Il� ITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT DECLARATORY RESOLUTION ONE, SAMPLE STREET REDEVELOPMENT PROJECT AREA WHEREAS, the South Bend Redevelopment Commission, Governing Body of the City of South Bend, Department of Redevelopment (herein called the "Commission" ) has made investigations, studies and surveys of various blighted areas wit in the City of South Bend, Indiana, and of the costs contributing to th he blighting Of such areas; and WHEREAS, such investigations, studies and surveys have been made in cooperation with the various departments and bodies of the City and have been directed to determining the proper use of land so as to best serve the interests of the Cit and its inhabitants, both from the standpoint of human and economic values, aid as a result of such investigations, studies and surveys the Commis- sion has lieretofore found that the area hereinafter described has become blighted to such arl extent that such conditions cannot be corrected by regulatory process or by the rdinary operations of private enterprise without resort to the provisions of the Redevelopment of Cities and Towns Act of 1953, as amended, and as supple- mented by Chapter 173 of the Acts of 1957, and that the public health and welfare would be benefitted by the acquisition and redevelopment of such area under the provisionq of said acts; and described dations WHEREAS, the Commission now finds that the area hereinafter is one in which: (a) the buildings are used in part as dwelling accommo- i in part for commercial purposes; (b) the housing accommodations are -1- Resol L No. 14 to a large extent unsanitary and unsafe, and the use of the same causes an increase and spread in disease and crime; (c) the area is entirely surrounded by heavy indus- tries and ailroads; (d) the area lacks all community facilities, including school and recreation facilities; (e) the conditions existing in said area necessitate excessive and dispo tionate expenditure of public funds for crime prevention and punishment, public he lth and safety, fire and accident protection, and other public services and facilities f the City, and impair the value of property in surrounding areas; (f) the existing c nditions result in the reduction of the value of taxable property within the City; (g) a conditions are beyond remedy and control by regulatory process because of the obs lete and deteriorated character of the buildings and other improvements, faulty pl ning and land use, shifting of population and technological and social changes; (h) the ac uisition and redevelopment of said area in accordance with the Redevelop- ment Plan and Master plan hereinafter referred to will benefit the health, safety, morals and welfare, and will serve to protect and increase property values in the City and the state; (i) such acquisition and redevelopment of said area are public uses and purposes; and WHEREAS, the Commission has heretofore caused to be prepared maps and plats showing the boundaries of the hereinafter described area, the loca- tion of thel various parcels of property, streets, alleys and other factors affecting the acquisition, clearance, replanning, rezoning or redevelopment of such area, indicating the portions of the area acquired which are to be devoted to public pur- poses and r the redevelopment plan; also, a list of the owners of the various par- cels of pr perty to be acquired, all of which, appropriately identified, are now on file with a Commission; and W H E R E A S, the Commission has caused a separate appraisal to be made by three independent appraisers of the fair value of each of the parcels of - 2 - Re solutio:h No. 14 property koposed to be acquired, which appraisals are now on file with the Com- mission, land the Commission now finds that the estimated cost of acquiring the property fn the blighted area hereinafter described, determined by taking the average of the thr�e separate appraisals is now therefore, BE IT RESOLVED by the South Bend Redevelopment Commission that the area which is bounded and described as follows: BEGINNING at the intersection of the westerly right of Chapin Street with the southerly right of way line of the New York Central Main Line right of way. THENCE, in an easterly direction along the southerly right of way line of said New York Central right of way for a distance � of approximately 730 feet to the inter- section with the easterly right of way line of Scott Street. THENCE, in a southerly direction along said easterly right of way line of Scott Street for a distance ,l of 800 feet to the intersection with the easterly right of way line of Prairie Avenue. THENCE, along the easterly right of way line of Prairie Avenue for a distance � of approximately 1460 feet in a southwesterly direction