Regulations pertaining to the Historic Preservation Commission are found in Chapter 21 (Zoning), South Bend Municipal Code and Chapter 26 of the St. Joseph County Code. The issuance of this certificate does NOT in any manner, release the recipient from the responsibility of complying with the requirements of the zoning ordinances, building codes, safety codes, ADA or other requirements of the City of South Bend, the County of St. Joseph, the State of Indiana, or the United States Federal Government. My initial thoughts were that perhaps the tree could be salvaged, but upon inspecting its numerous buttress roots, I found varying amounts of fungal decay primarily on the south and west sides of the root crown. This will eventually cause the tree to become un-anchored from the roots and it will fail. Additionally, up in the crown there was a failure of one of the scaffold branches due to fungal decay, and there is obvious decay in that branch which extends downward as a fungal decay column into the main trunk. This hazards 3/4 of the tree that could fail from that area of the trunk. There are numerous other areas further up in the tree where cavities can be observed. Taking all of these issues into consideration, we would recommend removing the tree. Miramontes or KC Tree should both be able to do a good job on this removal for you.
