Contracters,for the amount of..,.*--*.* ................*03471*797 o ZContraetors bond for One Thousand ( 1,000.00) Dollars signed by Hugh Anderson as prinicipal and .the United States Fidelity &e Guaranty Company, of Baltimore,Md: as sureties was; approved by the Board. `/ A renewal of Bond No. 797153 for excavation signed by W.i. Braunsdorf and Fidelity and Deposit Co. of MD for One Thousand ($1',000.00)Dollars was approved by the Board. A renewal of Bond No. 652050 for excavation, signed by W. • H. Burke and the Fidelity and Deposit go. of Md.-for One Thousand ($1,000.00)D011ars was approved by the Board. ✓ Board ordered. a steel cabinet for the City Hall Building to be placed in the Board of Public Safety Room at the request of the aforesaid Board, from the Art Metal Construction Company of Jamestown, N.Y. In the matter of the Condemnation Resolution No. 20 for a highway on Sample Street south, all action was deferred on -same until May 9th. 1913 at 10:00 A.L. CONDEMNATION RESOLUTION NO. 26. Resolved by the Board of Public Works of the City of South Bend, Indiana: That the following described property be appropriated for the use of said City; Beginning at the north east corner of Lot 34 Stanfield and Foster Addition, thence north on the west line of Foster Street produced to the south east corner of Lot 6 in Dallmants Addition, thence east 60 feet to the south west corner of lot 15 in said Dallmant s Addition, thence south to the northwest corner of lot 33 in Sknfield and Fester Addition; thence west 60 feet to theplace of begining. The following described property may be injuriously or beneficially affected by such proceedings; is the property herein proposed to be appropriated and all the lots and parcels of lots and land in the following described territory as follows,to-wit: - Beginning on the south line of St. Vincent Street' and the First Alley east of Niles Avenue, thence south to the north line of Howard Street thence east on the north line of Howard Street to a point 107.17 feet east of the east line of Foster Street$ thence north to the south line of St. Vincent Street; thence west on the south line of St. Vincent Street to the place of beginning. Resolved by the Board of Public Works of the City of South Bend, St. joseph County,State of Indiana, That itis deemed necessary to improve BROADWAY FROM FRANKLIN STREET EAST TO IM VANDA°LIA RAILROAD, as follows,to-wit:- By grading said Street from property line to property line. and the construction of cement sidewalk and cement curb on both sides of said street where not already''constructed. All as shown on the plans and in accordance with the specifications, profiles and detail drawings on file in the Office of the Department ff Public Works of the City of South Bend, Indiana. And such improvement is now ordered, in accordance 'with the profile,, de- tails,, drawings and specifications on file in the office of the department of the Board of Public Works of said City; and such improvement is now ordered. The cost of.said improvement,.including to cost of street and alley inter- sections, shall be assessed upon the real estate abutting on said. BROADWAY FROM FRANKLIN STREET TO TBE VANDALIA RAILROAD, all according to .the method and manner provided for in an Act of the General Assembly of the State of Indiana, entitled "An Act Concerning Municipal Corporations," approved March 6,1905, and in accordance with and pursuant to the provisions of all amendatory and supplemental acts trjereto, passed by the General Assembly of the State. of Indiana. Assessments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per any. A bond or bo ds shall be issued to the contractor in payment of such work, unless the property owners pa said assessment before said bond or bonds are issued. Under no circumstances shall he City of South Bend, be , or be held responsible for any sum or sums, due from said property owner or owners for said work or for the collection of the same, or for the payment of any bond bonds, certificate or certificates, issued to said contractor in payment for such work except for such moneys as shall have been actualy received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled Act required $o pay. All proceedings had, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bonds therefore, shall be as provided for in said above entitled Act and amendments thereto. Notice of this resolution sball be published on the 31st. day of March 1913 and on the 7th. day of April 1913 in the South Bend Daily Times. In the matter of the Trunk sewer on Mishawaka Aveziue, under Improvement Resolution No. 177. The Board having the opening and awarding of these:ntract for said sewer,under advisement do hereby reject all bids and find that improvement Resolution No.177 should be and the same is hereby in all things rescinded. 75.8 TRUNK SEWER IMPROVEKENT RESOLUTION N0. 