to the point where said easterly right of way line of Prairie Avenue intersects with the southerly right of way line of Garst Street, extended. THENCE, along the southerly right of way line of Garst Street extended and Garst Street for a distance of 600 feet in a westerly direction to the end of Garst Street at the easterly property line of Wilson Brothers. THENCE, in a northerly direction for a distance � of 290 feet along said easterly property line of the Wilson Brothers Plant to the northerly right of way line of Kerr Street. THENCE, in an easterly direction along the northerly right of way line of Kerr Street for a distance of 220 feet to the intersection with the westerly right of way line of Catalpa Avenue. - 3 - Re solutioln No. 14 THENCE, in a northerly direction along the westerly right of way line of Catalpa Avenue for a distance of 300 feet to the intersection with the southerly right of way line of Sample Street. THENCE, in a westerly direction along the southerly right of way line of Sample Street for a distance � 940 feet to the intersection with the westerly right of w ay line of McPherson Street, extended. THENCE, in anortherly direction along the westerly right of way line of McPherson Street, extended, and McPherson Street, for a distance � of 825 feet to the intersection with the northerly right of way line of the first east -west alley north of Dunham Street. THENCE, easterly along said northerly right of way line of the alley for a distance of 960 feet to the intersection with the easterly right of way line of the second north -south alley east of Laurel Street. THENCE, in a southerly direction along said easterly right of way line of the alley for a distance � of 12 5 feet to the intersection with the northerly right of way line of Dunham Street. THENCE, easterly along the northerly right of way line of said street for a distance � of 350 feet to the inter- section with the westerly right of way line of Chapin Street. HENCE, northerly along the westerly line of said street for a distance � of 970 feet to the point of BEGINNING. (With the exception of Project Parcels Nos. 15 -6 and 15 -7, the property of Gust and Mildred Caras, and Project Par- cel No. 15 -9, the property of Charllie Ann Campbell). is hereby found and declared to be a blighted area within the meaning of the Rede- velopmen� of Cities and Towns Act, Chapter 176 of the Acts of 1953, as supplemented by Chapte�r 173 of the Acts of 1957;that said blighted area constitutes a menace to the social and economic interests of the City and its inhabitants, and it will be of public uti�ity and benefit to acquire such area and to redevelop the same under the provisiono of said acts. - 4 - Resolution No. 14 to the referred in actor Commis s B E I T F U R T H E R R E S O L V E.D that in all proceedings relating sition and redevelopment of the above described area the same shallbe as "Sample Street Redevelopment Project Area. BE IT F U R T HE R RESOLVED that the plat of the area prepared in accord lance with the governing statutes and now on file with the Commission, marked " is hereby Property Map, Sample Street Project Area, R 311 -E, " be and the same approved. BE IT FURTHER RESOLVED that the list of the owners of the property o be acquired, keyed to "Property 17v4ap, Sample Street Project Area, R 311 -E, " marked "List 1, 2, 3, and 4 - -, Sample Street Project Area, " be and the same is hereby approved. BE IT FURTHER RESOLVED that the general redevelopment plan and specifications,. marked "Urban Renewal Plan" and "Land Use Plan, Sample Street Project Area, R 311 -C 1," now on file with the Commission, be and the s me is hereby approved, and that the blighted area hereinabove described be acquired and redeveloped in accordance with said master plan. BE IT FURTHER RESOLVED that a copy of this resolution, together y,,ith the supporting data, map, plat, list and plan be submitted to the South Bed City Plan Commission for examination by said bodies and determination as to whether the redevelopment plan conforms to the master plan for the develop- ment of e City, and for their written orders approving or disapproving this decla- ratory resolution and the redevelopment plan proposed. 5 - Resol . No. 14 BE IT FURTHER RESOLVED that in the event said plan commissi ners shall approve the proposed redevelopment plan, then a notice shall be published in accordance with the requirements of the governing statues, fixing a date for the -hearing and receiving of remonstrances and objections from all person interested in or affected by the proposed acquisition and redevelop- ment, and for the final determination by this Commission of the public utility and benefft of the proposed acquisition and redevelopment of the above described area.
