Board met in reuular session at 10:00 A.I. All members present.
.Board ordered the Street Commissioner to place Twelve (12) plank crossing on
Mishawaka Avenue.
In the matter of the awarding of contract for pipe sewer on St. _Louis. Street from
South Bend, Avenue to Corby Street, under Improvement Resolution No 209. The same was
awarded to Henry De Vos, Contractor.
P"'Verbo,l, understanding between the Board and Henry De Vos, Sewer Contractor,t o the effect
that the Board allow Henry De Vo s Thirty five (35) working days from date for the
completion of the South Main Street Sewer, the City to pay the expense of an in-
spectors After expiration of Thirty five (35) days from_ date, Henry De Vos to pay City
in Spector at the rate of Two Dollars and Fifty cents (42.50) per day until completion
of the construction of the sewer.

CONDEMNATION RESOLUTION NO. 20.
f� RESOLVED, by the Board of Public Works of the City of South Bend, Indiana
That the following described property be appropriated for the opening of a street
sixty (60) feet wide from Sample Street to Ewing Avenue as follows t owit : -
Beginning at the North 1/9 cor ner of Section 15 Twp. 37 N.R. 2 E. thence
east 30 feet, thence south on a line parallel and 30 feet east of said 1/9 section
line to the north line of Ewing Avenue, thence west 60 feet, thence north on a line
parallel and 30 feet west of said 1/8 section line to the north line of said section
159 thence east 30 feet to the place of beginning.
The property which may be injuriously or benefically affected in the City
of South Bend, Indiana by the opening of said street as above described is known as the
ground herein proposed to be condemned and appropriated therefor, and also all the lots
and lands and parcels of lots lying within the following described territory in the
City of South Bend, Indiana.to-wit:-
Beginning at the northwest corner of Section 15
Twp. 37 N.R.2E. thence East on the north line of said Section 15 to the center line of
said Section 15, thence south on the center line of said section 15 to the south line
of said section 151, thence west on the south line of said section 15 to the south west
corner of said section 15, thence north on west line of said section 15 to the north -
west corner thereof being the place of beginning. Owned by the follwoing property
owners. Edward H. Duffield and Caroline Knott, Rosa Sack et,al, Sarah L. Kirby,
Antoninia Luzny, New Jersey,Indiana and Illinois Ry. Co., Grand Trunk Western Ry.Co.,
Chicago, Indiana and Southern Ry. Co., St. Joseph South Bend and Southern Ry. Co.,

The purpose of such appropriation is for the opening OF A HIGH -WAY SOUTH
FROM SAMPLE STREET TO EWING AVENUE.
Notice of this resolution shall be published on the 22nd. d%r of
November and on the 29th . day of November 1912 in the South Bend Daily Times.
This Board, at its office in the City Hall on the 27th. day of December
1912 at 7:45 P.M. will hear and receive remonstrances from all persons interested in or
affected by these proceedings.

CONDEMNATION RESOLUTION NO. 21.
Resolved by the Board of Public Works of the City of South Bend, Indiana:
That the following described property be appropriated for the Opening of Calvert Street
from Carlisle Street to the City limits as follows ,to —wit: —
Beginning at the intersection of the north line of Calvert Street and
west line of Carlisle Street thence west on the north line of Calvert Street produced,'
to the City Limits which point is 200 feet west of the west line of Section 15 Tp. 37
N.R. 2 E.. thence "south 60 feet, thence east to a point on the south line of Calvert
Street produced west 920.9 feet west of the west line of Carlisle Street which point is
the south west corner of Calvert Street and Grand Boulevard in proposed addition to
Highland Park.Thence south 40 feet, thence east to a point 245 Peet west of the west line
df Carlisle Street, thence north 40 feet, thence east 254 feet to the west line of
Carlisle Street thence north 60 feet to beginning.

Permission was granted to the Indiana & Michigan Electric Company to._ replace two of the
Central Union Telephone Companyf s poles, at the intersection of the alleys between Wayne
and Division and the alley east and west of Carroll The same was approved as follows: —
West of Carroll Street on the N. W. corner of alley. Easy of Carroll Street on the north
east corner of alley.
Engineer filed assessment roll and final estimate for Grade, curb and walk
on North Shore Drive from Lafayette Street to Iroquois Street, under Improvement
Resolution No. 163.

six consecutive days in the South Bend Daily Times, commencing on the 2nd. day of

The City Engineer submitted the list of property owners in themftter of the
appropzi ation of certain property under Condemnation Resolution Number 17 which list
-includes the names of the owners and holders of property and of interests therein
sought to be taken or beneficially or injuriously effected, and the description of
the several pieces of property which is affected by the said appropri-ation proceedings..
Thereupon the Board proceeded to award the damages sustained and to assess the
benefits accruing to each piece of property upon said list.
It was thereupon, upon motion duly made and seconded and unanimously adopted,
resolved that said list, together with the amounts of benefits and damages and net `
benefits and net damages therein set 'forth as to the several parcels of land be adopted
and ordered spread upon this record by reference, and that the respective amount of
benefits contained in Said list be and are hereby -assessed against the several tracts
of land as speficially set forth in said list, and that the respective amounts of
damages contained in the said list be and are hereby, awarded to the several tracts of
land as specifically set forth in said list, and that the net benefits or._ net damages
as the case may be as to the respective tracts of land, contained, in said list are
hereby awarded or assessed, a�i the case may be as to the said several tracts of laid.
The Board hereby further sets off the benefits and damages each against the.
other. where both benefits and damages are assessed against the same piece of property
tract of land or interest, and hereby- fixes said respective net benefits as the amount
that- shall be paid by the respective owners as benefits,, and further hereby fixes the
respective net damages as to the several tracts as the amou:fit that shall be paid to the
owners of the respective tracts as demageg.
Thereupon, upon motion duly made and seconded and unarL:mously adopted, the

hear remonstrances from persons with regard to the amount of their respective awards or

the date of said hearing.

It was thereupon, upon motion duly made and seconded and unanimously adopted,

or award, with a description.of the property affected, and the date of said hearing.
