o this memorandum is Resolution 3076 and Addendum To Master Agency Agreement for the
& Sidewalk Repair Project. The Addendum will provide $16,000 for curb & sidewalk repair at two
I locations.
The first r pair project is at the southwest corner of Michigan and Wayne Street in front of the new location
of Ciao's estaurant. The are several sections of broken brick banding and a couple curb sections that need
to be reel ced before the area is safe for patron activity in front of the restaurant area.
The second repair project is on Wayne Street immediately west of the Wayne & St. Joe Garage in front of the,
Library Bar. DTSB and the City have been working with the property on fagade upgrades and the repair work
will repair some broken walk sections, remove a driveway approach, and repair damaged GFI receptacle
units in the tree grates.
The timetne for this work is to open quotes with the Board of Public Works on September 25th and get the
work com leted in October.

LUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
APPROVING AND AUTHORIZING THE EXECUTION OF
AN ADDENDUM TO THE MASTER AGENCY AGREEMENT
(DTSB Curb & Sidewalk Repair)
WHEREAS, effective January 1, 2012, the South Bend Department of
ent, acting by and through its Redevelopment Commission (the
") .and the South Bend Board of Public Works (the "BPW ") entered into a

of th� Commission for certain projects during 2012; and
WHEREAS, pursuant to the Master Agency Agreement, the Commission desires

this Addendum.
NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment

Section 1. The Commission hereby approves the Addendum to Master
Agreement (DTSB Curb & Sidewalk Repair) and hereby authorizes its execution
in substantially the form attached hereto with such changes as the Commission may deem
or appropriate upon the advice of counsel, said execution thereof to be
,ive evidence of the Commission's approval of such changes. The Clerk is hereby
1 to file a copy of the Addendum with the BPW.
Section 2. This Resolution shall be in full force and effect after its adoption
by the Commission.

ADDENDUM TO
MASTER AGENCY AGREEMENT
(DTSB Curb & Sidewalk Services)

This Addendum to Master Agency Agreement (this "Addendum "), made and
into as of the 25th day of September, 2012, by and between the South Bend
Department of Redevelopment, acting by and through its Redevelopment Commission
(the `Commission ") and the City of South Bend, Indiana, a municipal corporation duly
and existing pursuant to the laws of the State of Indiana, acting by and through
its Beard of Public Works (the "BPW ") for purposes of the Commission designating the
BPW�to act as the Commission's agent to undertake the DTSB Curb & Sidewalk Repair
(the "Project ")
WHEREAS, effective January 1, 2012, the Commission and the BPW entered
into 4 Master Agency Agreement which authorized the BPW to act as agent for and on
of the Commission for certain projects during 2012; and
WHEREAS, pursuant to the Master Agency Agreement, the Commission desires
to ado the DTSB Curb & Sidewalk Repair to the Master Agency Agreement by way of

NOW, THEREFORE, in consideration of the mutual covenants and promises
herein, and for other good and valuable consideration, the receipt of which is
acknowledged, the BPW and the Commission agree as follows:
1. The Commission hereby empowers and appoints the BPW, pursuant to the
Agency Agreement, to act as the Commission's agent for the limited purpose of
for and managing the completion of the Project, the scope of said Project
more specifically described in "Exhibit A ", attached hereto and made a part hereof.
2. All of the terms and conditions of the Master Agency Agreement shall
this appointment and this Addendum shall be attached to the Master Agency
