Railway Company asking for a side- track over and, across Lafayette Street and Prairie Avenue wasr. approved by the Board and referred to the Common Council for ratification Petition- received and read petitioning for &-Grade on Elwood Avenue from Wilber Street to Portage Avenue. The same is on the Assessment roll. In the above matter no remoonstrators appeared and no remonstrances were filed. The Board find that the property mentioned in said roll is benefited and damaged respectively as shown in said roll and said roll is hereby in all things ratified, con- firmed and approved, and all action under Condemnation Resolution No. 15 is hereby con- cluded. t Hearing given on Assessment roll showing award of damages and assessment of benefits in the matte-r of Vacation Resolution No. 16. adopted on the 26th. dyy of March,1912. No remonstrators .appeared and no remonstrance: were filed. The Board there- fore declare the above roll filed July the 24th. 1912 to be in all things ratified, confirm ed and approved and all action under Vacation Resolution No. 16<,is hereby concluded GRADING AND SIDEWALK IMPROVEMENT RESOLUTION NO*, 199. RESOLVED by the Board of Public 'Alorks of the City of South Bend., St. Jeseph County, State of Indiana, that it is deemed necessary to improve HYDRAULIC AVENUE FROM LASALLE AVENUE TO THE EAST END OF HYDRAULIC AVENUE from the curb line to the Property line on the east and southerly side of said Avenue, and constructing cement sidewalk on said east and southerly side of said Hydraulic Avenue., in accordance with the profile, details, drawings and specifications on file in the office of the Department of Public Works of said City; and such improvement is now ordered. The cost of said improvement, including the cost of street and alley in- tersections, shall be assessed upon the real estate abutting on said HYDRAULIC AVENUE all according t.o the method and manner provided for in an Act of the General Assembly of the State of Indiana, entitled "An Act Concerning Muncipal Corporatioxs," approved March 6, 1905, and in accordance with and pursuant to the provisions of all amendatory and supple- mentary acts thereto, L)a.ssed by the General Assembly of the State of Indiana. Assessments if deferred, are txo be paid in ten equal annual istallments , 5,,ith interest at the rate of Six per cent per annum, A Bond or Bo:,.dP shall, be issued to the C:�ntractor in payment of such work, unless the property owners pay said asge rsment before said Bond or bonds are issued. Under no circumstances shall the City of South Bend, be,or be held responsible '"or any sum or Puri, due from said property owner or owners,. for Paid work or for the -collectiox of the PaTne,or for the petyment of any bond, bonds, certificate or ceeti- cates issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assessments for such improvements ,or Puch moneys as said Cilry is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided for in said above entitled Act and amendments thereto. Not-' ce of this resolution shall be publiAhea on the 7th. day of August and on the 14th. day of August 1912, in the South Bend Daily Times.
