Alternate 03: Contractor shall include the design, fabrication and delivery of (Level 3 through the top of
the building) architectural precast embeds to be integrally built into the concrete
superstructure. Wilhelm will provide typical embeds (at Level 2) which Contractor must
coordinate with Wilhelm the utilization thereof. Contractor shall incorporate such typical
embeds into Contractor's design.

A. Contractor shall coordinate schedule requirements, work activities, erection
sequencing, erection durations, and site logistics with Wilhelm.
B. Contractor shall submit to Wilhelm on a weekly basis, a three (3) week look
ahead schedule detailing its planned erection activities.
C. Contractor shall provide all project management and superintendence as
required to efficiently execute this alternate.
D. Contractor shall provide, maintain and remove all crane mats, road plates, and
any other protection devices necessary to protect existing sidewalks, roadways,
surfaces, etc.

E. Contractor shall not utilize any roof areas of the Project for staging, stockpiling or
hoisting of materials.
F. Contractor shall protect, repair and clean architectural precast panels in
accordance with the Architectural Precast Design and Performance Criteria.
G. Per the schedule provided, all costs for hot/cold weather work have been
accounted for and are included. No additional funds will be provided if this
Contractor incurs costs for weather conditions that should have been anticipated
at bid time.

SECTION I EXPERIENCE QUESTIONNAIRE

SECTION II PLAN AND EQUIPMENT QUESTIONNAIRE
1. Attach an explanation of your plan or layout for performing proposed work. (Examples could
include a narrative of when you could begin work, complete the project, number of workers,
etc. and any other information which you believe would enable the City of South Bend to
consider your bid.) See attached.
2. Attach a listing of the names and addresses of all subcontractors (i.e. persons or firms outside
your own firm who have performed part of the work) that you have used on public works
projects during the past five (5) years along with a brief description of the work done by each
subcontractor. See attached.
3. If you intend to sublet any portion of the work, attach the name and address of each
subcontractor, equipment to be used by the subcontractor, and whether you will require a
bond. However, if you are unable to currently provide a listing, please understand a listing
must be provided prior to contract approval. Until the completion of the proposed project, you
are under a continuing obligation to immediately notify the City of South Bend in the event that
you subsequently determine that you will use a subcontractor on the proposed project.

5. Have you entered into contracts or received offers for all materials which substantiate the

SECTION III CONTRACTOR'S FINANCIAL STATEMENT
Attachment of bidder's financial statement is mandatory. Any bid submitted without said
financial statement as required by statute shall thereby be rendered invalid. The financial

enough in detail so that said City of South Bend can make a proper determination of the bidder's

The undersigned Contractor, being duly sworn upon his/her/its oath, affirms under the penalties of perjury
that:
1. Contractor has not, nor has any other member, representative, or agent of the firm, company,
corporation or partnership represented by him, entered into any combination, collusion or agreement with
any person relative to the price to be bid by anyone at such letting nor to prevent any person from bidding
nor to induce anyone to refrain from bidding, and that this bid is made without reference to any other bid and
without any agreement, understanding or combination with any other person in reference to such bidding.
Contractor further says that no person or persons, firms, or corporation has, have or will receive directly or
indirectly, any rebate, fee, gift, commission or thing of value on account of such sale; and
2. Contractor certifies by submission of this proposal that neither contractor nor any of its principals
are presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from
participation in this transaction by any Federal department or agency; and
3. Contractor has not, nor has any successor to, nor an affiliate of, Contractor, engaged in
investment activities in Iran.
For purposes of this Certification, "Iran" means the government of Iran and any agency
or instrumentality of Iran, or as otherwise defined at Ind. Code § 5-22-16.5-5, as
amended from time -to -time.
b. As provided by Ind. Code § 5-22-16.5-8, as amended from time -to -time, a Contractor
is engaged in investment activities in Iran if either:
i. Contractor, its successor or its affiliate, provides goods or services of twenty
million dollars ($20,000,000) or more in value in the energy sector of Iran;
or
ii. Contractor, its successor or its affiliate, is a financial institution that extends
twenty million dollars ($20,000,000) or more in credit to another person for
forty-five (45) days or more, if that person will (i) use the credit to provides
goods and services in the energy sector in Iran; and (ii) at the time the
financial institution extends credit, is a person identified on list published by
the Indiana Department of Administration.

