In the City of South Bend, Indiana. v/ Pavement on Ottowa Street from Vistula Avenue to L.S. & M. S. RY. , under Improvement Resolution No. 220. In the City of South Bend, Indiana. Bivement on Kemble Avenue from Prairie Avenue to Eying Avenue, under Improvement Resolution No. 226. "n the City of South Bendjndiana. Pavement on Howard Street from Leeper Avenue to Niles Avenue, under Improvement Resolution No. 217. In. the City of South Bend, Indiana. Pavement on Pine Street from Napier Street to L.S. & M. S. Ry. ,under Improvement Resolution No. 219. In the City ofSouth B*nd, _Indiana. /Excavation bond for One Thousand (1,000.00) Dollars signed by Staples and. Ackerman as prinicipal and American Surety Company of New Fork as suretiesq was approved by the Board. ,/Excavation bond for One Thousand (1,000.00)Dollars signed by Indiana & Michigan Electri Company, a corporation as prinicipal, and The Empire State Surety Company of New York as sureties, for the year of 1912�was released by the Board.. P/Petition received read and placed on file for the vacation 91ley running from Van Buren Street to Cushing Street,in rear Of Lots 2-4-5 in Studebaker's Sub. The same was referred to the City Engineer for investigation. ✓Contract for Grade, Curb and walks on Various Streets in the City of South Bend, Indiana under Improvement Resolution No. 242 was awarded to W. A. Fries, Contractor for the year 1913. 779 STREET OR ALLEY IMPROVEMENT RESOLUTION N0. 249. Be it resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, that it is desired and deemed necessary to improve DUNHAM STREET FROM HARRIS STREET TO ARNOLD STREET. By grading and paving the roadway also grading and paving of intersecting and entering streets and alleys lying within the portion of said Dunham Street not included in the roadway to be improved with ASPHALT,CREOSOTED W)ODEN BlioCKS,BITULITHIC OR BRICK laid upon a five inch portland cement concrete foundation or Brick laid upon a six inch gravel foundation, placing the necessary marginal curbs, storm water inlets and curbing the roadway with cement curb where the same has not ­lready been constructed. All as shown on plans in accordance with detail plans, profiles and specifications on file in the Board of Public Works of said City. And such improvement is now ordered. The cost of the improvement herein provided for, ex cept street and alley intersections, shall be paid by special assessment to be levied upon the property specially benefitted to the amount that the same may be legally assessed therefor, in accordance with an Act of the General Assembly of the State. of Indiana, entitled "An Act Concerning Muni cipal Corporations," approved March 6119052 and in accordance with and pursuant to the provisions of all acts amendatory and supplemental. thereto. The cost of all street and alley intersections, including one-half of the width of the improvement opposite street and alleys which run into, but do not cooss said roadway herein proposed to be improved and that portion of such street or alley abutting upon property belonging to said City, or upon property not subject to such assessment, shall be paid by the City in cash out of its general Rind, if able to do so, or from a fund cre- ated by a special assessment to be levied under the provisions of Section 108 of the above entitled Act. Assessments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A Bond or bonds will be issued to the Contractor to the amount of such deferred assessments in pro rata payment for such improvement. Under no circumstances shall the City of South Bend be, or be held re- sponsible for any sum or sums due from said property owner or owners for said work, or for the collection of the same, or for the payment of any bond, bonds, certificate or certi- ficates, issued to said contractor in payment for such work, except for such moneys*as shall have actually been received by the City from the assessements for such improvement, or such moneys as said City is by said entitled Act and amendments and supplements thereto required to pay. All proceedings had, and work done in the making of said improvement, assessments of property, collection of assessments and issuance of bonds therefor, shai 1 be as provided for in said -above entitled Act, and. Acts amendatory thereof and supplemental thereto. BE IT FURTHER RESOLVED, That the Board of Public Works fix the 23rd. day of May,A. D. 1913s at the hour of 7:45 P.M. at the office of the Board of Public Works, of this City, at the time and place for the public consideration of said proposed improvement at which said Board of Public Works will hear all persons interested, or whose property is liable to be assessed for said improvement, and will decide whether the benefits to the property liable to be assessed for said improvement will equal the estimated cost thereof. BE IT FURTBER RESOLVED, That notice of the time and place of such public consideration be published and mailed in the manner provided by law. Notice of this resolution shall be published on the 22nd. day of April 1913 and on the 29th. day of April 1913 in the South Bend Daily Times. Adopted this 19th. , day of Apri 1,3 �1. Resolved by the Board of Public works of the City of South Bend, Nounty of St. Joseph, State of Indiana, That the construction of a local sewer, intended and .adapted only for local use by the property .holders whose property abuts thereon, and intended or adapted for reciving sewerage from collateral drains be and the same is hereby ordered in and. along OLIVE STREET FROM HURON STREET TO A P0INT 100 ?EET SOUTH OF THE SOUTH LINE OF ,DIVISION STREET, as follows, ro-wit: - Beginning at the center of Olive Street and Huron Street; thence -north along the center line of said Olive Street to the center of Monroe Street with a 15 inch vitrified sewer pipe thence still north along the center line of said Olive Street to a point 100 ft. south of the south line of D vision Street with a 12 inch vitrified sewer pipe. Together -with the house connections to the curb line along - the line of said improvement and sa1d. sewer, with all its appurtenances shall be constructed in accordance with the profile and speci- fleations now on file in the Office of the Department of Public works Of said City. The cost of said improvement shall be apportioned against .and paid by the property holders whose property abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all according to the method and manner provided for in Act of the General Assembly of the State of -Indiana, entitled,"An Act Concerning -Municipal Cor- porations," approved March 6,1905. Assessments, if deferred, are to be paid in ten equal annual installments, with i rterest atthe rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment for such work, unless the pro - owners pay said assessments.'before said bondor bonds are issued. Under no cirsum- stances shall the City of South Bend or be held responsible for any sum' or sums due from property owner or -owners for.said work, or for the collection of same, or for the - collection of same or for the payment of any bond or bonds, certificate or certificate issued to said eont'ractor in payment for such work, except for such moneys as shall ,have been actually received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proceed- ings. had, and work done in the making of said improvement, assessment of property, col- lections of assessments acid issuance of bonds. therefor, shall be as provided for in said above entitled Act. Notice of this Resolution shall be published on the 22nd day of April 1913 and on the 29th. dray of April 1913 in the South Bend Daily Times. Be it Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, that it is desired and deemed necessary to improve HIGH STREET FROM SAMPLE STREET TO BROADWAY . By grading and paving the roadway, also, grading and paving the roadway of intersecting and entering streets andalleys lying within the portion of said High Street not included in the roadway to be improved with Asphalt, Bitulithic, Creosoted Wooden Blocks or Brick laid upon a five inch Portland cement concrete foundation or Brick laid upon a six inch rolled gravel foundation, placing the necessary marginal curb, curbing tfte roadway with cement curb where the same is not already curbed, also constructing the necessary storm water inlets. All as shown on plans, and in accordance with detail plans. poiles, and specifications on file in the office of the Board of Public Works of said'City. And m ch imp rov ement is now ordered.
