TRUNK SEWER IMPROVEMENT RESOLUTION NO. 243
RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND,COUNW
OF ST. JOSEPH, STATE OF INDIMA; That it is desired and deemed necessary to construct
a sewer IN INDIANA AVENUE FROM KEMBLE AVEWJE TO FRANKLIN STREET all in said City, whin
which, from its size and character, is not only intended and adapted for use by pro-
perty owners whose property abuts along the line of said sewer, but is also intended
and adapted for receiving sewerage from collateral drains 'already constructed or which
may be hereafter constructed, and the same is hereby ordered constructed in and along
-the following line in said City,to-wit:-
Beginning at the center of Kemble Avenue and.
the north curb; line of Indiana Avenue. -thence on a curve to the left with a radius of
30 feet to the east to the. east line of Kemb le Avenue with a single ring, 22n =inch
by 33 inch brick sewer, thence east on the center line of Indiana Avenue to the center
of Scott Street with a 24 inch vitrified pipe sewer, thence still east along the center
of said Indiana Avenue to the west curb line -of Franklin Street with a 20 inch
.vitrified pipe sewer. Together with tree necessary manholes, inlets and house con-
nections to the curb line along the line of said improvement.
And to be built in accordance with the profileg
specifications, detail plans, maps and estimates now on file in the office of the
Department of Public Works of said City, which includes an estimate of the proportion
that the cost of an adequate loc 1 sewer, built along the above line, bears to the
cost of the main sewer, to be built as follows:- The cost of an adequate local sewer,
built along the line above described, is hereby estimated and fixed to be 50% o•f the
cost of the main sewer to be built along said line as above set forth, which propor-
tion, as herein estimated and fixed shall be taken and adopted in all computations
requiring. a knowledge of the cost of such sewer if built along the line where the main
sewer is to be built. The cost of the construction of said sewer shall be divided as
follows:
1. So much of such cost as shall be equivalent to the construction of an
adequated local sewer not adapted to receive sewage from collateral drains or sewers,
if built along the proposed line as hereinabove set forth shall be paid by the abut-
ting property holders and the City of South Bend, if it be determined that said City
is benefited by said sewer in the same manner and to the same extent as local sewers,
are paid for by them, under the Statutes in such cases made and provided.
2. The excess of cost over and above what would be equivalent to the cost
of a local sewer, if built along said line, shall be assessed against each piece of pre
perty in the district or area to be drained and against the City, if it be determined
that the said City is benefitted by the said sewer, according to the manner and method
prescribed by law, all of which said property beneficially affected lies within the
following described territory in the City of South Bend, County of St.Joseph, and
State of Indiana,to-wit:-
Begin at the center of Kemble Avenue and the north line of Indiana
Avenue, thence east along the north line of Indiana Avenue 130 feet, thence north
150 feet, thence east 75 feet, thence north to the center of the Indiana & Lake
Michigan Railway Co. right of way, thence east along the center of said right of way
a point 136 feet west of west line of Franklin Street, thence south parallel with and
136 feet west of the west line of Franklin Street to a point 150 feet north of the
north line of Indiana Avenue, thence east 36 feet, thence south 150 feet to the north
line of Indiana Avenue, thence east to the east line of Franklin Street, thence south
to a point 150 feet south of the south of the south line of Indiana Avenue, thence
east 149 feet, thence south parallel with and 149 feet east of Franklin Street to a
point 130 feet north of the north line of Calvert Street, thence west parallel with
and 130 feet north of the Forth line of Calvert Street to a point 150 feet east of the
east line of Kemble Avenue, thence north parallel with and 150 feet east of the east
line of Kemble Avenue to a point 150 feet south of the south line of Indiana Avenue,
thence west 50 feet, thence north 150 feet to the south line of Indiana Avenue, thence
west along the south line of Indiana Avenue 130 feet to the center of Kemble Aveme,
thence north 60 feet to the place of beginning.
SAID IMPROVEMENT SHALL BE KNOWN AS THE INDIANA AVENUE TRUNK SEWER FROM

