All members present. `Representative of the Indiana & Michigan Electric Company appeared before the Board asking for a temporary permit for the placing of twelve (12) poles on the East side of South Chapin Street south from the Grand Trunk tracks. The same was approved subject to the Ordinance governing the Under -ground district. d Clerk made a repDrt of the balances for the month of February 1913. PIPE SEVER IMPROVEMENT RESOLUTION NO. 232. Resolved by the Board of Public Works of the City of South Bend, j County of St. Joseph, State of Indiana. That the construction of a local sewer, in- tended and adapted only for local use by the property holders whose property abuts there on and not intended or adapted for reciving sewerage from collateral drains, be and the same is, hereby ordered in and along Kenwood Avenue, Anthony Street and Bertrand Street from Meade Street to a point about 40 of McCartney Creek, as, follows to-Vit Beginning at the intersection of Meade Street and Kenwood Avenue, thene thnee west along the center of Kenwood Avenue to the center of Anthony Street with a 20 inch vitrified pipe sewer, thence north ,along the center of Anthony Street to the center of Bertrand Street with an 18 inch vitrified pipe sewer, thence west along Bertrand Street 1293 feet with an 18 inch vitrified pipe sewer, thence northwesterly 220 feet to a point 40 feet east of McCartney Creek with an 18 inch vitrified sewer. Together with the necessary manholes, Inlets and House Connections to the curb line along the line of improvement. All as shown on the plans, and in accordance with the profiles, detail drawings and specifications on file in the Office of the Department of Publi a Works of the City of South Bend, Indiana. And such improvement is now ordered and said sewer with all its appurtenances shall be constructed in accordance with the profile and specifications now on file in the office of the Department of Public Works of said City. The cost of said improvement shall be apporitioned against and paid by the property holders whose property abuts thereon, and upon the City of South Bend if the City is benefited by said improvement , all according to the method and manner provided for in Act of the General Assembly of the State=of Indiana, entitled "An Act Concerning municipal Corporations," approved-Mareh 6th. 1905• Assessments, if deferred,, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessments before said bond or bonds are issued. -Under no circumstances shall the City of South Bend be or be held responsible for any sum or sums due from said property owner or owners for said work, or for the collection of same, or for the paymen of any bond or bonds, certificate or certificates, issued to said contractor in pay- ment for such w kk, except for such moneys as shall have been actually received by the City from the assessments for such improvement, or such moneys as said City is by said entitled Act required to pay. All proceedings had, and work done in the making of said I mprovement assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act. Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for receiving sewerage from collateral drains, be and the same is, hereby ordered in and alo�lg LAFAYETTE STREET AND PARKOVASH AVENUE FROM TONTI AVENUE TO TECUMSEH AVENUE as follows ,to -wit:- Beginning at the intersection of Tonti Avenue and Lafayette Street thence north- along the center of Lafayette Street to the center of Parkovash Avenue with an 18 inch vitrified pipe sewer, thence easterly along Parkovash Avenue to Tecumseh Avenue with a 15 inch vitrified pipe sewer. Together with the necessary Manholes, Inlets and House Con- nections to the curb 'line along the line of said improvement. All as shown on plans, and in accordance with the profiles detail drawings and specifications on file in the Office of the Department of Public Forks of said City. And such improvement is now ordered and said sewer with all its appur- tenances shall be constructed with the profile and specifications now on file in the office of the Department of Public Works of said City. Together with the necessary manholes inlets and house connections to the curb line along the line of said improvement. JOSEPH RIVER TO ANGELLA AVENUE$ Also in the FIRST ALLEY NORTH OF NORTH SBDRE DRIVE FROM IROQUOIS STREET to a point 60 FEET WEST OF THE WEST LINE OF LAFAYETTE STREET as fflllows,to--wi.t:- Beginning at the St. Joseph RiVer and the center of Iroquois Street, thence north along the center of Iroquois Street to the center of Tonti Avenue with a 24 inch vitrified pipe sewer, thence still north along the center line of Iroquois to the center of Parkovash Avenue with a 20 inch vitrified pipe suer, jahence still north along the center of said Iroquois Street to the center of Angella Street with a 18 inch vitrified pipe sewer.