4. Contractor does not knowingly employ or contract with an unauthorized alien, nor retain any
employee or contract with a person that the Contractor subsequently learns is an unauthorized alien.
Contractor agrees that he/she/it shall enroll in and verify the work eligibility status of all of Contractor's
newly hired employees through the E-Verify Program as defined by I.C. 22-5-1.7-3. Contractor's
documentation of enrollment and participation in the E-Verify Program is included and attached as part of
this bid/quote; and
5. Contractor shall require his/her/its subcontractors performing work under this public contract to
certify that the subcontractors do not knowingly employ or contract with an unauthorized alien, nor retain
any employee or contract with a person that the subcontractor subsequently learns is an unauthorized alien,
and that the subcontractor has enrolled in and is participating in the E-Verify Program, The Contractor agrees
to maintain this certification throughout the term of the contract with the City of South Bend, and understands
that the City may terminate the contract for default if the Contractor fails to cure a breach of this provision
no later than thirty (30) days after being notified by the City.
6. Persons, partnerships, corporations, associations, or joint venturers awarded a contract by the City
of South Bend through its agencies, boards, or commissions shall not discriminate against any employee or
applicant for employment in the performance of a City contract with respect to hire, tenure, terms, conditions,
or privileges of employment, or any matter directly or indirectly related to employment because of race, sex,
religion, color, national origin, ancestry, age, gender expression, gender identity, sexual orientation or
disability that does not affect that person's ability to perform the work.
In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or any
combination of the foregoing including, but not limited to, public works contracts awarded under public
bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards,
or commissions may consider the Contractor's good faith efforts to obtain participation by those Contractors
certified by the State of Indiana as a Minority Business ("MBE") or as a Women's Business Enterprise
("WBE") as a factor in determining the lowest, responsible, responsive bidder.
In no event shall persons or entities seeking the award of a City contract be required to award a subcontract
to an MBE/WBE; however, it may not unlawfully discriminate against said WBE/MBE. A finding of a
discriminatory practice by the City's MBE/WBE Utilization Board shall prohibit that person or entity from
being awarded a City contract for a period of one (1) year from the date of such determination, and such
determination may also be grounds for terminating the contact for which the discriminatory practice or
noncompliance pertains.
7. The undersigned contractor agrees that the following nondiscrimination commitment shall be made
a part of any contract which it may henceforth enter into with the City of South Bend, Indiana or any of its
agencies, boards or commissions.
Contractor agrees not to discriminate against or intimidate any employee or applicant for employment in the
performance of this contract with privileges of employment, or any matter directly or indirectly related to
employment, because of race, religion, color, sex, gender expression, gender identity, sexual orientation,
handicap, national origin or ancestry. Breach of this provision may be regarded as material breach of
contract.
I, the undersigned bidder or agent as contractor on a public works project, understand my statutory
obligations to the use of steel products or foundry products made in the United States (I.C. 5-16-8-1). I hereby
certify that I and all subcontractors employed by me for this project will use steel products or foundry
products made in the United States on this project if awarded. I understand I have an affirmative duty to
notify the City in my bid that my proposal does not include the use of steel products or foundry products
made in the United States. I understand it is my sole obligation and responsibility to provide a justification
to the City, subject to review and approval, why the cost of United States made steel or foundry products is
unreasonable. Prior to award and upon submission of bid which does not use steel products or foundry
products made in the United States, the City, through its director of public works, shall make a determination
if the price of United States made steel or foundry is unreasonable. I understand that violations hereunder

