Mr. Martin appeared before the Board and notified them that he had been retained bV John and Jesse Janisczak to represent -crier, in matter of - opening of Union Street and filed notice to effect that Janisezak have a substantial interest in lots 13 Arnold, Hine & Wilson's Sub. Div. , . of Bank Out lot 100-101 and 102. The same was plaeed on file. Nearing given on Assessment Roll. and Anal estimate for Pipe Sewer on South Bend Ave from Eddy Street to Eastern. City Limits, under Improvement Resolution No. 107. A remonstrator appeared, in, the person of John Duey, and remonstrated against his assessment, but no remonstrance was filed. The Board after due consideration therefore find th.&t the property assessed in said rolls filed July 19th. 1912 is benefited in the amount of assessments as shown on said rolls, and the Beard further find that the assess meat rolls filed July 19th. 1912 and the Final Estimate allowed July 19th. 1912 should be and the same are hereby in all things ratified, confirmed and approved. ✓Petition filed for sewer on No. St. Louis Street from Madison Street to Cedar Street Same referred to City Engineer. ✓Petition for Concrete Pavement on Howard Avenue from Leeper Avenue to Niles Avenue Same was referred to City Engineer. The Following contracts were awarded an the fallowing Improvements. Grade, curb and walk on Lincoln Street from Mi chi gan Avenue to Quincy St reet,under Im- provement Reselution No. 184. Awarded to De Paepe & Coussins, Trunk Sewer on Olive Street and Michigan Avenue , under Improvement Resolution No. 192. Awarded to Henry De Ves. ,—Pavement on lst . alley North of North Shore Drive from Mi chi gan. Street to Lafayette St. under Improvement Resolution No. 191. Awarded to Hoban & Roach, vd th Concrete Pavement. �rad.e, curb and walk on Division Street from Frances to Eddy St rests, under Improvement Resolution No. 195. Awarded to T.C. Barnes. Pipe Sewer on Garfield Court from Washington Avenue to N. line of lot 6 in Bartlett ,$ub. Div:, , under Improvement Resolution No. 199. Awarded to De Paepe & Coussins. Engineer filed assessment roll and final estimate for Brick Pavement on Wadxut Street from Colfax Avenue to LaPorte Avenue, under Improvement Resolution No. 112. GRADE, CURB AND SIDEWALK IMPROVEMENT RESOLUTION NO. 203. RESOLVED by the Board of public Works of the City of South Bend, St. J Joseph County , State of Indiarm, That it is deemed necessary to improve COLFAX AVENUE FROM BIRDSELL STREET TO WALNUT STREET , by grading said Colfax Aven.e from property line to pro— perty line, and the construbtiox of cement sidewalk and Bement curb on both sides of said Colfax Ave .e; All as shown on detail plans, profiles anal specifi eations on file in the office 'of the Department of Public Works of the City of South Bend, India na. And such improvement is now erdere d in accordance with the profile, details, drawings anal speci— fications on file in the Office of the Department of the Beard Of Public Wanks of said City; and such improvement is now ordered. The cost of said improvement, including the cost of street and alley inter— seetions, shall be assessed upon the real estate abutting on said COLFAX AVENUE FROM BIRDSELL STREET TO WALNUT STREET all according to the method and manner provided for in ax act of the General Assembly of t e State of Indiana, entitled, "An Art Concerning Muni#al Corporations". approved Larch 6, 1905, and in accordance with and pursuant to the pro— visions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be .paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A Bond or bonds shall be issued to the cox rioter in payment of such work, unless tthe property owners pay said asses meat before said bond or bonds are issued. Under no circumstances shall the City of South Bend, be, or be held responsible for any sum or sums, due from said property owner or w owners for said work or fort he eolleetiox of the same , or for the payment of any bond, bonds, certificate or certifieates, i - sued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assesments for such improvement, or such moneys as. said City is by au d above. entitled Act required to pay. All proceedings had, and work done in the makine of said improvement, assessment of property, collection of assessments and issuance of bonds thereofr, shall be as provided for in said above entitled Act and amendments thereto. Notice of this Resolution shall be published on the 21st . day of Augi st 1912 and on the 28`th. day of August, 1912 in the South Bend Daily Times. This Bard will give a hearing on this resolution in its office in the City Hall on the27th. day of September 1912 at 7:45 P.M. Adopted this 20th. day if August, 1912. President.
