BUILDING SITE, LANDSCAPING & ACCESSORIES This section focuses on individual properties and amenities. Building sites tend to be irregularly shaped, of varying topography and with different setbacks with regard to plots. Alleys are generally behind houses. Landscape accessories like fences are unique to each structure. Chapin Place presents a unique situation within the district. Applications from properties that have property lines on Chapin Park will be considered on a case-by-case basis. Required Fencing, walkways, outbuildings, private yard lights, signs (i.e. house numbers) and benches (visible from the street) as well as trees located in a yard or tree lawn which reflect the property’s history and development shall be retained. A tree located in such areas shall only be removed if the removal is required due to storm damage, disease, threatened damage to a structure or for such other reason acceptable to the Historic Preservation Commission. Storm damage or diseased trees should then be replaced with an approved species at the same or approximate location wherever possible. Fencing visible from the street in front of the structure shall be open (meaning spaces between the pickets) and consistent with the historic character of a structure enclosed. Weather report said 30-35 mph wind gusts for yesterday. I had to remove to make sure the public right of way was safe. Sec. 19-19. - Removal of hazardous trees by property owner; order, notice; emergency removal. a. Every owner of real estate within the City shall remove or trim any tree or shrub or any part thereof located on such real estate or in the tree and lawn area in front of such real estate which may be dead, diseased, unsightly, in a condition which is injurious or detrimental to the public health and safety or the growth of adjacent trees or which may project over the public street on which such real estate abuts in such manner as to obstruct the free passage of pedestrians and vehicular traffic on such public streets. b. The Board of Park Commissioners shall have the power and the authority to order and require such owner to remove any such tree or shrub by first causing notice to be served on such owner in the manner provided in section 19-21 not less than ten (10) days prior to the time designated in such notice for the removal or trimming of such tree or shrub. c. In case of an immediate necessity for any such removal or trimming by reason of storm or other emergency, such removal or trimming may be done by the Board of Park Commissioners or its Superintendent of Parks, and no notice whatever need be given thereof. Elicia Feasel from Historic Preservation has emailed me wondering what happened because it is a historic property and it would normally need HPC approval to remove. I let her know what happened. I was wondering if there was a way that you could replace the tree that was removed? Maybe add a street tree in the tree lawn. Department of Community Investment just received a favorable recommendation on a new zoning ordinance yesterday and part of that was a tree preservation program that would require the tree be replaced elsewhere if it is removed. This request would be something that is in line with there goals, and I'm sure your offices as well. If its not something you can do, no worries. I just figured I'd ask. Thank you.
