✓Commu.nication received from Mr. Robert C. Chatten, of.Goshen,Indiana, relative to
the opening of North Turnoek Street between South Bend Avenue and Corby Street. The
same ;.eras read and placed on file.
✓3A:-�pl.kt of the Michigan Street Addition to the City of South Bend, Indiana was presented
to the Board and the same was referred to the City Civil Engineer.
Petition received for pipe sewer on Adams Street frog._ Vassar Avenue to Michigan Avenue
The same was read and referred to the Engineer for investigation.
,,--Petition received for grade, curb and walk on Tenth Street River Park, from Mishawaka
Avenue to Wall Street. The same was read and referred to the City Engineer for in-
vestigation.
Petition received for grade, curb and walk on Wall Street from Clifford Court west
to Sixth Street, �n R v�-^ Park. The same was read and referred to the City Engineer
for investigation.
d Petition received from Chicano, South Bend & Northern Indiana Railway Co. accompanied
by blue prints was presented to the Board petitioning for the erection of crossing

ors and assigns for the sum of ONE ($l.00) DOLLAR, the following Real Estate in St.
Jospeh. County in the State of Indiana, to wit:
A tract or parcel of land. thirty (30)
feet in width bounded by a line running as follows viz: Beginning at a point in the
center line of Bertrand Street; which point is thirty (30) feet South and six hundred
ninety-five and eight -tenths (695.5) feet West of the South East corner of Lot No. Two
Hundred ninety three (293) in Kaley's Third Addition to the City of South Bend, being at
the North West corner of a tract heretofore conveyed to WinklEr Brothers Manufasturing
Company; thence running North sixty four (64) degrees fifty -five (55) minutes West
on the Northerly line of. grantor's land two hundred sixty- three and seven--tentls�>
(263.7)- feet, more or less, to the west line of Section No. Three. ("A) Township No.
Thirty -se ven (37) North, Range No. Two (2) East, thence South on said Section line to
a point. thirty (30) feet distant (measured at right angles) from said Northerly line of

Company, passed at a meeting held. January 18th. 1913. And. Covenant for itself, its
successors and personal representations that it is lawfully seized of the premises has
good right to convey the same and guarantee the quiet possession thereof that the same
are free from all in.cumbranee and that it will Warrant and Defend the title to the

RESOLVED, By the Board of -Public Wo rKs of the City of South Bend, St.
Joseph County, Indiana, that it is desired and deemed necessary to
construct a sewer in Michigan Street and LaSalle Avenue, said City,
which, From its side and -charaefer, is not only intended and adapted
for use bjr property owners whose `property abuts along the line of said sewer-, but is
also intended and adapted for receiving sewage from collateral drains already con-
structed or 'which may be hereafter constructed., and the same is hereby ordered con-
structed in and along Mi chi gan Street and LaSalle Avenue, beginning at a point in the
center of LaSalle Avenue where the same intersects with the westerly bank of the St.
Joseph River, in the said City of South Bend; thence running west along said LaSalle
Avenue to Michigan Street with a sewer sixty (60) inches in diameter; thence south
along Michigan Street to the center of Washington Avenue with a sewer sixty (60)
inches in diameter thence still south along Michigan'Street to the center of
Jefferson Blvd. with a sewer fifty four (54) inches in diameter; thence still south
along Michigan Street to Monroe Street- with a surer forty-e;;gkt (48) inches in dia-
meter, together with all the necessary house and store' connections to the curb line
along the whole length of said improvement, andto be built in aceo'rdsnee vdth the
profile, specifi.cations, detail plans, maps and estimates new on file in the office
of the Department of Public Works of saaid. City, whiek ineludes all estimate of the
proportion that the cost of an adequate local sewer, built along the above line, bears
to the cost of the main sewer, to be built as follows: The cost of an adquate local
sewer, built along the line above described, is hereby estimattee, and fixed to be
of the cost of tke main sewer to be built along said line as
above set Forth, which proportion, as herein estimated and fixed, shall be taken and
adapted in all eomputations requiring a knowledge of the cost of :such local sewer if
built along the line where the main sewer is to be built. The cost of the c;onst rue-
tion of said sewer shall be divided as follows: -
So much of such cost as shall be equivalent to the construction of
an adequate local sewer not adapted to receive sewage from collateral drains or -sewer;
- if built along the proposed line as hereinabove set forth, shall be paid by the abut-
ting property holders and the said City of South Bend, if it -be determined that the
said City is benefited by said sewer in :the same manner and to the same extent as
local sewers, are paid for by them, under the Statutes in such cases made and pro-
vided..
2• The excess of cost over and above what would be equvivalent to
the cost of a loal sewer, it built along said line, 'shall be assessed aged nat each
piece of property in the di st ri et or area to be drained and against the City, if it
be determined that the said City is benefited' by the said sewer, according to the
manner and method prescribed by law, all of which said property benefi(d ally af-
fected lies within the following- described territory in the City of South Bend,
County of St. Joseph, and State of Ind1ana, t o-wit : -

SAID IMPROVEMENT SHALL BE KNOWN AS MICHIGAN STREET TRUNK SEWER.
And each piece of property in said district. or area above described,
including abutting property holders and the said City of South Bend, if the said City is
benefited, shall be assessed, as aforesaid, to pay said excess of cost over and above what
would be equivaleAt to the cost of aloeal newer; all of which will more fully appear by
reference to the profile, -map, drawings and specifications now on file in the office of
the Department of Public Works of said City which, among other things, gives the exact
course of said proposed mein sewer, overflows,, and its appurtenances.,91 and the distriet or
area which may be injuriously or beneficially arfeeted thereby, as shown by the heavy
boundary lines marked on said map and drawings with proper words and figuees written there-
on, clearly indicating what said heavy boundary lines represent, and, the district or &L-ea
embraced thereby. Assessments if deferred are to be paid in ten equal annual installments,
with interest at the rate of Six per cent, per annum.' . A bond or bonds shall be issued to
the contractor in payment for such work, unless the property owners pay said assessments
before said bond or bonds are i sued. Under no circumstances shall the City of South Bend,
be or be held responsible for any -sum or sums due from said property owner or owners for
said work, or for the collection of the same, or for the payment of any bond, bonds, certi-
ficate or certificates issued to said contractor in payment for such work, except for such
moneys as shall have been actually reeeived by said City from the assessments for such
improvement.
All proceedings h&d and work done in the construction of said main
sewer and its appurtenances, manner of assessments of property, collection of assessments
and issuance of bonds therefor.shall be as provided for .in an Act of the General
Assembly of the State of Indiaha, entitled,"An Act concerning municipal corporations, in
matters pertaining,to the construction, alteration and maintenance of public drains and
sewers, providing for the construction., alteration and maintenance of such sewers and
drains in such Cities anti 'within four miles thereof, also providing for the assessment of
property .-peeially benefited thereby for the payment thereof, in whole or in part.) and
for the collection of such assessments; repealing all laws and parts of laws in conflict
therewith, and declaring an eme rgeney, "approved March 6. 1905, and all Acts supplementary
and &Tendatory thereto.) passed by t e General Assembly of the State of Indiana.
Notice o,f this resolution shall be published Onthe 31st- day Of
January, and on the 7th . day of February 1913 in the South B*--rid Daily Times. This
Board *ill,give.a hearing on this_ resolution at its office in the City Hall on the 29th.
day of February 1917 at 7:45 P.M.
