o'i Board met in regular session at 10:00 A.M. Mr. Bastian absent. Petition received by the Board for a curb and walk on Tan Buren Street from Howard Avenue to Sancome Avenue. The same was read and referred to the City Engineer. .,'Petition receieved by the Board for a Trunk Sewer on Meade and Bertrand Street from Intersection of Kenwood Avenue and Meade Street to Bertrand Street, west on Bertrand Street to west end of Street as now platted. The same was read and referred to the City Engineer for investigation. Bids received and opened for Grade on Michigan Avenue from Olive Street to 1436.feet west, Under -Improvement Resolution No. 183. The same were referred to' the City Engineer for tabmlation. Engineer submitted an estimate cost of the Eddy Street Trunk Sewer Improvement from Jefferson Avenue to Division Street at .............. ....................3,3pO.O0 The Board ordered that Electire lights be placed at the following places. On light on Cedar Street between Notre Dame and St. Peter Street, oppoitte the rear entrance to the St. Joseph Hospital. One light at the intersection of Hudson Avenue and Woodward Avenue. The following petition was rectived and approved by the Board. BOARD OF PUBLIC WORKS, South Bend, Ind.. Gentlemen: - We expect to rebuild our lines on Johnson and Linden Street, and find it will be necessary to set 4 - 35' poles on Linden Ave., just west of Johnson . We will also want to move poles from Linden St. west of Olive to the first alley south, By doing this we expect to remove some poles on Carlisle and Orange Ste and also on Olive Street. If your inspector will see Mr. Jennings of this Company, he can tell him exactly where the poles will be placed. Yours truly, C. S. KENNEDY. Asst. Also remove all Indiana & Michigan Electric Poles off Linden Avenue west from Olive Street. -, 699 STREET OR ALLEY IMPROVEMENT RESOLUTION NO. 217. Be it resolved by the Board of Public !Forks of the City of South Bend, St. Joseph °County, State of Indiana, that it is desired and deemed necessary to improve HOWARD STREET FROM LEEPER AVENUE TO NILES AVENUE as follows,to—wit:— 16 By grading said Howard Street from Curb line to curb line, and paving the roadway its full -width and seven(7) inches in depth with n. Portland Cement gravel Concrete Pavement. Placing the necessary marginal cement curb and the construction of the necessary storm water in— lets.. All as shown on the plans, and in accordance With the profiles, detail drawings and specifications on file in the office of the Department, of.Public Works of said City. And such improvement is now ordered . The cost of the improvement herein provided for, except street and alley intersections, shall be paid by special assessment to be levied upon the property specially benefited, to the amount that the same may be legally assessed therefor, in accordance with an Act of the General Assembly of the State of Indiana, entitled "an Act Concerning Municipal Corporations,* approved March 6,_ 1905 , and in accordance with and pursuant to the provisions of all acts amendatory and supplemental thereto. The cost of all streets and alley intersections, including one—half of the width of the improvement opposite street and alleys which run into, but do, not cross said -roadway herein proposed to be improved and that portion of such street or alley abut— ting upon property belonging to said City, or upon property not subject to such assessment shall be paid by the City in cash out of its general fund, if able to do so, or from a fund created by a special assessment to be levied under the provisions of Section 108 of the above entitled Act. Assessments of tel dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per anaum. A bond or bonds will be issued to the contractor to the amount of such deferred assessments iri pro rats payment for such improvement. Laid on a five (5) inch Portland cement gra vel foundation. Bitulithic, Brick or Creososted Wooden Blocks, Laid on a five (5) inch Portland cement gravel concretefoundation. Joseph County, State of Indi na, that it is desired and deemed necessary to improve PRAIRIE AVENUE FROM 'WEBSTER STREET TO GRANT STREET as follows, to-witL- By grading said Prairie Avenue from property line to property line, and the construction of cement sidewalks and cement curbs-. on. both sides, and paving strip df the roadway eighteen (19) feet wide and seven (7) inches in depth with a Port- land Oement Gravel Concrete Pavement. Placing the necessary marginal cement curb, also the construction of the necessary storm water inlets. All as shown on the plans, and in accordance with the profiles, detail drawings and specifications on file in the Office of the Department of Public Works of said City. And such improvement is now ordered. BOARD OF PUBLIC WORKS. 