Niles Avenue South Bend, IN 46617 RE: Alley Vacation — A Portion of the First North/South Alley East of Niles Ave., South of Howard Street (Preliminary Review) Dear Ms. Robinson: The Board of Public Works, at its September 24, 2019, meeting, reviewed comments by the Engineering Division, Area Plan Commission, Community Investment, Fire Department, Police Department, and the Streets Division. Community Investment and Engineering stated, per IC 36-7-3-13, the vacation would make access to the lands of the aggrieved person by means of public way difficult or inconvenient and would hinder the use of a public right of way by the neighborhood in which it is located or to which it is contiguous. Therefore, the Board of Public Works submitted an unfavorable recommendation for the vacation of this alley. Please contact Engineering at 574 235-9254 lrior• to picking up your radius nra . You will need a radius map showing properties within 150' of the proposed vacation for your petition to the Common Council. C. } » \ f \ \.k W 4 1 4 kl�i 0 Dear Council Members, On behalf of myself, Homeowner, and my family at 934 Niles Avenue in South Bend, Indiana, I am requesting the approval of vacation of a portion of the public alley directly behind my property. The reason for this Alley Vacation Request is to ensure that I am given the same right and/or opportunity to park my vehicle closest to my home without taking that right from any of my neighbors. Because my property faces Niles Avenue, a one -lane street, I am prevented from parking there, due to the fact that I would obstruct the flowing traffic, cause damage to the curb and block the sidewalk. Furthermore, by parking along Howard Street, I am preventing my fellow neighbors from parking in front of their homes. Unfortunately, the alleyway is far too narrow for me to access my garage, unlike the other properties along the alleyway. Parking in the alley allows me to access my back door. During the winter months, I am able to be off the streets to allow the plows to work efficiently. In addition, over the last 25 years, I have properly clear the alley of snow and debris from storms, up to my property line. Thank you in advance for your time and consideration.
