Maps shall be substituted for all the Old Maps . The Book of Maps now are incorporated into and made a part of the Zoning Ordinance . 3 . The Executive Director of the Commission shall, to the best of his abilities, preserve and protect the Old Maps as they existed, and 4 . The Book of Maps as adopted and amended from time to time and as hereafter amended shall be maintained and available for public inspection at the office of the Commission. Section 2 : NOW THEREFORE, BE IT FURTHER ORDAINED: 1 . That Section 21-5 . Adoption of "Book of Maps" . be deleted in its entirety and replaced by the following: Sec. 21-5 . Adoption of "Book of Maps (a) The use, height, area and other designations pertaining to the districts in this chapter are set forth in and on the "Book of Maps" hereby designated as a "Book of Maps, " together with all amendments thereto, and the proper notations, references and other information shown thereto are hereby adopted and by this reference made a part of this chapter with the same force and effect as though described and set out in full . (b) Certified copies of the Book of Maps, as adopted and further amended, shall be filed with the City Clerk and City Building Commissioner. Copies of the Book of Maps shall be open to public inspection at all times during normal business hours . Section III: This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and legal publication as required by law. As you are aware, there presently are separate zoning and height and area maps. Both sets of maps are old and difficult to maintain. The new maps that we have been working on, are computer generated and combine both the zoning and the height and area on one set of maps. We have reviewed these maps numerous times m our office and have also discussed them with Don Fozo, the Building Commissioner. These maps are now ready for adoption by the City. Attached, is a proposed ordinance that would adopt these maps. We ask that the Council have first reading on the proposed Bill at its August 12, 1996, meeting and refer the Bill to the Area Plan Commission for a public hearing.
