DU Attest: Presented by me to the Mayor of the City of South Bend, Indiana August 27, City Clerk President of Common Council 19 96 Approved and signed by me 19 141 City Clerk et-4e"" ` Mayor SUBSTITUTE BILL q ORDINANCE NO. 5 713 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROVING THE SALE OF PARK PROPERTY STATEMENT OF PURPOSE AND INTENT The City of South Bend, Indiana, for the use and benefit of its Park Department and /or Board of Park Commissioners (hereinafter, the "Park Department ") owns certain real property located at the southeast corner of Western Avenue and Chapin Street, and being more particularly described as follows: Parcel of land situate in SE 1/4 Sec. 11, T 37 N, R 2 E, City of South Bend, Portage Twp., St. Joseph County, Indiana and more particularly bounded and described as follows: Beginning at a point which bears south 0 002145" East 60.00 feet and North 89 057115" East 20.00 feet from the centerline intersection of Western Avenue and Laurel Street; thence along and assumed bearing of North 89 056145" East, parallel to and 60.00 feet South of the centerline of Western Avenue, 468.36 feet; thence along a 172.00 foot radius curve to the right through an internal angle of 16 005' an arc distance of 48.28 feet to a point on a 57.00 foot radius curve whose center bears South 16 001145" west; thence easterly along said 57.00 foot radius curve through an internal angle of 57 °461, an arc distance of 57.47 feet to a point on a 172.00 foot radius curve whose center bears south 73 047145 "; thence southerly along said 172.00 foot radius curve through an internal angle of 16 °05' an arc distance of 48.28 feet; thence south 0 007115" East 150.55 feet; thence South 4 041145" East 150.48 feet; thence South 0 007115" East 301.93 feet; thence South 89 059' West, 142.00 feet; thence North 0 °11130" West 29.95 feet; thence South 89 054130" West, 132.00 feet; thence South 0 008' East 82.39 feet; thence South 73 022105" West 52.77 feet; thence North 0 008' West 27.28 feet; thence North 74 020130" West 138.37 feet; thence North 0 015' West 19.44 feet; thence North 73 045' West 120.51 feet to a point on a 57.00 foot radius curve whose center bears North 16 015' East; thence easterly along said 57.00 foot radius curve through an internal angle of 194 003147" an arc distance of 193.06 feet to a point on a 20.00 foot radius curve whose center bears North 12 °11'13" East; thence Westerly along said 20.00 foot radius curve through an internal angle of 87 046102" an arc distance of 30.64 feet; thence North 0 002145" West along a line parallel to and 20.00 feet East of the centerline of Laurel Street 483.37 feet to the point of beginning. The Park Board has been approached by the South Bend Housing Authority, a governmental entity involved in the provision of affordable housing and related tenant development programs, concerning its interest in acquiring Oliver Park for use in the development of its Alonzo Watson Housing University/ Campus of Learners Project. At its meeting of August 19, 1996, the Park Board determined that Oliver Park is not required for park purposes, as all existing programs and facilities will be duplicated and enhanced by the proposed Campus of Learners, and authorized the sale of Oliver Park. Pursuant to I.C. 36- 10 -4 -18, once the Park Board has determined that land under its control is no longer needed for park purposes, the Common Council shall determine whether to approve the sale of such land. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. The sale of Oliver Park, as described hereinabove, is approved, subject to the condition that the South Bend Housing Authority receive the anticipated funding to complete the entire Campus of Learners Project. Section II. That Oliver Park be transferred by Quit -Claim Deed to the South Bend Housing Authority for the sum of One Dollar ($1.00) . Section III. This Ordinance shall be effective upon its passage by the Common Council and approval by the Mayor.