And each piece of property in said district or area above described, in-
cluding abutting property holders and the said City of South Bend, if the said City is
benefited, shall be assessed, as aforesaid, to pay said excess of cost over and above
what would be equivalent to the cost of a local sewer; all of which will more fully ap-
pear by referene, to the profiles, map, drawings and specifications now on file in the
office of the Department of Public Works of said City, which, among other things, gives
the exact course of ,said proposed main sewer, overflows,, and its appurtenances, and the
district or area which may be. injuriously or beneficially -affected thereby, as shown
by the heavy boundary lines marked on said map and drawings, with proper words and figures
written thereon, clearly indicating what said heavy boundary lines represent, and the
district or area embraced thereby. Assessments if deferred, are to be paid in ten equal
annual installments, with interest at the rate of six per cent per annum. A bond or bonds
shall be issued to the contractor in payment for said work, unless the property owners
pay said assessments before said bond or bonds are issued. Under no circumstwnces shall
the Cityof South Bend be or be held responsible for any sum or sums due from said pro-
perty owner or ownersfor waid work, or for the collection of the same, or for the payment
of -Any bond or bonds, certificate or certificates issued to said contractor in payment
for such work, except for such moneys as shall have been actually received by said City
from the assessments for such improvements.
All proceedings had and work done in the construction of said main. sewer and
its appurtenances, manner of assessments of property, collection of assessments and is-
suance -of bonds therefor, shall be provided for in an Act of the General Assembly of the
State of Indiana entitled "An Act Concerning Municipal Corporations," in matters pertaining
to the constitution, alteration and maintenance of public drains and sewers, providing for
theconstruction , alteration and maintenance of such sewers and. drains in such cities and
within four miles thereof$ also providing for the assessments of property specially bene-
fited thereby for the payment thereof, in whole or in part, and for tLLe collection of such
assessments; repealing all laws and parts of laws in conflict therewith, and declaring
an e,ergency ,approved March 6,1905, and all acts supplementary and amendatory thereto
passed by the General Assembly of the State of Indiana.
Notice of this resolution shall be published on the 27th. day of March 1913
and on the 3rd. day of April 1913 in the South Bend Daily Times. This Board will give a
hearing on this resolution at its office in the City Hall on the 25th. day of April,1913
at 7:45 P.M.

LOCAL SEWER IMPROVEMENT RESOLUTION
NO. 244.
RESOLVED BY THE BOARD OF PUBLIC MKS OF TFIE CITY OF SOUTH BEND,COUNTY OF
ST JOSEPH,STATE OF INDIANA, That the construction of a local sewer, intended and
adapted only for local use by the property holders whose property abuts thereon, and
not intended or adapted for receiving sewerage from collateral drains, be and the
same is, hereby ordered in and along the following described streets to -wit: -
Begin at the intersedtion of the center of Sample Street and Grant Street
thence north oath(- center line of Grant Street 325 feet with a 10 inch vitrified
pipe sewer. ALSO; Begin at the center of Sample Street and Lincoln Street, thence
north on the center of said Lincoln Street 490 feet with a 10 inch vitrified pipe
sewer. ALSO; Begin at the center of Sample Street and Pulaski Street; thence north
on the center of said Pulaski Street 530 feet with a 10 inch vitrified Pipe sewer.
ALSO; Begin at the center of Sample Street and Kosciuszko Street, thence north on the
center of said Kosciustiko Street 530 feet with a 10 inch vitrified pipe sewer.. ALSO.
Begin at the center of Sample Street and Harris Street, thence north on the center
line of Harris Street to the center of Dunham Street with a 15 inch vitrified pipe

Together with the necessary mahboles, inlets and house connections to the curb line
Along the line of said improvement, and said sewer, with all its appurtenances shall
be constructed in accordance with the profike and specifications now on file in the
office of the Department of Public !Forks of said City. The cost of said improve-
ment shall be apportioned against and paid by the property holders whose property
abuts thereon, and upon the City of South Bend if -the City is benefitted by said
improvement, all according to the method and manner provided for in Act of the
General Assembly of the State of Indiana, entitled "An Act Concerning Municipal
Corporations," approved March 651905. Assessments, if deferred, are to be paid in
ten equal annual intiallments, with interest at the rate of Six per cent per annum.'
A bond or bonds shall be issued to the contractor in payment for such work, unless.
the property owners pay said assessments before said bond or bonds are issued. Under
no Circumstances shall the City of South Bend be or be held responsible for any sum
or sums due from said p.rpperty owner or owners for said work, or for the collection
of same, or for the payment of any bond or bonds, certificate or certificates, is-
sued to said contractor in payment for such work, except for such moneys as shall
have been actually received by the City from the assessments for such improvement,or
such moneys as said City is by said above .entitled Act Act required to pay. All
proceedings had, and work done in the making of said improvement, assessment of
property, collections of assessments a:.d issuance of bonds therefor, shall be as
provided for in said above entitled Act.