Shell Architectural Precast Concrete Panels, Project No. 119-030.
The Contractor and Surety are bound to the Owner in the amount set forth above, for the payment of which the Contractor and Surety bind
themselves, their heirs, executors, administrators, successors and assigns, jointly and severally, as provided herein. The conditions of this
Bond are such that if the Owner accepts the bid of the Contractor within the time specified in the bid documents, or within such time period
as may be agreed to by the Owner and Contractor, and the Contractor either (1) enters into a contract with the Owner in accordance with
the terms of such bid, and gives such bond or bonds as may be specified in the bidding or Contract Documents, with a surety admitted in
the jurisdiction of the Project and otherwise acceptable to the Owner, for the faithful performance of such Contract and for the prompt
payment of labor and material furnished in the prosecution thereof; or (2) pays to the Owner the difference, not to exceed the amount of
this Bond, between the amount specified in said bid and such larger amount for which the Owner may in good faith contract with another
party to perform the work covered by said bid, then this obligation shall be null and void, otherwise to remain in full force and effect. The
Surety hereby waives any notice of an agreement between the Owner and Contractor to extend the time in which the Owner may accept the
bid. Waiver of notice by the Surety shall not apply to any extension exceeding sixty (60) days in the aggregate beyond the time for
acceptance of bids specified in the bid documents, and the Owner and Contractor shall obtain the Surety's consent for an extension beyond
sixty (60) days.
If this Bond is issued in connection with a subcontractor's bid to a Contractor, the term Contractor in this Bond shall be deemed to be
Subcontractor and the term Owner shall be deemed to be Contractor.
When this Bond has been furnished to comply with a statutory or other legal requirement in the location of the Project, any provision in
this Bond conflicting with said statutory or legal requirement shall be deemed deleted herefrom and provisions conforming to such
statutory or other legal requirement shall be deemed incorporated herein. When so furnished, the intent is that this Bond shall be construed

SECTION 11 PLAN AND EQU 1PMENT UES'1TION AIRE
Upon official award by way of a Contract/Notice of Proceed anticipated to be the week of 9/4/19,
we would begin our engineering work and shop drawings within (1) day of contract award,
engineering start approx. 9/5/19. Engineering would include work on the architectural precast
panel layout and design. Shop drawings will be submitted for approval by approximately
11/14/19, or 50 days after award. The approval period for shop drawings will be for 20 days,
(11/14/19 to 12/11/19). Submission and approval of precast samples and thin brick samples are
to be from 9/13/19 to 10/10/19, 20 days. After those approvals, the precast mock-up is to be
produced and approved from 10/11/19 to 11/21/19. After all approvals, thin brick and form liner
are to be ordered for production, which will begin on approx. 3/9/20, with all precast production
being completed by 8/7/20. Embeds for the precast panels would be ordered and delivered as
directed in the Precast Scope of Work (Level 2 embeds may not be available in time). The 1"
mobilization for the delivery of the precast would be approximately 4/10/20 going through
7/2/20. The 2nd mobilization for the balance of the precast walls would follow starting 7/3/20 and
finishing 9/21 /20.
Note that the Precast Scope of Work is only to deliver the precast panels to the site, the hoisting
and erection is excluded from our scope. Hoisting and erection of the precast panels is Alternate
#5. If Alternate #5 is accepted, then the erection crew will be composed of approx. 9 workers on
average. Work will be one (1) shift per day, eight (8) hours per shift, five (5) days per week,
Monday through Friday, Straight time. Excludes all cost to work overtime, weekends, holidays,
and additional shifts. It is to be further understood that a large crane, loaded tractor trailers, and
man -lifts will need to be able to have access around the entire structure to be able to set and brace
the exterior architectural precast wall panels. Access next to the new structure must be provided
by Others, per the attached crane access plan (if Alternate #5 is accepted). It is also understood
that the tower crane on site (installed and maintained by F.A. Wilhelm) will be available for
precast panel erection if and as required, per the Bid Documents. Normal site "wear and tear" on
the surrounding ground, access road, and pavements can and should be expected. Site repairs as
part of normal precast panel installation is not included in our bid. Crane mats will be used where
possible and practical.
2. On prior public works projects, we have subcontracted out the erection to: Area Erectors, Inc.,
(1225 S. 7ffi St., Rochelle, IL); Ben Hur Construction (2120 Montcalm St., Indianapolis, IN);
Sofco Erectors (7037 Brookville Rd., Indianapolis, IN), and Precast Services, Inc. (8200 Boyle
Parkway, Twinsburg, OH 44087); they have all provided precast installation services on Coreslab
projects in the Midwest. hi addition, Robert Haines Company (2747 N. Emerson, Indianapolis,
IN), H.E.S.S. Caulking & Restoration (1091 S. 7th St, Rochelle, IL, 61068), and Ram
(INDIANAPOLIS, INC.)

