Re: AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, ANNEXING TO THE CITY OF SOUTH BEND CERTAIN TERRITORY
CONTIGUOUS THEREWITH LOCATED IN CLAY TOWNSHIP, ST. JOSEPH
COUNTY, INDIANA (IRONWOOD NORTH ANNEXATION)
Dear Mr. Kelly:
I am attaching for filing the above - referenced ordinance which annexes to the City certain
territory generally located north of State Road #23, west of Ironwood Drive, South of Dunn
Road (Hepler Street) and east of Willis Avenue.
You will recall that on August 12, 1996, the Council passed an ordinance, Ordinance No.
8702 -96, annexing virtually the same territory. The Mayor declined to sign that ordinance due to
an error of a technical nature in the legal description of the territory proposed for annexation.
The legal description in Ordinance No. 8702 -96 failed to include all public right -of -way
contiguous to the territory proposed for annexation, as is required by Indiana law for annexations
occurring after June 30, 1996. The attached ordinance corrects that oversight in the legal
'description.
Your favorable consideration is respectfully requested. Filed In Clerk's Office
Sincerely, AUG 2 ? 1996
