RESOLUTION NO. 45 On motion made by Mr. Helmen, seconded by Mr. Koczan and unanimously carried, the Commission approved the resolution en- titled "Resolution of the South Bend Redevelopment Commission, Governing Body of the City of South Bend, Department of Redevelop- ment, Approving the Proposed Sale of the North Part of Disposition Parcel I in the Sample Street Redevelopment Project, Indiana R -7, by Advertising Said Realty and Soliciting Written Bids" which is hereby made a part of these minutes. IV. INTERSTATE DEMOLITION LETTER RE REMOVAL OF SLABS Mr. Lynch appeared before the Commission regarding removal of excess slabs in the Sample Street Indiana R -7 area. He stated it was too costly for the demolition company to remove these slabs without added remuneration. Mr. Baer informed Mr. Lynch that official representatives in Chicago advised him that they were of the o inion that the demolition contract contemplated a complete demolition of the area and that is what would be expected. They IV. INTERSTATE DEMOLITION LETTER REMOVAL OF SLABS also emphasized strongly that Mr. Lynch was expected to continue to work. They advised that Mr. Lynch report in writing any objection or claim he may have to the Commission for their consi- deration. V. VAL OF CITY BUDGET On m tion made by Mr. Helmen, seconded by Mr. Koczan and unanimously carried, the Commission approved the submittal of the Urban Renewal Comm' ssion budget to the City, as prepared. VI. PROGRESS REP( Mr. Bielicki informed the Commission of a letter from HHFA, Chicago, which reported on rent collection prac- tices in the Sample Street Area. Generally, HHFA seems to be satisfied. Their suggestions were, 1) to deter- mine exactly what the situation is to relief recipients, 2) w should not automatically apply relocation payment to b ck rentals. The Commission, upon discussion, stated that in each and Every case where the relocation payment will be applied towards the removal of rental delinquencies, theSE cases must be reviewed by the Commission before any 4ction is taken. On a motion made by Mr. Helmen, seconded by Mr. Place and unanimously carried, the Commission determined that the time for the application for payment of Relocation Clainis has been extended from four months to a period of six months. This extension of time was granted so that the applicants for the Relocation Payment would have a greater amount of time available to them for the submission of claims. Mr, �ielicki reported that the following rentals were due rom the persons listed below: BADGER, Jodie,IParcel 9 -6. Paid $45 Relocation Claim towards rent, still due $40.26. Delinquent rent amount too small to be economically feasible to attempt to collect it. DELINQUENT RENT IND. R -7 RELOCATION CLAIMS - TIME EXTENSION WRITING- OFF UNCOLLECT- IBLE BACK RENT IV. ROGRESS REPORT - Continued JACKS N, Alfreddie: Parcel 8 -15. Paid $54 Relocation Claim towards rent, still due $48.91. Amount too small to be economically feasible to attempt to collect it. JACKS N, Thomas: Parcel 11 -6. Paid $36 Relocation Claim towar s rent, still due $176.74. No economic resources for c llection. NEAL, Jesse: Parcel 12 -32. No prospect for collecting $55.65 back rent. STEVENSON, Corraine: Parcel 8 -30. Owes $106.18. No possibility for collection due to intermittent employment and tenant moved from offsite address. Whereabouts unknown. THOMAS, James: Parcel 8 -17. Owes $27.58. Amount too small to be economically feasible to attempt to collect it. On motion made by Mr. Helmen, seconded by Mr. Koczan and unanimously carried, the Commission approved the writing -- off cf the above rentals as uncollectible. DAVIS, George: Parcel 2 -29. Owes $75. GARNISHMENTS KI, Irving: Parcel 12 -34. Owes $84.08. SCOTZ, Steve: Parcel 2 -4. Owes $423.66. Upon motion made by Mr. Place, seconded by Mr. Koczan and unanimously carried, the Commission recommended garnishment proceedings be initiated against the above tenants since all attempts to collect delinquent rent have been exhausted and po special hardship appears to exist. Meeting adjourned 12 :25 p.m. uis, President Fre elmen, Secretary RESOLUTION NO. 45 ION OF THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT APPROVING THE ED SALE OF THE NORTH PART OF DISPOSITION PARCEL 1 IN THE SAMPLE REDEVELOPMENT PROJECT, INDIANA R -7 BY ADVERTISING SAID REALTY AND SOLICITING WRITTEN BIDS. WHEREAS, land constituting the North Part of Disposition Parcel 1 of the Sample Street Project No. Indiana R -7 has been acquired for the u e and benefit of its Department of Redevelopment; and WHEREAS, the South Bend Redevelopment Commission is of the opini n that this land should be offered for sale as promptly as possi- ble s ject to the requirements of the Redevelopment Plan; and WHEREAS, the South Bend Redevelopment Commission is of the opini that proposed sale at this time would be both timely and to the b st interests of the community; NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission as follows: 1. (a) That the proposed real estate offered for sale is fully described in the Offering Sheet, which Offering Sheet is ordered attached hereto as Exhibit A and made a part of this resolution. That the teal estate to be sold at this time should be the real estate known as the North Part of .Disposition Parcel 1 as shown on the map prepared by Chas. W. Written bids are to be publicly opened and announced at a special meeting of the Redevelopment Commission to be held on September 20, 1962 at 11:00 A.M. C.D.T. at the office of the South Bend Redevelopment Commission at 129 West Colfax Avenue in South Bend, Indiana. That in all res- pects the proposed disposal procedure follow the Statutes of the State of Indiana. (c) That the proposed minimum disposal price shall be not less than 23.7 per square foot, which price is not less than the fair value of the land for use in accordance with the Urban Renewal Plan and is equal to the average of the three; appraisals made of the fair value of said land.
