Agenda: Preliminary Review of Complaint filed by Henry Davis Jr.
Council President and Rules Committee Chair Derek Dieter opened the meeting by
stating an official complaint had been filed by Councilman Henry Davis against fellow
Councilman Dr. Fred Ferlic and against Police Chief Chuck Hurley.
Derek then asked Council Attorney Kathy Cekanski - Farrand to explain the protocols
dictating where we go from here.
Kathy began by suggesting Dr. Ferlic recuse himself from the Rules Committee for the
time it deals with the complaint filed against him. Dr. Ferlic did so.
Kathy noted that the governing South Bend Municipal Code provisions permit its Council
Rules Committee to have the assistance of the City Attorney, Council Attorney or outside
Legal Counsel. She suggested that the complaint could be referred to the City Attorney
Aladean DeRose and herself for a procedural recommendation to be given to the
Committee within 10 business days (Aug. 8)
Dr. Varner motioned that referral. Karen White seconded and all agreed.
In the matter of the complaint against Chuck Hurley, Kathy said in that the Chief was a
department head it would be up to the City Administration to follow through according to
their own protocol.
There being no further business to come before the committee at this time, Chairperson
Derek Dieter adjourned the meeting at 4:10 p.m.
