IMPROVEMENT RESOLUTION NO. 190.
RESOLVED bY.the .Board of,Public Works of the City od Sout h Bend, St
Jpseph Count Indiana That it is desired and deemed necessary to construct a sewer
and drain in and along the Bowman Creek and in and through lands adjacent and conti-
guous to said Creek' in said City, which from its size c-.nd character is not only in-
tended and adapted for use by property holders whose property abuts along the line, of
said sewer and drain, but is also intended and adapted for receiving sewage from col-
lateral sewers and drains,
already constructed or to be constructed, as well as to ree-
eive the water in said Creek, and the same is hereby ordered in and along the follow-
ing line of said Citytowit:-
Beginning at a point ,in said City, where a line parallel with and 8.6
feet north of the northerly line of Sample Street intersects the west side of the St.
Joseph River, said point being 166.2 feet from Vistula Avenue measured eastwardly a-
long a line parallel with the northerly line of Sample Street, thence south 8017' west

'And to be built in accordance with the profile, specifications, detail
plans maps- and estimates now on file in the office of the Department of Public Works
of said City, which include an estimate of the proportion that the cost of an adequate
local sewer,, built along the labove line nears to the cost of the main sewer; to be
built as follows: The cost of adequate local sewer, built along the above lifte as above
described is hereby estimated and fixed to be ofthe cost of the
Main sewer to be built along said line as -above set forth.) which proportion as herein
estimated and fixed, shall be taken and adopted in all computations; requiring a know-
ledge of the cost of such local sewer if built along the line where the main sewer is
to be built. The cost of the construction of said sewer shall be divided as- follows:!"

local sewer not adapted to receive sewage from collateral drains or sewers, if -built
along the proposed line as hereinbefore set forth, shall be paid for by the abutting,
property holders and the said City of South Bend, if it be determined that the staid

ty is benefited by said sewer, in the same manner and to the same extent as local
sewers. -are paid for by them, under the Statute in such cases made and provided. 2nd.
The excess of cost over and above what would be equivalent to the cost of a local sew-
er, if built along said line., shall be assessed against eash piece of property in the dt
distri-ct or area to be drained and aguinst, the said City, if it be determined that the
said City is benefited by the -said sewer, according to the manner ' and method prescribd
by law; all of which said property beneficially affected lies within the following
described territory in the said City of South -Bend, St. Joseph County, State of

and above what would be equivalent to the cost of a local's sewer; all of Txhich will
more fully appear" by reference to the profile, map, drawings and specifS cations now

among other things, gives. the exact course of said proposed main sewer, overflows,
and its appurtenances, and the district or area which may be injuriously or bene-
ficailly affected thereby, as shown by the heavy boundary,lines. marked on said map
anddravvings, with proper words and figures written thereon, clearly: ;indic ating what
said heavy boundary lines represent, and the district or area embraced thereby. As -
Assessments if deferred, are to be paid in ten equal annual installments, vdth in-
terest at the rate of six per cent. per annum. A Bond or bonds shall be issued to
the constractor in payment for said work, unless the property owners pay said
assessments before said bond or bonds are issued. Under no circumstances shall the
City of South Bend be or be held responsible for any sum or sums due from said pro-
perty owner or owners for said work, or for the collection of the same, or for the
payment of any bond, bonds, certificate or certificates issued to said contractor
in payment for such work, except for such ^coneys as shall have been actually ree-
eived by said city from the assessments for such improvement.
All proceedings had and work done in the construction of said main
sewer and its appurtenances, manner of assessment of property, collection of
assessments and i sushce of bonds therefor, shall be as provided for in an Act of the
General Assembly of the State of Indiana, entitled "An Act concerning municipal cor-
perations, in matters pertaining tothe construction, alteration and maintenance
of such' sewers and drains in such cities and within four miles thereof, also
providing for the assessment of property specially benefited thereby foTthe pay-
ment thereof, in whole or in part, and for the collection of such assessments;
repaaling all laws and parts of laws in conflict therewith, and declaring, an
emergency,"approved March 6,1905, and all acts supplementary and amendatory thereto,
p,assed by the General Assembly of the State of Indiana. Said improvement to be knows
as BOMAN CREEK TRUNK SEWER AND DRAIN, under Improvement Resolution No. 180
Notice of this resolution shall be published on the 25th. day of
May and on the Z$ day of Tune1912, in the South Bend Daily Times. This Board will
give a hearing on thi`e ;Resolution'at its, office in the City Hall on the 28th. der of

RESOLUTION OF THE BOARD OF PUBLIC WORKS.
On motion duly made and seconded, the following preamble and resolutions
were unanimo{.isly adopted:
WHEREAS. This Board did on the loth day of January 1912 deem it expedient
and of public uhility to permanently improve CARROLL COURT between TUTT STREET and
SALE STREEt, i* the City of South Bend,St. Joseph County, Indiana, by paving the road-
way of the same, and did on said date pass and adopt a resolution aytharizing said per-
manent improvement, and
WHEREAS. The City Engineer has prepared and filed vidth this Board a report
showing the number and location, as well as the meter ial to be used and the manner of
laying the same, of the service pipes, mains, conduits, laterals and connections
which are, or will be necessary to accommodate the abutting property owners, with gas,
water,heat,steam or any other product for which any person,firm or corporation has been
s?ranted a franchise for supplying the citizens of the City of South Bend, Indiana, which
report is as follows:

BE IT RESOLVED. That said report of said City Engineer be and is
hereby adopted.
And be it further Resolved, that it is contemplated by this Board to
improve CARROLL STREET from TUTT STREET TO SAMPLE STREET all in said City of South
Bend, by grading and paving said street with Asphalt,, Bitulithic',, Creososted Wooden
Block or Brick laid on a five (5) inch Portland Cement gravel concrete foundation
all as shown on the plans ad.in accordance with the profiles and detail drawings
and specifications on file in the office of the Department of Public Wrks of said
City, and that it is and is hereby , so declared,, necessary for the Northern Indiana
Gas & Electric Compa y, which has, and operates under, a franchise from said City to
,supply gas to the citizens of said Ciry, to provide and install m'ainsl laterals,
service pipes and connections for gas in said part of said street, of the descriptin
location and number set forth in said report of said City Engineer., which mains,
service pipes and connections are hereby declared necessary for the immediate use of
said Company in supplying gas to the ow ners of property abutting, upon said part of
said Street.