Construction Services (4592 40th St., SE, Kentwood, MI 49512) have provided sealant and
cleaning services for Coreslab projects as well.
Subcontractor list is yet to be determined but will be supplied to the Construction Manager within
48 hours of this bid per the documents.
4. The only on -site equipment required for our scope of work would be the tractor trailers delivering
precast to the jobsite, and man -lifts or scissor lifts that will be used to grout and patch the precast
concrete after it is erected.
If Alternate #5 is accepted, then an erection crane will be required for wall panel erection (it will
be provided by the subcontractor erector).
If Alternate #6 is accepted (precast to precast joint caulking) then a man -lift or scissor -lift will
also be on -site to perform this work.
The crane, semi -truck and man -lifts will need 30 feet of access around the building footprint area
to deliver and erect the precast. Tower crane and buck hoist are assumed to be provided by Others
(F.A. Wilhelm).
5. We have material contracts with our vendors of cement, pre -stressing strand, rebar, and weld
plates which allow us to accurately estimate the cost of our materials. In addition, we have
received proposals for the thin brick material, form liner, and insulation that is needed to
manufacture the precast panels for the architectural intent of the project.

B. INCLUSIONS
This proposal includes:
Insulated and solid arch. precast panels, in sizes and thickness as per Coreslab's take -off and panelizations.
-- Precast panels are provided delivered ONLY to the jobsite. Hoisting and erection by Others. Precast panel caulking by Others.
SCHEDULE: See Coreslab schedule attached. Precast delivery starts 4/10/20 as noted in contract schedule, and is
completed by 9/21/20. Straight time only, see Section II Plan & Equipment Questionnaire for more information
concerning schedule and delivery assumptions included in price.
-- All arch. precast pieces to have one face mix, factory buff with back mix to be buff or gray.
Arch. precast face mix to match as closely as possible to PCI Plate # 119, with a light acid etch or sandblast finish.
Precast back mix to be structural gray concrete, where exposed having a two (2) pass hard steel trowel finish. The back
finish in non -exposed areas is to have a one (1) pass steel trowel finish.
12" x 12" samples will be submitted for mix color and finish approval.
(2) sample panels approx. 16 SF in area to be viewed and approved at the precast plant. No site mock-up.

