RESOLVED by the Board of Public Works of the City of. South Bend, St. Joseph County, State of Indiana, That it is deemed necessary to improve Michigan AVENUE from the EAST LINE OF OLIVE STREET TO A POINT 14436 FEET WEST; measured &log along the center line of said Michigan Avenue; by grading the said :Michigan Avenue from property line!to property line to the establi .Tied grade line, in accordaneo with the profile details, drawings and specifications on file in the office of the Dep&rtment of the Board of the Boetrd of Public 7torks of said City; and such improve meat 1 R, Haw o? d.ered. That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and not intended or adapted for receiving sewerage from collateral drains, be and the same is hereby ordered in and along LINDEN AVENUE, CARLISLE STREET. and SADIE STREET as follows:- t owit - Beginning at the center of Olive Street and linden Avenue; thence t-East along , t e center line of said Linden Ave. to the center of Sadie Street; with a 15 inch vitri- fied pipe sewer. Also begin at the center of Linden Avenue and Sadie Street thence south along the center of said Sadie Street to the center of Orange Street with a 12 inch Pipe ` sewer; ;,thence still south along the center line of Sadie Street to a point 100 ft. north of the north line df Washington Street with a 10 inch sewer. Also begin at the center of Linden Ave. and Carlisle Street thence South along the center line of said Carlisle Street to the center of Orange Street with a 12 inch pipe sewer; thence still south along the center of said Carlisle Street do a point 60 ft. north of the north line of Washington Street. Together with the house connections to the curb line long the line of said strer and said sewer, with all its _appurtenances shall be constructed in accordance with the profile and specifications now on file in the office of the department of Public Works of said City. LINE of WASHINGTON STREET TO THE SOUTH END OF SAID D PAZ COURT. By grading the said Court from curb line and paving the roadway with Bituminous Macadam or with Concrete Pavement. All as shown on detail plans, pro- files, and specifications on file in t e office of the Board of Public Works. And B such improvement is .now ordered. The coat of the improvement herein provided for, except street and allay intersections, shall be paid by special assessment to be levied upon the property. specially benefited, to the amounts that. the same may be legally assessed therefor, in accordance with an Act of the General Assembly of the State of Ilidiana, entitled "An Act Concerning Municipal Corporations," approved March 6, 1905, and in ,accord an ce with and pursuant to the, provisions of all acts amendatory and supplemental thereto. BE 'IT RESOLVED, by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, that it is desired and deemed necessary to improve the first . alley North of North Shore Drive from West line of Michigan Street to the East line of Lafayette Street by grading and paving the said Alley with Brick,Asphalt,. Bitulithic or Creosoted Wooden Blocks laid upon a five (5) inch portland Concrete found- .ation or with brick, bitulithic, Granite Blocks or Creosoted Wooden Blocks laid upon a six (6) inch gravel foundation or by the construction of a concrete pavement-. All as shown on detail drawings, profiles, plans and specifications on -file in the office of the Board of Public Works. And such improvenent is now ordered. The cost of the improvement herein provided for, except street and alley intersections, .shall be paid by special assessment to be levied upon the `property specially benefitted, to the amount that the same may be legally assessed therefor, in accordance with an Act of the. General Assembly of the State of Indiana,• entitled "An Act Concerning Municipal Corporations," approved march 6, 1905, and in accordance with and pursuant to the provisions of all acts .amendatory and supplemental thereto. The cost of all street and alley intersections, including one-half of the width .of the improvement opposite street and alleys which run into, but do not cross said roadway herein proposed tombe improved and that portion of such street or alley abutting upon propertybelonging to said City, .or upon property not subject to such assessment, shall be paid by the City in cash out of its general fund,. if able to do so, or from a fund created by. a special assessment to be levied under the provisions of Section 10E of the above entitled Act. Under no circumstances shall the City of South Bend be, or be held respon- sible for any sum or sums due from said property owner or owners for said work, or for the collection of the same, or for the payment of any bond, bonds, certificate or certi- ficates, issued to said coni ractor in payment for ouch work, except for such moneys as shell have actuiklly been received by the City from the assessments for such improvement, or such moneys as said City is by said entitled Act and amendments and supplements thers- t o required to pay. BE IT FURTHER RESOLVED, That the Board of Public Works fix the 26th.' day of July A.D. 1912 at the hour of 7:45 P.M. at the office of the Board of Public Works, of this City, as the time and place for the public consideration of said propsed improve- ment, at whieh said Board of Public Works, will hear all persons interested, or whose property is liable to be assessed for said improvement, and wd.11 decide whether the benefits to the property liable to be assessed for said improvement will equal the e st imat ed cost thereof. BE IT FURTHER RESOLVED. That notice of the time and place of such public consideration be published and mailed in the manner provided by law. . Remonstrators appeared and a further remonstrance was filed. The Board after due consideration deferred all action until January lst. 1913. 'Remonstrance received read and placed on file signed by property owners on Niles Avenue remonstrating against any further action on the grade and curb impnm vemenit of Niles Avenue, other than as stated on the original improvement petition. /Communication received read and placed on file from H. 3. Lemert a resident of Studebaker Street, ff' remonstrating against the placing-o:-a sewer on said Street. rI/Hearing given on Declaratory Resolution No. 168 for the grade, curb and walk on St. Vincent Street from Notre Dame Avenue to Eddy Street. ' In the above matter no remonstrators appeared and no remonstrances were filed. Therefore be it resolved that the Board find in each and every case in said improvements that the benefits to the property, and to the City of South Bend are equal to the estimated cost of said improvements and the same are hereby in all things ratified, confirmed and approved. Be it .resolved that notices be published in the South Bend Times on the 22nd. day of June 1912 and on the 29th. day of June 1912 to the effect that this Board will receive bids for the construction of said impm vement s up to 10:'00 A.M. on the 12th. day of July, 1912, The Board reserves the right to reject any and all bids.
