Allmemberspre-sent'. k1 the Board approved of the following report from the City Eaglheier 'and ordered payment of same to the City Treasurer. To the Hon. 'Board of Public Works, 'of the City of South Bendq Indiaaa. Gentlemen: - I find the BoWMan Cemetery Association should be rebated $10..45 on account of the Bowman Creeksewer easement for the part which is used for cemetery purposes. Yours very truly W. S. MOORS, City Engineer. Warranty Deed received from Edward B. & Anne Swygart donating right-of-way on Sumption Prairie Addition from Prairie Avenuesouth. The same referred to the City Civil Engineer for investigation* GRADE9CURB AND WALK IMPROVEMENT RESOLUTION NO* 230- Resolved by the Board of Public Works of the City of South Bend$ St. Joseph County, State of Indiana. That it is deemed necessary to, improve OAKLAND STREET FROM MICBIGAN STREET TO THE TERRE HAUTE AND LOGANSPORT RAILWAY, as followsq to -wit: - By grading said street from property line to ptoperty line* and the construction of cement sidewalk and cement curb on both sides of said street*' All as shown on the plans,, and in accordance with the profiles, detail drawings and specifications on file in office of the Department of PublieWorks of said City. And such improvemebt is now ordered in accordance with the profile, details.,,drawings and specifications on file in the office of the Department of the Board of Public. Works of said City:- and such improvement is now ordered. The cost of said improvementt including the cost of street and alley intersectionsl.shall be assessed upon the real estate abutting on said OAKSIDE STREET FROM MICHIGAN STREET ,TO THE TERRE HAUTE AND LOGANSPORT RTI, all according to the method and manner provided for in an Act of the general Assembly of the State of Indiana, entitledg*An Act Concerning Municipal Corporations$" approved March 6,1905 and in accordance -with and pursuant to the provisions of -all amendatory and supple- mental acts thereto, passed by the General' Assembly of the State oflIndiana. Assess ments, If deferred, are to be paid in ten equal -annual installments, with interest at the rate of Six per cent per annum. A Bond or bonds shall be issued to the con- tractor in payment of such work, unless the property owners pay said assessment be- fore said bond or bonds are issued. Under no circumstances shall the City of South Bedd,) be, or ben held responsible for any sum or sums ,due from said property owner or owners for said work or for the collection of the same, or for the payment of airy bond, bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proceedings -had, and work done in the making of said improvement, assessment of.propertyt collection of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act and amendments thereto. Notice of this resolution shall be published on the .7th. day of March 1913 and on the 14th. day of March 1913 in the South Bend Daily Times. This Board will give a hearing on this resolution in its office in the City Hall on the 11th. day of April 1913 at 7:45 P.M. Adopted this fifty day of March.1913- Board of Public Yorks. LOCAL SEVER IMPROVEMENT RESOLUTION NO. _ 231., Resolved by the Board of Public forks of. the City of South Bend, County of St. Joseph, State of Indiana, That the construction of a local sewer2 intended and adapted only for local use by the property, holders whose property abuts thereon, and not intended or adapted for receiving sewerage from _collateral drains, be and the same is, hereby ordered in and along Eighteenth Street from the St. Joseph River to Mishawaka Avenue and in Mishawaka Avenue from Sixteenth Street to Nineteenth, Street as follows, to -wit: - Beginning at the St Joseph River and ,the center line of Eighteenth Street, thence north along the center line of -Eighteenth Street to the alley south of Pleasant Street with a 15 inch vitrified pipe -sewer.) thence still north,along the. said center line of Eighteenth Street to the center of Mishawaka Avenue with a 18 inch vitri- fied pipe sewer. Also begin at the intersection of the center of Eighteenth Street and Mishawaka Avenue thence west along the center line of Mishawaka Avenue to the center of Seventh Street with a 12 inch vitrified pipe sewer, thence still west along the center of Mishawaka Avenue to a point about 30 .feet .east of Sixteenth Street with a 10 inch vitrified pipe sewer. Also begin at the center of Mishawaka Avenue and Eighteenth Street, thence east along the center of Mishawaka Avenue to the curb line of 'Nineteenth Street with a 10 inch vitrified pipe sewer. Together with the necessary manholes inlets and house conections to the curb line along the line of said improvement. All as shown on the plans, and in accordance with the profiles, detail drawings and specifications on file in the office of the Department of Public.Works of,said City. And such improvement is now ordered , and said sewer, with all its appur- tenances shall be constructed in accordance with the profile and specifications now on file in the office of the Dppartment of Public !forks fff said City. The cost of said im- provement shall be apportioned against and .paid by the property holders whose property abuts thereon, and upon the City of South Bend if the City if benefited by said improvement all according to the method and ma;-mer provided for in Act of the General Assembly of the State of Indiana, entitled "An Act Concerning Muncipal Corporations," approved March 6, 1905. Assessments, if deferred, are to be paid in ten equal annual installments, with in- terest at the rate of Six per cent per annum. A Bond or bonds shall be issued to the con- tractor in payment for suh work, unless the property owners pay said assessments before said bond or bonds are issued. Under no circumstances shall -tide City of South Bend be or be' held resphnsible for any sum due from said property owner. or owners for said work, of for the collection of same, of for the payment of any bond or bonds, certificate of certificates issued to said contractor in payment for such work, except for such moneys as shall have been. actually received by the City from the assessments for such improvement, or such moneys as said City ,is by said above entitled Act required to .pay. All proceedings had, and work done in the making of said improvement, assessment of property, collections of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act. Notice of this resolution shall be published on the 7th. day of March 1913 and on the .14th. day of March 191- t-hes South Bend Daily Times. This Board will. give a hearing on this resolution at its office in the City Hall on the llth. day of April 1913 at 7:45 P.M. Adopted tais fifth day of March 1913, President.