Limestone pattern form liner provided where shown as 8" x 16" with 3/8" wide reveals and 1/4" reveal depth.
An operated & maintained Buckhoist is to be provided by Others, at no cost to Coreslab or our erector (Alt. #5), for
transportation of personnel, equipment, & materials throughout the entire scope of work and shall be a min. of 12'-0" deep.
- Panels to bear on slab edge, typically. Assume approx. (200) locations where pre -welds will be attached to columns for bearing.
- Embeds for any cast -in -place concrete work necessary for precast connx. will be furnished by Coreslab, installed by Others.
Shims and bearing pads are provided as required. Shimming and grouting as required.
-- Uncoated reinforcement.
-- All exposed to final exterior embedded plates, anchorage devices, and loose connection devices shall be galvanized.
- All remaining embedded plates, anchorage devices, and loose connection devices shall be prime painted.
It is assumed that first level precast connections to the CIP structure will be post -installed by Coreslab.
All other embeds required in foundation or CIP structure shall be designed & provided by Coreslab, installed by Others.
Indiana licensed engineering for precast product and connection design, and framing layout.
Payment & Performance Bond.
C. EXCLUSIONS
This proposal does not include any other items and specifically the following:
Any Hoisting or Erection of the precast panels (See Alt. #5).
Any field laid limestone, material and connections (designed & provided by Others in Alt. #1).
Any cast -in -place concrete work. Any installation of precast embeds in foundation or structure.
Any full size mock-ups. Any mock-ups erected at the jobsite, reduced size mock-up only, delivered with off-loading by Others.
Any Caulking of the precast to precast joints only (See Alt. #6).
ACCESS for crane & trucks to move under their own power, per the requirements noted above.
For Alt. # 5, erection of precast shall be in (1) mobilization for crane and crew. Access to be by Others as required on
the attached crane access plan. South elevation precast from Lines 4 to 7 and D to H may be set using the tower crane
on site, per the requirements noted in Add. # 3. Schedule shall be during normal work hours and be continuous
for the erection crew. Tower crane pieces shall be picked off E. Lasalle Ave.
-- For Alt. #5, the Weld Inspector is to be available at all times during prewelds and erection. If he is not available, pictures
will be taken of the welds and will be treated as acceptable if no response by 24 hours.
For Alt. # 5, tower crane cannot be used during precast erection with the ground crane if they interfere with each other.
For Alt. #5, ground crane access will be required on all (4) sides of the structure, to within 20' of it if possible.
For Alt. #5, if a street closure/blockage is required during assembly or disassembly of the crane it shall be provided
by Others at no cost to Coreslab and to be during normal working hours.
C. EXCLUSIONS continued...
Any crane mats (assume exterior crane road paths will be provided by Others to within 20' of the structure).
-- Any precast panel erection work underneath existing poured -in -place formwork.
-- Buckhoist (to be provided by Others, as described above).
Utility location or protection. Any dewatering of footings.
Sealer, painting, staining, water proofing, expansion joints. Caulking of precast to dissimilar materials (limestone, metal, etc.).
-- Any field cuts in precast products which may be required by other trades. Patching of chips caused by other trades.
Structural steel or continuous steel members.
Any jobsite firesafing.

