LOCAL SEWER IMPROVEMENT RESOLUTION NO. 200. RESOLVED by the Board of Public Works of the City of South Bexd,County of St. Joseph, State of Indiana, That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for reciving sewerage from collateral dramas be' and the same is, hereby ordered in and along LISTON STREET FROM BIRDSELL STREET to a point Thirty (30) feet east of the east line of Adams Street as follows to -wit: - Beginning at the center of Birdsell Street and Liston Street thence west along the center of Liston Street to a point thirty (30) feet east of the east line of Adams Street with ' a 10 inch viti ri fi ed pipe sewer. Together with the necessary Max - holes, Inlets and House Connections to the curb line along the line of said improvement. All` as shown on detail plans, profiles and specifications on file in the office of the. Department of Public Works of said City. And such improvement is now ordered seal Said sewer, with all its appurtenances shall be constructed in accordance with the profile and specifications now on file in the office of the Department of Public Works of said City. The cost of said improvement shall be approtioxed -- against and paid by the por- perty holders whose property abuts thereon, and upon the City of South Bend if the City is benefited by said improvement, all according to the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled,"Ax. Act Concern- ing Municipal Corporations," approved March 6,1905. - Arsessments ,if deferred; are to be paid in ten equal annual installments, with interest at the rate of Six per cent per axxum. " .STREET OR ALLEY IMPROVEMENT RESOLUTION NO. 202. Be it resolved by the Board of Public Works of the City of South Bead, St. Joseph County, State of Indiana, that it is desired and deemed ne-cesary to im- prove THE FIRST ALLEY SOUTH OF WAYNE STREET from Main Street to Vistula Avenue; is the City of South Bend, Indiana. By grading and paving said alley from property line to property line with brick, Bitulithi c, Creosoted Wooden Block or Asphalt laid upon a five (5) inch Portland cement gravel foundation; or with Brick, Granite Block, Creosoted Wooden Block or Bitulithis laid on a six (6) inch gravel foundation; plac- ing the necessary marginal curbs, all as shown on the plans and is accordance with the specifications, detail drawings and profiles on file in the Office of the Depart- ment of Public Works of the City of South Bend, Indiana. And such improvement is now ordered. The cost of the improvement herein provided for, except street and alley intersections, shall be paid by speeial assessment to be levied upon the property se specially benefited, to the amount that the same may be legally assessed therefor, in accordance with as Act of the General Assembly of the State of Indiana, entitled "An Act Concerning Municipal Corporations," approved March 6th. 1905; and in accord- ance with and pursuant to the provisions of all acts amendatory and supplemental thear thereto. The cost of all street and alley intersections. including one-half of the wi dt h of the improvement opposite street and alleys which runi rat o, but do not ere cross said roadway herein proposed to be improved and that portion of such street or alley abutting upon property belonging to said City, or upon property not subject to such assessment, shall be paid by the City in cash out of its general fund, if able to do so, or from a fund created by a special assessment to be levied under the provisions of Section 109 of the above entitled Act. Assessments of ten dollars a,nd more a,gairst each lot, if deferred, are to be paid in ten equal annual insta-Llments, with interest at the rate of Six per celk cent per annun . A bond or bonds will be issued to the .contractor to the amount of such deferred assessments in pro rat& payment _for such improvement. Under no circumstances shall the City of South Bend be , or be held re- spoxsiable for aky sum or sums due from said property owner or owners for such work, 1br for the eollection of the same, or'for the payment of any bond, bonds, certificates or. certificates, issued to said contractor in payment far such work, except for such moneys asshall have actually been received by the City_from the assessments for such improvemnt, or such moneys as said City is by said entitled Act and amendments and supplements the re- t o required to pay.,- All proceedings had, and _work donee in the making of said improve- ment, ' assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act, and Acts amendatory thereof and supplemental thereto. BE IT FURTHER RESOLVED, That the Beard of Public Works fix the 13th. day of September A. D. 1912 at the hour of 7:45 P.M. at the office of the Board of Publie Works, of this City, as the time and place for the public. consideration of said proposed improvement, at which said Board of Publie Works will hear all persons interested,or vhose property is liable to be assessed for said improvement, and will .deeide whether the bene- fits to the property liable to be assessed for said improvement will equal the estimated cost thereof. BE IT FURTHER RESOLVED, That notice of the time and place of such public consideration be published and mailed ix the manner provided by lax. RESOLVED by the Board of Public Works of the City of South Bend, Indiana That the following described property be appropriated for Widening of the ALLEY WEST OF HARRT O SN AVENUE FROM MI CHI GAIT AVENUE t o the FT RSA' ALLEY SOUTH O F MI CHI GAN AVENUE as follows to -wit:- 9 feet taken off and from the entire lexgth of the west side of lot No.l of Rockstroh and Nickel's First Addition to the City of South Bend, Indiana. The property which may be ixjuriously or beneficially affected in the City of South Bend, Indiana by the widemi.xg of said Alley as above described is known as the ground herein proposed to be condemned and appropriatedtherefor, and also all the lots an lands and parcels of lots lying within the following described territory in the City of South Bend, Indiana, to -Brit: - Beginning at the north west corner of Harrison Avenue and.
