HomeMy WebLinkAboutNo. 0007 determining four appraisers selected that possess qualifications justifying expectations that they will furnish appraisal reports and can act with confidencedete3 justi: whicl with (No. 7) RESOLUTION WHEREAS, the South Bend Redevelopment Commission, has nined that the four appraisers selected possess qualifications ring the expectation that they will furnish appraisal reports on the Commission and the Housing & Home Finance Agency can act ;onfidence, and that they will be able to support their conclusions ly in the event of investigation or court proceedings; and WHEREAS, the appraisers have represented to the satisfaction of the South Bend Redevelopment Commission that they do not have any interest, present or prospective, that could reasonably be construed either to impair their ability to furnish impartial reports, or to raise any question as to their impartiality or fairness; and and basic has c WHEREAS, the proposed contracts conform to the Housing & Finance Agency standard form of appraisal contract No. H -639; WHEREAS, the South Bend Redevelopment Commission, on the of inquiries among other users of professional appraisal services :termined that the compensation to be paid is: (a) fair and proper under all circumstances; (b) at rates that do not exceed what typically would be paid in the locality for equivalent services, based on compensation that has been paid and is being paid by others for similar services; (c) the compensation to be paid is within the limitation of the approved budget on the amount available for such services.; and WHEREAS, the proposed contract for the selected selected appraisers' services will fulfill the needs and requirements of the project and will best serve the interest of the project with due regard for the objective of holding the expense to a minimum; NOW, THEREFORE, the following individuals are hereby designated to each appraise 1/4 of the Sample Street Redevelopment Area, for an overall fee of $1, 750 each, with court appearance to be compensated at the rate of $100 per full day and $50 for 1/2 day or less. In order to make the foregoing determinations, the South Bend Re evelopment Commission has: , (1) Made appropriate inquiries among users of appraisal services, particularly other public agencies, to identify the best qualified appraisers for the particular assign- ment and to obtain information as to their competence and qualifications to perform the proposed appraisal services. (2) Made inquiries of the attorney expected to handle con- demnation litigation for the Local Public Agency and of condemnation trial attorneys for other public agencies, to obtain information as to the relative abilities of the appraisers to support their valuations by court testimony. (3) Made pertinent inquiries among other users of professional appraisal services, particularly other public agencies, to estimate the prevailing rate in the locality for equivalent services, including the obtaining of information with re- spect to the rates of compensation that have been and are being paid to the appraisers, the types of property apprai- sed, the extent and character of the appraisal reports and services furnished, and the caliber of the appraisers em- ployed. (4) Given full consideration to available qualified appraisers, conferred with six of them, and selected four appraisers to perform the equired work. In conferring with apprai- sers, the Local Public Agency has ensured that each such appraiser fully understands the requirements, has ascer- tained their qualifications for the particular assignment, and obtained proposals as to the conditions under which they would undertake the work. (5) Required the selected appraiser to submit a statement conforming to the conflict -of- interest provision in HHFA standard form of contract for the particular type of services to be furnished by the appraiser. (6) Obtained statements, signed by the selected appraisers, setting forth their qualifications, including education, technical training experience (particularly to estimate the value of the properties to be appraised), and the courts in which they have testified as expert witnesses, (7) Negotiated contracts with the selected contractors on the basis of the foregoing investigations and analyses, which contracts, in the opinion of the Local Public Agency, will best serve the interest of the project, with due regard for (but not primary consideration of) the objective of holding the expense to a minimum. 1 s (Signature) President South Bend Redevelopment Commission L
