Tuesday July- 9th. 1912.
Board met in regular session at 10:00 A.M. All members present.
Grade, curb and walk on Emerick Street under Impm vement resolution No. 156 was
awarded to H. N. Barnes.
Grade, curb and walk on Howard Street from South Bend Avenue to E. line of More,yt s
1st. addition, under improvement resolution No. 154. was awarded to H.N. Barnes.
,�Crade, curb and walk on Howard Street from Notre Dame to Eddy Street, under improves
merit resolution No. 153 was awarded to Hugh Anderson.
Grade, curb and walk-on Kinyon Street from Portage Avenue to the west line of
Morris Park Addition,under improvement. resolution No. 169. -was awarded to H. W
Reed be Sons.
Pipe Sewer on Marion Street from Lafayette Street to 60 ft.: West of
Main, under improvement resolution No. 1591, was awarded to Hoban & Roach.
t-- Trunk Sewer on Main Street from Indiana Avenue to Ewing Avenue, under Improvement
resolution No. 176. was awarded -to Henry DeVo s.
✓Petition received, read and placed on file asking for a street light at the corner
of Cleveland Avenue and Vassar Avenue. The same was referred to hhe 'Street -Cem-
missioner for investigation .
Engineer filed assessment roll and final estimate fo-r Pipe Sewer on Miner:::St-rett
from Notre Dame St re et to Eddy St reet , under improvement Resolution No. 137.
Resolved, that noticese as to the amounts of assessments be published
for six c.onse ctut i ve days in the South Bend Daily Times, commencing on the 15t h.
day. of Jule 1912, stating that this Board will give a hearing on the amount of such
assessments at its office in the City Hall on the 26th. day of July 1912 at 7:45P.M
Resolved further, that the entire work under the above contracts be
accepted and approved and the final estimate thereon allowed. Notice of this
resolution shall be published on the 15th. day of July 1912 in the South Bend Daily
Times, stating that this Board will give a hearing on the acceptance of such work
at its office in the City Hall on the 26th. day of July 1912 at 7:45 P.M.

NO. 193.
RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA
ST. JOSEPH COUNTY,STATE OF INDIANA; That it is deemed necessary to improve O'Brien
St re et from .the north line of Mi chi gan Avenue to the North line of Mayr' s Addition
by grading the said street from property line to property line and constructing cem
ent walks and cement curb on both sides of said street, All as shown on detail
plans, profiles and specifications on file in the Office of the Department of Board
of Public Works of said City. And such improveir..ent is now ordered, in accordance
wJbth the profile, details, drawings and specifications on file in the office of the
Department of the Board of Public Works of said City; and such improvement is now d
ordered. The cost of said improvement, including the cost of street and alley inte
intersections, shall be assessed upon the real estate abutting on said O'Brien Stre
Street all according to the method and manner provided for in an act of the General
Assembly of the State of Indiana, entitled "An Act Concerning Municipal Corpor-
ations, "approved March 6, 1905, and in accordance with and pursuant to the pro-
visions of all amendatory and supplementary acts thereto, passed by the General
Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten
equal annual instaIlments, with interest at the rate of Six per cent per annum.
A bond or bonds shall be issued to the contractor in payment of such wnrk,unless
the property owners pay said assessment- before said bonds or bonds are issued. -
Under no circumstances shall the City of South Bend, be, or be held responsible
;or :any , sum: or sums, due from said property owner or owners for said werk �or for
the collection of the same, or for the payment of any bond, bonds, certificate or
certificates, i sued to said contractor in payment for such work, except for such
moneys as shall have been actually received by the City from the assessments for
such_ improvement, or such moneys as said City is by said above entitled Act re-
quired to pay. All proceedings had, and work done in the making of said improve-
ment, assessment of property, collection of assessments and issuance of bonds there
for,, shall be as provided for in said above entitled Act and amendments thereto.
Notice of this resolution shall be published on the 10th. day of
July 1912 and on the 17t h. day of July 1912 in the South Bend Daily Times. This
Board will gkve a hearing on this resolution in its office in the City Hall on the

