Board met in regular session at 10: 00 A.M. All members present.
✓Plat of Sumpptioh.Prairie Avenue Addition presented by Ernest M. Morris to the
Board and approved.
,,"'Petition received and read for a Pipe Sewer on Marietta Street from Wenger Street to
Pennsylvania Avenue. The same was referred to the City Engineer.
-"'Petition received and read- for a sewer on Studebaker Street from Fassnacht Ave.
to LaPorte Avenue. The same was referred to the Sity Engineer.
✓ Petition received and read for a pipe -sewer on Quincy Street From Portage avenue
to Cleveland Avenue. The same was referred to the City Engineer.
°Bond and contract signed by De Paepe & Coussenas and' t7?e United States Adelity
and Guaranty Co. of Baltimore ,Md. -for Pipe Sewer -on.Studebsker Street Inder
Improvement Resolution No. 157,was approved by the Board.
,-'Guarantee Bond signed by the Western Construction Company and the Title Guaranty
and Surety Company, for Re -Surfacing with Asphalt pavement of South Main Street,
under Improvement Resolution No 115. was approved by the Board.
"'Guarantee Bond signed by the Western Construction Company and the Title Guaranty
& SuretynCompany , for paving North Lafayette Street Under Improvement Resolution
No. 132, was approved by the Board.
---In the matter of awarding bids on Division Street and Walk under Improvement
Resolution No. 196. All bids rescinded and ordered relet January 15th . 1913.
//ln the matter of the plat of Fairview, Davies Addition to Grand View presented to
the Board .and referred to the City Engineer.

Commissioner ;or investigation.
LOCAL SEWER IMPROVEMENT NO. "209.
Resolved by the Beard of Public Works of the City of South Bend, County of
'St. Joseph ,State of Indiana, That the construction of a local sewer.,intended and
adopted only for local use by the property holders whose property abuts thereon, and
not intended or adapted for reeiving sewerage from collateral drains be and the same
is, hereby ordered in and along ST. LOUIS STREET FPOM. SOUTH BEND AVENUE TO CORBY
STREET as follows to -wit : -
Beginning at the center of South Bend Avenue and St. Louis Street thenee
North along the ce'ter line of St ."I Louis Street to the center of Kalorama Street
with a 15 inch vitirifed pipe sewer, thence still north along the center line of
St. Louis Street to Corby Street with a 12 inch vitrified pipe sewer. MDgether
with the necessary manholes, inlets and house connections to the curb line along
the line d'f said improvement. All as shown on the detail plans ,pro.files and
specificationiR on file in the Office or the Department of Public Works of said City.
And such improv meat is now ordered and said sewer, with all its appur-
tenances shall be constructed in aecordanee with the profile axed specifications now
on file in the Office of the Department of Public Works of said City. The cost of
said improvement shaiibe apportioned against and paid by the property holders vtose
property ab uts thereon, and upon.the City of Souta Bend if the City is benefited by
said improveme t, all according to the, method and manner provided for in Act of
the Assembly of the State of Indiana, entitled,"An Act Concerning Muneipal ifforpor=
ations,"appra rdd March 61,1905. Assessments, if deferred, are to be paid in ten `'
equal annual installments, with interest at the rate of Six per cent per annum. A
bond or bbnd!s shall be issued t the contractor in payment for such work, uhless
the property owners ppy said assessments before said bond or bonds are issued. Under
no eireumstanees shall the City of South Bend be or be held responsible for any sum
or sums due from said property owner or owners for said work, or for the collection
of same, or for the payment of any bond or bonds, certi fiOates or certifi Oates, issued
to s0 d contractor in payment for such work, except for such moneys as shall have
been actually received by the City from the assessments for such improvement, or Each
moneys as said City is by :said above entitled Aet required to pay. All iproseedings
had, and. work done in the making of said improvement, assessment of property,eolleetin
of assessments and issuance of bonds therefor, shell be as provided for in above
entitled. Act. Notiae of this resolution shall be published on the 26th. day of Sept.
and on the 3rd. day of October .1912 in the So.Bend Daily Times. This Board will give
a hearing on this resolution at its office in the City Hall on the 25th. day of
O et . 1912 at 7: 45 P.M.

STREET OR AuLEY IMPROVEMENT RESOLUTION NO. 209.
Be It resolved by the Board of Public Works of the City of South Bend
St. Joseph County, State of Indiana, that it is desired and deemed necessary to improve
BRICK AVENUE FROM LAPORTE AVENUE TO MICHIGAN AVENUE including the intersection of Euclid
Avenue as follows,t o-wit : -
By grading and paving said B ri ek Avenue from property line t® property
line with Brick ,Bitulithie, Creosoted Wooden Block or Asphalt laid upon a 5 inch portland
cement gravel foundation: or with Brick laid on a six (6) inch gravel foundation, placing
the necessary marginal curb, all as shown on plans and in accordance with the specifications
detail drawings and profiles on file in the office of the Department of Public Works
of the City of South Bend, Indiana.
And such improvement is now ordered.
The cost of the improvement herein provided for, except street and alley
intersections, shall be paid by special assessment to be, levied upon the property specially
benefitted, to the amount that the same may be legally assessed therefor, in accordance
with an Act of the General Assembly of the State of Indi anal ent it led "An Act Concerning
Muncipal Corporations," approved March 6,1905, and in accordance with and pursuant to the
provisions ofall acts amendatory and supplemental thereto.
The cost of all street and alleys i. ntarsections, including one+-dalf of
the width of the improvement opposite street and alleys which run t1to, but do not cross
said roadway herein proposed to be improved and that portion of such street or alley abutting
upon property belonging to said City, or upon property not subJect to sueh assessment,
shall be paid by the City in cash out of its general fund, if able to do so, or from a fund
created by a special assessment to be levied under the provisions of Section 109 of the
above entitled Act.
Assessments of ten dollars and more against each lot, if deferred,ane to
be paid in ten equal annual installments, with interest at the rate of Six per cent per
annum. A bond or bonds will be issued to the contractor to the amount of such deferred
assessments in�pro rata payment for such improvement.
Under no circumstances shall the City of South Bend be, or be held rerpons-
ible for any sum or gums due -from' paid property owner or owners for said work,or for t rs
collection of the same, or for the payment of any bond, bonds, certificate or certifi.eates
issued to said contractor in payment for sueh work, except for such moneys as shall have
,actually been received by the City from the assessments for such improvement, or such moneys
as said City is by said entitled Act and amendments and supplements thereto required to pay.
All proceedings had, and work done in the making of said improvement, assessment of pro-
perty, collection of assessments and issuance of bonds therefor, shall be as provided for
in said above entitled Act and Acts amendatory thereof and supplemental thereto.
BE IT FURTHER RESOLVED, That the Board of Pubtie Works fix th# 25th. day
of October A.D. 1912 at the hour of 7:45 P.M. at the office of the Boardof Public Works of
this City, as the time and place for the public eondiderstion of said proposed improvement,
at which said Board of Public Works will hear all persons interested, or vtose property
is liable to be assessed for said improvement, and vdll decide whether the benefits tot *
property liableto be assessed for said improvement will equal the estimated cost thereof.
BE IT FURTHER RESOLVED. That noti ee of the time and place of such public
consideration be published and mailed in the manner provided by law. Notice of this
Resolution shall be published on the 26th. day of September 1912 and on the 3rd. day of
October 1912. in the South Bend Daily Times.