245. ✓ Resolved'by the Board of Public works of the City of South Bend, County of St. Joseph, State o.f Indiana; That it is desired and deemed necessary to construct a sewer IN MISHAWAKA AVENUE AND BETWEEN THE WESTERbY FND OF" SAID MISHAWAKA AVENUE AND THE ST. JOSEPH RIVER, all in slid City , which, from its sire and char- acter, is not only intended and adaptedfo use"_by property owners whose property abuts along the line of said sewer, but is also intended and adapted for receiving sewage from collateral drains already constructed or which may be hereafter con- structed, and the same is hereby ordered constructed in and along the following line in said City.to-wit:- Beginning on the easterly bank of the St. Joseph River at a point in; line with the center line of Mishawaka Avenue if produced, thence running south easterly in line with the center of said Mishawaka Avenue with a sewer fifty-four (54) inches in diameter to the ce ter line of Eddy Street; thence still south east- erly following the center line of said Mishawaka Avenue to a point One Hundred (100) feet east of the center line of Ermerson Avenue with a forty-eight (48) inch sewer, thence easterly along the center of Mishawaka Avenue to the center line of Greenlawn Avenue with a twenty-four (24) inch vitrified pipe sewer; thence east along the center line of said Mishawaka Avenue to the center of Ninth Street. with a twenty (20) inch vitrified pipe sewer; thence still east along the center of Mishawaka Avenue to the center of Twelfth Street with an eighteenth (1E) inch vitrified pipe sewer;- thence still east along the center of Mishawaka Avenue to the center of Sixteenth Street with a fifteen (15) inch vitrified pipe sewer, together with the house connections to the curb line along the line of said improvement, And to be built in accordance with the profiles, specifications, detai detail plans; maps and estimates now on file in the office of the Department of Public Works of said City, which includes an estimateof the proportion that the cost of an adequate local sewer, built along the above line, -bears to the cost of the main sewer, to be built as follows: The cost of an adequate local sewer, built along the line above described, is hereby estimated and fixed to be Forty Three (43%) per cent of the cost of the main sewer to be built along said line as aboee set -forth, which proportion, as herein estimated and fixed, shall be taken and adapted in all computa- tions requiring a knowledge of the cost of such local sewer if built along the line where the main sewer is to be built. The cost of the construction of said sewer shall be divided as follows: 1. - So much of such cost as shall be equivalent to the construction of an adequate local sewer not adapted to receive sewage from collateral drains or sewers' if built along the proposed line as hereinabove set- forth, shall be paid by the abut- ting property holders and the City of South Bend, if it be determined that said City s is benefited by said sewer in the same manner and to the same extent as local sewers are paid for by them, under the Statutes in such cases made and provided. li 2. The excess of cost over and above what would 'be equivalent to the cost of a local sewer, if built along said line, shall be assessed against each piece Of property in the district or area to be drained and against the City, if it be deter- mined that the said City if benefited by t e said sewer' according to the manner and method preseibed by law, all of which said property beneficially affected lies within the following described territory in the City of South Bend, County of St. Joseph, and State of Indiana,to-wit:- Beginning at the intersection of the northerly bank of the St. Joseph River and the center line of the first north and south alley west of Frances Street, in said City; thence running north along the center line of said alley to the center of Division Street; thence east along the center of Division Street to the center line of the Grand Trunk Western Railway Company's Righty of Way:- thence easterly along the center line of said Railway Company's right of way to the center 6 of Greenlawn Avenue; thence north along the center of said Greenlawn Avenue t- the center of the road along the north line of Section 7, Township 37 North, Range 3 East; thence east along the center of said road to the center of Nineteenth' Street thence south along the center of Nineteenth Street to a point one hundred fifty (150) feet south of the south lino of Mishawaka Avenue thence west parallel with and one hundred fifty (150) f- et south of the south line of said Mishawaka Avenue and Mishawaka Avenue produced to the easterly bank of the St. Joseph River; thence north westerly following the easterly bank of said river to a point in line with the center line of the first north and south alley west of Frances Street which point is 6 the place of beginning. 55 9 Friday Mar Said improvement shall be known and designated as THE MISHAWAKA AVENUE TRUNK SEWER, Under Improvement Resolution No. 245, in the City of South Bend, Indiana. .AAd each piece of ;property in said district or arm -above described, in- cluding abutting property holders and the said City of South Bend, if the said City is benefited, shall be assessed, as aforesaid, to pay said excess of cost over and above what would be equivalent to the cost of a local sewer; all 6f which will more Rally appear by reference to the profiles, map,drawings and specifications now on file in the office of the department of Public Works of said City, which, among other things, gives the exact course of said proposed main sewer, overflows, and its appurtenances, and the district or area which may be injuriously or beneficially affected thereby, as shown by the heavy boundary lines marked on said map and drawings, with proper words and figures written there- on, clearly indicating what said heavy boundary lines represent, and the district 'or ares: embraced thereby. In the above matter no remonstrators appeared, but a remonstrance was filed. The Board therefore after due consideration find in each and every case in sad said improvement that the benefits to the property and to the City of South Bend, are equal to the estimated cost of said improvements and the same are hereby in all things ratified, confirmed and approved. Be it resolved that notices be published in the South Bend Dail,* Times on the 31st. day of March 1913 and on the 7th. day of April 1913 to the effect that this Board will receive bids for said improvement up to 10:00 A.M. on the 22nd. day of Apri1,1913.