III. PROVISIONS

1. Coreslab Structures (Indianapolis) Inc.is a Certified Plant under the Prestressed Concrete Institute's Plant Certification program.
2. All precast/prestressed concrete will be fabricated in compliance with manufacturing and testing procedures,
control recommendations, and dimensional tolerances set forth by the Precast/Prestressed Concrete Manual MNL-117.
3. Slight color variations in all products must be expected.
4. The above price does NOT include any openings 144 square inches or less being cast into the precast/prestressed
products. Any openings of this size shall be field located and drilled by others.
5. Mutual agreed to project schedule will supersede any written project schedules.
6. Coreslab Structures (Indianapolis) Inc. reserves the right to use standard sections, details, panel design and procedures to facilitate
manufacturing, engineering, and production of precast products.
7. Coreslab Structures (Indianapolis) Inc. will, at additional cost, install items embedded in the precast products for other trades but will
not furnish nor be responsible for the structural integrity or intended purpose of the items.
8. Any fire rated assemblies.
B. WORK ITEMS TO BE PROVIDED OR PERFORMED BY OTHERS
1. Stabilized level access for delivery equipment under their own power into the jobsite.The compacted surface and or slab must
accommodate loaded tractor -trailers.
2. Traffic control if required during delivery and/or erection at/or near the jobsite.
3. Customary care shall be taken when moving crane and material, but the contractor shall provide reasonable access in order to prevent
damage to existing improvements, such as existing roads, curbs, landscaping, or environmentally sensitive areas, etc. Coreslab Structures
(Indianapolis) Inc. shall not be responsible for any damages.
C. DESIGN CRITERIA
Products will be designed to conform to state and local building codes.
Coreslab Structures (Indianapolis) Inc. specialty engineers are Registered Professional Engineers and NOT the Engineer of Record
for the structure.
Coreslab Structures (Indianapolis) Inc. will NOT perform the lateral analysis of the structure.
Coreslab Structures (Indianapolis) Inc. is responsible for the design of individual pieces and connections shown on the Bid
Documents based on Structural Design Parameters furnished by the Engineer of Record.
D. PAYMENT TERMS,
THE ABOVE PRICE IS BASED UPON THE FOLLOWING PAYMENT TERMS:
Unless otherwise specified herein, payment in installments of 90% for the value of engineering, startup, and precasting
work shall be made by the Buyer to Coreslab Structures (Indianapolis) Inc. on or before the 15th day of the month following
the month in which invoiced.
When casting begins, Coreslab Structures (Indianapolis) Inc. shall invoice Buyer for the yard price of material cast specifically
for this project and properly stored in Coreslab Structures (Indianapolis) Inc.'s plant. After payment is received, Coreslab
Structures (Indianapolis) Inc. then agrees to repair or replace any of this material damaged or lost in storage, transit or erection,
without cost to the Buyer. Buyer may inspect this material prior to payment.
Should retainage be required on this project, Buyer agrees to release one half the amount of the specified retainage upon installation
of products in their final position and after welding and grouting is completed. A punch list shall be established not later than 30 days
after completion of erection and the balance of the retainage is due within 30 days of completion of Coreslab's punchlist items.
E. INSURANCE
To the fullest extent permitted by law, Coreslab Structures (Indianapolis) Inc. shall indemnify, defend and hold harmless the General Contractor,
Owner, Architect/Engineer, , Architect's/Engineer's consultants, and agents and employees of any of them (hereinafter referred to as
"Indemnities") from and against claims, damages, losses and expenses, including but not limited to attorney's fees, arising out of or resulting
from the performance of the Work, provided that such claim, damage, loss or expense is attributable to bodily injury, sickness, disease or death,
or to injury to or destruction of tangible property (other than the Work itself), but only to the extent caused by the negligent acts or omissions of
Coreslab Structures (Indianapolis) Inc., anyone indirectly employed by Coreslab Structures (Indianapolis) Inc. may be liable, regardless of whether
or not such claim, damage, or expense is caused in part by an Indemnities. In no event, however, shall Coreslab Structures (Indianapolis) Inc.
be required to defend, indemnify or hold harmless any Indemnities for any negligent acts or omissions of an Indemnities.
F. SPECIAL CONDITIONS
1.This proposal is based on a mutual agreed upon contract (See Coreslab comments in Attachment "A").
2. In the event of a conflict between the agreement tendered and conditions of Coreslab Structures (Indianapolis) Inc.'s proposal, this
proposal shall control the contract.
3. Buyer agrees to immediately notify Coreslab Structures (Indianapolis) Inc. in writing, of any deficiency in Coreslab Structures
(Indianapolis) Inc. products. If the deficiency is determined to be the fault of Coreslab Structures (Indianapolis) Inc. then
Coreslab Structures (Indianapolis) Inc. reserves the right to repair, rather than replace, any spelled or cracked units provided it is
structurally and architecturally feasible and will repair the work with its own forces, or at Coreslab Structures (Indianapolis) Inc.'s
option, authorize the Buyer in writing to have the work done at a mutually agreed price. No back charges will be accepted without
prior written authorization from by Coreslab Structures (Indianapolis) Inc.
4. Coreslab Structures (Indianapolis) Inc. shall not be responsible nor deemed to be in fault on account of delays in performance of this
Agreement due to causes beyond Coreslab Structures (Indianapolis) Inc. control and not occasioned by its fault or negligence,
including but not being limited to war, insurrections, strikes, riots, fires, floods, explosions, earthquakes, serious accidents, and any
act of government, acts of God or the public enemy, failure of transportation, quarantine restrictions, failure of vendors or other
shippers to perform their contracts or non -availability of materials from usual sources or labor troubles causing cessation, slowdown,
or interruption of work, provided such cause is beyond Coreslab Structures (Indianapolis) Inc.'s control.
5. No liquidated damages penalty for late performance is agreed to regardless of Buyer's obligation for such penalty.
6. If the Contractor does not pay, through no fault of Coreslab Structures (Indianapolis) Inc. within seven days from the time payment
should be made as provided in this agreement, Coreslab Structures (Indianapolis) Inc. reserves the right, without prejudice to any
other available remedies, upon seven additional days written notice to the Contractor, stop their Work under this subcontract until
payment of the amount owing has been received.
7. This bid is submitted contingent upon prompt and timely acceptance by Owner and Coreslab Structures (Indianapolis) Inc.'s ability to fit
the production of the work into the existing Coreslab Structures (Indianapolis) Inc.'s production schedules at the time the bid is awarded.
B. This proposal is valid for sixty (60) calendar days, and is contingent upon final approval by Coreslab Structures Credit Department.
9. This proposal is based upon the General Contractor or owner carrying a full coverage "Builder's Risk" on the entire project to which this
proposal applies, at no expense to Coreslab Structures (Indianapolis) Inc. The General Contractor will provide evidence of such coverage
to Coreslab Structures (Indianapolis) Inc.

