Bond and contract for the construction of Pavement on Ottowa Court from Vittula Avenue to L.S.& M.S.Ry,Under Improvement Resolution No. 220. was ,signed by C.H.DeFrees as prinicipal and American Surety Company of New York as sureties, was approved by the Board. Bond and contract for concrete pavement on Howard Street from Niles Avenue to Leeper Ave. under Improvement Resolution No. 217, signed by C.H.DeFrees and American Surety Company of New York as sureties, was approved by the Board. 'k-0 Bond and contract for bribk pavement on Pine Street from Napier Street to L.S.&M.S.Ry., under improvement Resolution No. 219* wigned. by C.H.DeFrees as prinicipal and American. Surety Company of New York as sureties, was appro ved by the Board. LOCAL SERER IMPROVEMENT RESOLUTIONNO. 262. Resolved by the Boa-rd of Public Works of the City of South Bend, County of St. Soseph,State of Indiana, That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon and not intended or ada- pted for receiving sewerage from collateral 'drains, be and the same is,hereby ordered in and along EDDY STREET ,PARRY STREET AND FRANCIS STREET as follo*s:- Beginning at the center of Mishawaka, Avenue and Eddy Street thence north along the center line of Eddy St. to the center of the alley along the north line of Beyer's first addition with and 19 inch pipe; thence still north along the center line of Eddy Street to the south line of Grand Trunk Western Railwey's Co's right-of-way with a 15 inch vitrified pipe sewer,. Also begin at the inter- section of Mishawaka Ave. Trunk sewer and Parry Street thence north along the center to the center line of Boulevard with an 19 inch pipe; thence still north along the center of Parry St. to the center of Alley between lots 17 and 20 Parry's second Addition with a o 15 inch pipe, thence still north along center of Parry St. to the center of Division Street with a 12 inch pipe. Also begin at the center of Parry St. and Boulevard thence westerly along the center line of the Boulevard to the center of Francis Street "thence north along the center of Frarrcis Street to the center. of Division Street with a 15 inch pipe sewer, together with the house connections to the curb line along the. line of said improvement, and said sewer, with all its appurtenances sha.11.be constructed in accordahee with the profile anc specif ea,tions now on file in the Office of the Department of Public Works of said City. The cost of said improvement shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all according to the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled "An Act concerning Muncicipal Corporations," approved Marc 6 21905. Assessments, if deferred, are to be paid in ten equal annual install- ments, with interest at the rate of Six Per cent per annzzm. A Bond or bonds shall be issued to the contractor in payment for such work, unless the propertyowners pay ,said assessments before said bond or bonds are issued. Under no circumstances shall the City of South Bend, be or be held responsible for any sum or sums due from said property owner or owners for said work, or for the collection of same, or for the payment of any bond or bonds,certi ficate or certificate, issued to said contractor in payment for such work, except for subh moneys as shall have been actually received by the City from the assessments for such improve- ment,, or such moneys as said City is by said above entitled Act required to pay. All pro- ceedings had, and work done in the making of said improvement, assessemtn of property, col-. lections of assessements and issuance of bonds therefor shall be as provided for in said above entitled Act. Notice of this resolution shall be published on the 6th. day of May,1913 and on the 13th. day of May,1913 in the South Bend Daily Times. Indiana, That the construction of a local sewer, intended and adapted only. for local use by the property holders whose property abuts thereon, and intended or adapted for receiving sewerage, from collateral drains be and the same is Q hereby ordered in ind along PORTAGE AVENUE FROM :FORTH LIFE OF MORRIS PARK ADD. TO THE NORTH LINE,' OF SECTION 34 T. 38 N.R. 2 E. as follows: — Beginning at the center of .Portage ave and the Alley along the North side of Morris Park Add. to the City of South Bend thence northwesterly along the center line of said Portage Ave. a, distance of 2700 ft. with a 15 inch pipe sewer; thence still northwesterly along the center line of Portage Avenue to the north line of section 34.T. 38 N.R. 2 E. with a 12 inch pipe s6we`r,,' together with the house connections to the curb line along the line of said improvement$ and said sewer, with ail its appurtenances shall be constructed in accord— ance with the profile and specifications now on file in the office of the Department of Public Works of said City. Resolved by the Board of Public Works of the City of South Bend,St. Joseph County,State of Indiana.That it is deemed necessary to improve PORTAGE AVENUE FROM THE NORTH LINE OF MORRIS PARK ADDITION TO THE NORTH LINE OF SECTION 341' 36 N.R. 2 E. By grading the said street from property line to property line and constructing cement curb and cement walks on both sides of said Portage Ave. from the north line of .Morris Perk Addition to the North line of Section 34 T.37 N.R. 2 East. And such improvement is now ordered, in accordance with the profile, details, drawings and specifications on file in the office of the Department of the Board of•Publie Works of said City; -and such improvement is now ordered. The cost of said improvement,including the cost of street and alley inter@ sections, shall be assessed upon the real estate abutting on said PORTAGE AVENUE all according to the method and manner provided for in an Act of the General Assembly of the State of Indi—. ana,entitled "An Act Concerning Municipal Vorporations," approved March 6219052and in accord- ance with and pursuant to the provisions of all~amendatory and supplemental acts thereto, passed by the General Assembly -of the State of Indiana;Assessments,if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. CONDEMNATION RESOLUTION NO.27.19130 Resolved by the Boardof Public Works of the City of South Bend, Indiana, That the following described property be--wpnvepriated for the use of said City: Beginning on the westerly lime of Portage Ave, end the north line of Morris Park Addition;thence westerly at right -angles to said Portage Ave'.' acid "d3's'tahbe' of fifteen feet; thence northwesterly par— allel with and fifteen ft. westerly from the westerly line of said Portage Ave. to the North line of Section 34 N.R. 2 E. thence east to a point fifteen feet easterly from the easterly line of said Portage Ave. measured at right angles, thence southeasterly parallel with and fifteen feet easterly from -the easterly line of said Portage Ave. to a point due east to the point of beginning thence west to the place of beginning.
