Minutes o the Meeting of 2 July were approved as mailed, upon motion made by
Mr. Louis, seconded by Mr. Helmen, and unanimously carried.
The following business was discussed:
(1) REPORT ON HOWARD PARK NEIGHBORHOOD IMPROVEMENT
PROJECT
Mr. Ery n Purwcker,' Chairriian, Advisory Committee; Howard Park Neighborhood
Improvement Project, gave a report on the progress of the neighborhood. A door -to-
door inspection of the homes in the area, on a voluntary basis, is meeting with
moderate success. Bad weather last winter, and a shortage of inspection personnel,
have slowed down the program.
Mr. Suche stated in next year's budget we have planned accordingly to overcome
the shortc mings of such a project by the addition of the following staff members:
(1) Full Time Inspector - to eliminate the shortage of inspection
personnel. He will make the initial inspections. When major problems arise, these
can be turned over to the individual specialist concerned, such as heating inspector,
plumbing inspector, etc.
(2) Community Organization Worker (part time basis) - this staff
member's duties_ would consist of arousing interest in neighborhood organizations
and obtaining the cooperation of the people concerned, with the use of talks,
slides, m vies, contests, etc. He would also guide efforts of neighborhood groups
into coast uctive channels once they are formed.

(3) AC4EPTANCE OF OFFER FOR FEDERAL PLANNING ADVANCE
Mr. Sucher reported that the U.R.A. has approved our submission of the Eligibility
& Relocation Report., and offered an Advance of Federal Funds to aid us in
financing the cost of final surveys and plans for the urban renewal project.
The amo t of the Planning Advance is $70,507-87. This is the amount of federal
funds th t will be allowed us until the end of the planning stage.
Mr. Baer explained the legal conditions of the Contract for the Planning Advance.

RESOLUTION ACCEPTING THE OFFER OF FEDERAL
ADVANCE
WHEREAS, under Title I of the Housing Act of 1949, as amended and
anted, the United States of America (herein called the "Government ") has
to the City of South Bend, Department of Redevelopment) herein called
al Public Agency ") an offer, hereinafter mentioned, to make an Advance

s for an urban renewal project, designated Project No. Ind. R -7 in the

WHEREAS the Local Public Agency has given due consideration to

Section 1. The offer of the Government to the Local Public Agency,
dated 21 July, 1959, designated "Contract for Planning Advance ", Contract No.
Ind. R -7 (A), consisting of Parts I and II, under and subject to the provisions,
terms and conditions of which the Government would make an Advance of Federal
funds to the Local Public Agency to aid in financing the cost of certain surveys and
plans fo an urban renewal project, designated Project No. Ind. R -7, situated
in the C'ty of South Bend, Indiana, is hereby in all respects accepted.
Section 2. The Local Public Agency agrees to abide by all of the
provisio s, terms and conditions of said offer.
Section 3. The President of the South Bend Redevelopment Commission,
Governing Body of the Local Public Agency is hereby authorized and directed forth -
with to send to the Housing and Home Finance Agency two certified copies of the
proceedings of the Local Public Agency in connection with the adoption of this
Resoluti n, together with two certified copies of this Resolution, and such further

Section 4. The President of the South Bend Redevelopment Commission
r authorized to file requisitions, together with necessary supporting
ts, with the Government, from time to time as Advance funds are required,
ig payments to be made to the Local Public Agency on account of the

Section 5. This Resolution shall take effect immediately.
Mr. L uis introduced a resolution to accept the Offer of the United States to
make aa Advance of Federal Funds to aid in financing the cost of surveys & plans
for the urban renewal project No. Ind. R -7. Mr. Koczan seconded the resolution.
It was imanimously passed, and the necessary forms were executed.
Mr. Sucher suggested in planning our second project the City should pay planning
and administrative costs and work with the 3 /4 Grant Allocation Formiula; the
advantages to this would be as follows:
(1) It would enable us to go ahead with the planning of the 2nd
project immediately, regardless of the survey and planning approval date of
this project.
(2) It would save time.
(3) Our existing City Budget would be adequate for this.
(4) SELECTION OF ACQUISITION APPRAISERS
One problem in connection with the appraisals in the Sample St. Area is the
required legal description of each piece of property, along with the correct
present owner. We cannot supply the necessary data by using the Assessor's
record3 because they are not quite up to date.
The Title Company seems to be our only way to secure adequate legal descriptions.
An approximate $ 2 charge would be involved for each unit, for which our
federal budget would have to be revised for this additional amount. Further
instructions from U. R. A. will be sought on this problem.
There are 700 appraisals to be done (350 units, each requiring 2 appraisals) .
Six firms are being considered for this work, each of whom have already
submitted its bid for varying portions of the work.
Mr, H lmen stated he thought there would be more uniformity and less confusion
if 4 ap raisers handled the job, with each doing one appraisal for one -half of
the area.