704 ✓ LOCAL SEWER IMPROVEMENT RESOLUTION NO. 222. Resolved by the Board of Public Works of the City of South Rend, County of St. Joseph, State of Indiana. That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon. and not intended or adapted for receiving sewerage from collateral drains, be and the same is hereby ordered in and along QUINCY STREET FROM PORTAGE AVENUE TO BLAINE AVENUE as follows,to—,wi.t:— Beginning at the center of Portage Avenue and Quincy Street thence west along the center of Quincy Street to the center of Harrison Avenue with a 12 inch vitrified pipe sewer, thence still west along the center.of said Quincy Street to a point about 60 feet east of the east line of Sherm n Avenue with a 10 inch vitrified pipe sewer. Also: Begin at the center of Quincy Street and Sherman Avenue, thence east along the center of said Quincy Street to a point about 70 feet west of the west line of Sherman Avenue with a 10 inch vitrified pipe sewer. Also:— Begin at the center of Alien Street and Quincy Street thence west along the center of Quincy Street to a pointabout 60 feet east of the east line of Blaine Avenue with a 10 inch vitrified pipe sewer-. Together with the necessary manholes, inlets and House Connections to the curb line along the line of said improvement. All as shown on the plans, and in accordance with the profiles, detail drawings and specifications on file in the office of the Depprtment of Public Works of said City. And such improvement is now ordered. and said sewer, with all its appurtenances steal shall be constructed in accordance with the profile and specifications now on file in the office of the Department of Public Works of said City. The cost of said improvement shall be apportioned against and -paid by the property holders whose property abuts thereon and upon the City of South Bend if the City fs benefited by said improvement, all according to the method and wanner provided for in Act of the General Assembly of the State of Indiana, entitled "An Act Concerning Municipal Corporations," approved March 6, 1905. Assessments:, if deferred, are to be paid in .ten equal annual installments, with interest at the rate of Six per cent per annum. A Bond or Bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessments before said bond or bonds are issued. Under no .circumstances shall the City of South Bend be or be held respon— sible for any sum or sums due from said property ovner or owners for such work, or for the collection of same, or for the payment of any bond or bonds, certificate, or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assessments for suh such improvement, or such moneys as said City is by said above entitled Act required to pay, All proceedings nad, and work done in the making of said improvement, assessment of property, collections of assessments and issuance of bonds therefor, shall be as provided for in said abovet entitled Act. The con- struction of cement curb on, both sides of tine roadway where not already constructed, plae- ing the necessary marginal cement curb andthe construction of the necessary storm water inlets. All as shown on the plans, and in accordance'with the profiles, detail drawings and specifications on file in the office of the Depart ent of Public Works of said City. And such improvement is now ordered. By grading said Olive Street from property line to property line to the established grade and the construction of .cement sidewalks and cement curb on both sides of said Olive Street. Be it resolved by the Board of Public Works of the City of8 South Bend, St. I. oseph County, State -of Indiana, that it is desired and deemed necessary to im- prove KEMBLE AVENUE FROM PRAIRIE AVENUE AVENUE TO EWING AVENUE as follows:- to -wit: By grading and paving the roadway, also grading and paving the roadway of intersecting and enterinng'streets and alleys,lying within said portion of said Kemble Avenue not included in the roadway to be improved with Asphalt, Bitulithie, Brick or Creosoted Wooden Blocks. Laid on a five (5) inch Portland cement gravel concrete foundation. 8r with Brick laid on a six (6) inch gravel foundation, plac- ing the necessary marginal cement curb, earbing the roadway with cement curb where same is not already constructed, also the construction of the necessary strom water inlets. All as shown on the plans, and =in accordance with. profiles, detail plans and.speeifieations on file in the office of.the Depart*erit of"Public Works of said Cijc City. And such improvement is now ordered. The cost of the improvement herein provided for, except street and alley intersections, shall be padd by special assessment to be levied upon the property specially benefited, to tiie amount that the same may be legally assessed therefor , inaccordance with an Act of the General Assembly of the State of Indiana, entitled "An Act Concerning Municipal Corporations," approved lurch 691905, and in accordance with and pursuant to the provisions of all acts amendatory and supplemntal t hereto. The cost of all street and alley intersections, including one-half of the width of the improvement opposite street and alleys which ran into, but do not cross said roadway herein proposed to be improved and that -portion of such street of alley abutting upon property belonging to said City,or upon property not sub feet to such assessment, shall be paid by the City in cash of its general fund, if able to do so, or from a fund created by a special assessment to be levied under the provisions of Section log of the above entitled Act. Assessments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A Bond or bonds will be issued to the contractor to the amount of such deferred assessments in pro rata payment for such improvement.
