HomeMy WebLinkAboutNo. 0053 declaratory resolution Chapin Street Redevelopment Project AreaBody of called the of various of the cos made in City and RESOLUTION NO. 53 CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT DECLARATORY RESOLUTION CHAPIN STREET REDEVELOPMENT PROJECT AREA , the South Bend Redevelopment Commission, Governing City of South Bend, Department of Redevelopment (herein "Commission ") has made investigations, studies and surveys blighted areas within the City of South Bend, Indiana, and contributing to the blighting of such areas; and , such investigations, studies and surveys have been ation with the various departments and bodies of the been directed to determining the proper use of land so as to best serve the interests of the City and its inhabitants, both from the standpoint of human and economic values, and as a result of such investigations, studies and surveys the Commission has heretofore found thatIthe area hereinafter described has become blighted to such an extent .hat such conditions cannot be corrected by regulatory process orlby the ordinary operations of private enterprise without resort to �he provisions of the Redevelopment of Cities and Towns Act of 1953, a# amended, and as supplemented by Chapter 173 of the Acts of 1957, a #d that the public health and welfare would be benefited by the acquisition and redevelopment of such area under the provisions of said acts; and , the Commission now finds that the area hereinafter described *s one in which: (a) the buildings are used in part as dwell- ing of the tions and in part for commercial purposes; (b) the housing are to a large extent unsanitary and unsafe, and the use causes an increase and spread in disease and crime; (e) the -1- Resolution No..53 area lacko community facilities, including school and recreation fa- cilities,-I(d) the conditions existing in said area necessitate excessive and dispo #ionate expenditure of public funds for crime prevention and punishment, public health and safety, fire and accident protection, and other public services and facilities of the City, and impair the value of Oroperty in surrounding areas; (e) the existing conditions result inIthe reduction of the value of taxable property within the City; (f) lthe conditions are beyond remedy and control by regulatory process because of the obsolete and deteriorated character of the buildings and other improvements, faulty planning and land use, shift- ing of population and technological and social changes; (g) the acqui- sition ano redevelopment of said area in accordance with the Redevelop- ment Planjand Master plan hereinafter referred to will benefit the health, safety, morals and welfare, and will serve to protect and increase property values in the City and the state; (h) such acquisi- tion and redevelopment of said area are public uses and purposes; and the Commission has heretofore caused to be prepared maps and puts showing the boundaries of the hereinafter described area, the Ilocation of the various parcels of property, streets, alleys and other Ifactors affecting the acquisition clearance, replanning, rezoning o� redevelopment of such area, indicating the portions of the area acquired which are to be devoted to public purposes under the re- development plan; also, a list of the owners of the various parcels of property to be acquired, all of which, appropriately identified, are now on1file with the Commission; and , the Commission has caused a separate appraisal to be made by three independent appraisers of the fair value of each of the parcels oflproperty proposed to be acquired, which appraisals are now on file with the Commission, and the Commission now finds that the -2- Resolultion No. 53 estimated cost of acquiring the property in the blighted area herein- afterldescribed, determined by taking the average of the three separate appraisals is $1,035,265.00* now tlierefore, BE IT RESOLVED by the South Bend Redevelopment Commission that the area located in the City of South Bend, County of St. Joseph, Statelof Indiana, which is bounded and generally described as follows: BEG2NNING at the intersection of the northerly right of way line of the New York Central Railroad and the western right of way line of Laurel Street. THENCE, in a northerly direction along the westerly right of way line of Laurel Street for a distance of 690'+ to the intersection with the northerly right of way line of Western Ave. THENCE, in an easterly direction along the northerly right of way line of Western Ave. for a distance of 1,340'± to the intersection with the easterly right of way line of Scott Street. THENCE, in a southerly direction along the easterly right of way line of Scott Street for a distance of 1,Q30" tv the intersection with the northerly right of.way line of the New York Central Railroad. THENCE, northwesterly along the north right of way line of the New York Central Railroad for a distance of 750'± to the intersection with the west right of way line of Chapin Street. THENCE, north along the west right of way line of Chapin Street for a distance of 87'+ to the intersection with the north property line of the Armour Company. THENCE, in a generally northwesterly direction along the north property line of the Armour Company to the inter- section with the east right of way line of Pine Street. THENCE, south along the east right of way line of Pine Street for a distance of 88'+ to the intersection with the north right of way line of the New York Central Railroad. THENCE, northwesterly along the north right of way line of the New York Central Railroad to the intersection with the west right of way line of Laurel Street, the point of BEGINNING. Resolt is of No. 53 found and declared to be a blighted area within the meaning Redevelopment of Cities and Towns Act, Chapter 176 of the Acts of 1953, as supplemented by Chapter 173 of the Acts of 1957; that said bligh ed area constitutes a menace to the social and Economic interests of th City and its inhabitants, and it will be of public utility and benefit to acquire such area and to redevelop the same under the provisions of said acts. BE IT FURTHER RESOLVED that in all proceedings relating to the acquisition and redevelopment of the above described area the sam- shall1be referred to as "Chapin Street Redevelopment Project Area, No. Iridiana R -29" accorc with t R 2131 in ac( BE IT FURTHER RESOLVED that the map of the area prepared in with the provisions of the governing statutes, now on file Commission, marked "Boundary Map, Chapin Street Project Area Bl)," be and the same is hereby approved. BE IT FURTHER RESOLVED that the plat of the area prepared ordance with the governing statutes and now on file with the Commission, marked "Property Map, Chapin Street Project Area, R 213(Dl)" be anc propez Area, and sl Chapin be an( the same is hereby approved. BE IT FURTHER RESOLVED that the list of the owners of the y to be acquired, keyed to "Property Map, Chapin Street Project R 222A," be and the same is hereby approved. BE IT FURTHER RESOLVED that the general redevelopment plan cifications, marked "Urban Renewal Plan" and "Land Use Plan, Street Project Area, R 213(Cl)," now on file with the Commission, the same is hereby approved, and that the blighted area herein- above described be acquired and redeveloped in accordance with said maste$ plan. -4- ResoU �tion No. 53 BE IT FURTHER RESOLVED that a copy of this resolution, together with he supporting data, map, plat, list and plan be submitted to the South Bend City Plan Commission for examination by said body and determination as to whether the redevelopment plan conforms to the master plan for the development of the City, and for their written ordero approving or disapproving this declaratory resolution and the lopment plan proposed and the approval thereof by the Common Council of the City of South Bend. BE IT FURTHER RESOLVED that in the event said plan commission- ers a d the Common Council of the City of South Bend shall approve the propo ed redevelopment plan, then a notice shall be published in accordance with the requirements of the governing statutes, fixing a data for the hearing and receiving of remonstrances and objections from all persons interested in or affected by the proposed acquisition and redevelopment, and for the final determination by this Commission of the public utility and benefit of the proposed acquisition and redevelopment of the above described area.