WHE.REAS, the South Bend Redevelopment Commission, has determined that
the four appraisers selected possess qualifications justifying the expectation that
they will furnish appraisal reports on which the Commission and the Housing & Home
Finance Agency can act with confidence, and that they will be able to support their
conclusion capably in the event of investigation or court proceedings;
AND WHEREAS, the appraisers have represented to the satisfaction of the
South Bend Redevelopment Commission that they do not have any interest, present
or prospec ive, that could reasonably be construed either to impair their ability
to furnish impartial reports, or to raise any question as to their impartiality or
fairne s s;

WHEREAS, the South Bend Redevelopment Commission, on the basis

at rates that do not exceed what typically would be paid
in the locality for equivalent services, based on com-
pensation that has been paid and is being paid by
others for similar services;
the compensation to be paid is within the limitation of the
approved budget on the amount available for such services.

NOW THEREFORE, the following individuals are hereby designated to eacA

In o der to make the foregoing determinations, the South Bend Redevelopment
Commissio has:

Uade appropriate inquiries among users of. appraisal services, parm,
titularly other public agencies, to identify the best qualified appraisers
for the particular assignment and to obtain information as to their
competence and qualifications to perform the proposed appraisal
services.
Made inquiries of the attorney expected to handle condemnation liti-
gation for, the Local Public Agency and of condemnation trial attorneys
for other, public. agencies, to obtain information as to the relative
abilities of the appraisers to support their valuations by court testimony,
Made pertinent in among other users of professional appraisal
services, particularly other public agencies, to estimate the- prevailing
rate in the locality for equivalent services, including the obtaining of
information with respect to the rates of compensation that have been and
are being paid to the appraisers, the types of property appraised, the
extent and character ,of the appraisal reports and services furnished, and
the caliber of the appraisers employed.
Given: full consideration. to available qualified appraiser's, -conferred
with six of them, and selected four appraisers to perform the required
work. In conferring with appraisers, the Local Public Agency, has
ensured that each such appraiser fully understands the requirements, has
ascertained their qualifications for the particular assignment, and
obtained proposals as to the conditions under which they would undertake
the work. .

Required the selected appraiser to submit a statement conforming to
the conflict -of- interest provision in the HHFA standard form of contract
for the particular type of services to be furnished by the appraiser.
Obtained statements, signed by the selected appraisers, setting forth
their qualifications, including education, technical training experience
(particularly to estimate the value of the properties to be appraised),
and the courts in which they have testified as expert witnesses.
Negotiated contracts with the selected contractors on the basis of the
foregoing investigations and analyses, which contracts, in the opinion
of the Local Public Agency, will best serve the interest of the project,
with due regard for (but not primary consideration of) the objective of
holding the expense to a minimum.

After a brief discussion it was decided that the following firms would be asked to
handle the 1st and 2nd sets of appraisals, upon motion made by Mr. Koczan,
second d by Mr. Helmen and unanimously carried:

rovided these firms agree on a $3, 500 overall fee for appraising 1/2 of
the pr tect area, and to complete appraisal work within the time limit.
As soo* as the title work is cleared the appraisal work will begin.
Mr. Su her will contact the chosen appraisers for the lst and 2nd set of appraisals,
and forward to the Chicago Office the proposed Contracts. Also, according to
Mr. Place's request, he will notify those not selected at this stage that they will
be considered for the 3rd set of appraisals to be done next spring.
(5) N(NE OF THE COMMISSION MEMBERS ARE PROPERTY

For record purposes, the Commission Attorney asked the individual members
of theC mmission and the staff if they owned any properties in the Sample Street
Redevelopment Area.

Mr. Bar remarked he would check with the City's records to see if such a set
of pers nnel rules were ever drawn up. If so, they will be presented at the
next m eting .
(7) �OMMITTEES ISCUSSION OF PROPOSED MEMBERSHIP LIST OF
There as further discussion of the membership of the various committees, but
definit action was postponed until the next meeting.

(8), PAO0AESS REPORT
Sampl Street Project
Mr. Sucher stated that the Master Plan is progressing satisfactorily, and should
meet initial federal requirements by the end of 1959.

The proposal of the Znd project - the "Downtown Project" went before the Council
about a month ago, but it was decided not to ask for approval then, but rather to
delay action until the outcome of both the Building Authority and the Housing
Bill "'have bpen decided.
(9) �ONTRACT - MARKETABILITY STUDY & REUSE
APPRAISAL
Mr. Sucher related that our Contract for the Marketability Study and Reuse
Appra,J,sal has been approved by the Chicago Office, and wblre .now ready to
forward it to the Real Estate Research Corporation, the firm contracted for
this work.
Copies of the Contract wer a then executed by the Commission President and
Secret ry, respectively.
Mr. S Cher will forward these copies to the Real Estate Research Corporation
for the'`r signature, along with a letter authorizing them to proceed with the
study,
(10) PRINTING OF HOUSING CODES
Verhe, Laic, Building Commissioner, has asked the Redevelopment .
Department to assume 50% ($200) of the cost of printing the Housing Codes. His
reason'ng for this request was as follows:
(1) The Codes relate to the functioning of both departments.
(2) The allocated funds in the Printing Account of the
Department cannot meet this printing cost.
Mr, 'V�T'lliams made a motion to approve the expenditure of $200 toward the print-
ing co t of the Housing Code. Mr. Louis seconded it, and it was unanimously