RESOLVED by the Board of Public Works of the City of South Bend, St.
Joseph County, State of Indiana, That it is deemed necessary to improve ELMER STREET
FROM THE NORTH LIME OF MI CHT GAN AVENUE TO THE NORTH LINE .OF MAYRI S ADDITION, by grading
the. said street from property line to property line and construction of cement walks and
cement curbs on both sides of said street., All as shown on detail plans and speci-
fications on file in Office of the Department of the Board of',Public Works of said Chty
And such improvement is now orderdd, in accordance with the profile, details, drawings
and specifications on file in the office of the Department of the Board of Public Works
of said City; and such improvement is now ordered.,
The cost of said improvement, including the cost of street and alley inter

RESOLVED by the Beard of Public Works of the City of South Bend, St.
Joseph County, State of Indiana, That it 'is deemed necessary to improve OLIVE STREET
FROM CHI GAN AVENUE TO ELWOOD AVENUE, by grading the East side of said Olive Street.'
All as shown on detail plans,prefiles and specifications on file in the Office of the
Department of Board of Public Works, and such improvement is now ordered in accordance
with the profile, details, drawings and specifications on file in the office of the
Department of the Board of Public Works,of said City; and such improvement is now
ordered. The cost of said improvement, including the cost of street and alley inter-

The City Engineer submitted the list of property owners in the matter 6t''the
4ppropriation of certain property under Condemnation Resolution Number 16, .which lVat
includes the names of the owners and holders of property and of interests therein
sought ,to be taken or beneficial or injuriously .effected, and the description of the
several pieces of property which is affected by the said appropriation proceedings.
Thereupon the Board proceeded to -award the damages sustained and to assess th
the benefits accruing to each piece of property upon said list.
It was thereupon, upon motion duly made and seconded and unanimously adopted,
resolved that said list, together with the. amounts of benefits and damages and net
benefits acid net damages therein -set forth as to the several parcels of land be adoptd
ed and ordered spread upon this record by reference, and that the respective amount
of benefits contai ne.d , in said list be and are hereby assessed agkinht the several
tracts of land as specifibally set forth in said list, and that the respective
amounts of damages contained in the said list be and are hereby awarded to the sev-
eral tracts of land as specifically set forth in said list, and that the net benefits
or net damages, as.the case may be as to the respective ttracts of land, contained
in said list are hereby awarded' or assessed, as the case may be as to the said several
t ract s of land.
The' Board hereby further sets off the benefits and damages each against the
other where both benefits .and damages are assessed against the same piece of property,
tract of land or interest, and hereby fixes said respective net benefits as the amount
that shall be .paid by the respective owners as benefits, and further hereby fixes the
respective net damages as to the several tracts as the amount that shall be paid to
the, owners of the respective tracts as damages.
Thereupon, upon motion duly made and seconded and unanimously adopted, the
9th. day of August was fixed as the day on which this Board will( receive or hear
remonstrances from persons with regard to the amount of their respective awards or
assessments, and the Clerk of this Board was instructed to prepare and cause to be
duly and legally given, notices to the ow ers of each parcel of property showing
the amount of the assessment or award, with a description of the property affected,
and the date of said of said hearing.

RESOLVED ,by the. Board of Public Works of the City of South Bend, Indiana,
That the following described property be appropriated for the extention-of Keasey Street
from the West line of lot 9 in Hutchins Addition to the west line of Carroll Street as
follows to -wit: -
Beginning on the South line of said Keasey Street and the west line of
lot 9 in Hutchins Add. $thence East in line with the South line of said Keasey Street to
the West line of Carroll Street; thence North -along the West line of said Carroll St.to
the South line of the alley along the North side of said lot 9; thence west along the
North line o,f -.said lot 9 to the west line of said lot 9; thence south to the place of
beginning.

RESOLVED by the Board of Public Works of the City of South Bend, Indiana:
That it is deemed and desired necessary to vacate part of Keasey Street from Carroll
Street to the first alley west of said Carroll Streets in t Le City of South Ben d, Indi ana
as follows to -wit: -
Begin on the west line of Carroll Street and t e south line of lot 10
in Hutchins Add. thence West along the south line of said lot 10 to the We -et line of said
lot 10 thence south 26 ft. to the North line of lot 20; thence East along the North line
of said lot 20 to the West. line of Carroll Street; thence North along the west line of said
Carroll Street 26 ft. to the place of beginning.
The fallowing property may be i njuriously or beneficially effected by such
vacation in the City of .South Benda Indiana by the- proposed vacation is known and describe