Contractor Name: Coreslab Structures (Indianapolis) Inc.
The City seeks to enhance its ability to identify responsive and responsible bidders on all City public works
projects by institution of comprehensive submission requirements in compliance with State law. Quality
workmanship, efficient operation, safety, and timely completion of projects requires that all bidders meet
certain minimum requirements to be responsive and responsible bidders.
THIS FORM MUST BE SUBMITTED WITH YOUR BID.
INSTRUCTIONS:
If you are a pre -qualified bidder, complete Section I only.
If you are not a pre -qualified bidder, complete Section II only.
Section II acts as an application for pre -qualification. Submission of Section II will allow the bidder to be
considered for pre -qualification for bids with the City of South Bend Department of Public Works. Pre -
qualified bidders will then be exempt from a portion of the submission requirements outlined in Section 6-
63 of The Responsible Bidding Ordinance No. 10594-18 (hereinafter, "Responsible Bidding Ordinance")
for a period of twelve (12) months.
Thereafter, contractors who are pre -qualified must submit a complete application for continuation of "pre -
qualified" standing, on a form provided by the City ("Responsible Bidder Checklist (1) Pre -Qualified
Bidders") by December 31 s' for the upcoming calendar year, or within twelve (12) months of obtaining pre -
qualified standing. If the status of any item changes within the twelve (12) months, it is the responsibility of
the contractor to notify the City. Failure by any pre -qualified contractor to submit its complete application
for continuation of "pre -qualified" standing within the time prescribed above shall result in automatic removal
of the designation, effective January 1 of the following year, or immediately following the twelve (12) months
of pre -qualified standing.
However, the "removed" contractor or subcontractor shall still be permitted to bid on City public works
projects, though the contractor must submit all required documents under 6-63 until "pre -qualified" status
is re-established.
Please Note: The City reserves the right to request supplemental information from the bidder,
additional verification of any information provided by the bidder, and may also conduct random
inquiries of the bidder's current and previous customers regardless of pre -qualified standing.
It is the sole responsibility of the potential bidder to comply with all submission requirements applicable to
the bidder in Section 6-63 of the Responsible Bidding Ordinance no later than the date of the public bid
opening.

POST BID SUBMISSIONS:
Post -bid submissions must be submitted in accordance with Section 6-64 of the Responsible Bidding
Ordinance. The post -bid submission requirements are as follows:
1. All bidders shall collect, maintain, and provide upon request, a current written list that discloses the
name, address, licensing status, and type of work for any subcontractor from whom the bidder has
accepted a bid and/or intends to hire on any part of the public work project, including individuals
performing work as independent contractors.
2. Each subcontractor, whose portion of the project is estimated to be at least one -hundred fifty
thousand dollars ($150,000.00), shall be required to adhere to the requirements of Section I of the
Responsible Bidder Ordinance as though it were bidding directly to the City, except that the
subcontractor shall submit the required information (including the name, address, and type of work)
to the successful bidder prior to the commencement of work.
3. Failure of a subcontractor to submit the required information shall not disqualify the successful
bidder from performing work on the project and shall not constitute a contractual default and/or
breach by the successful bidder. However, the City may withhold all payment otherwise due for
work performed by a subcontractor, until the subcontractor submits the required information and
the City approves such information.
4. The disclosure of a subcontractor list ("Disclosed Subcontractor(s)") to the City by a bidder shall
not create any rights in the Disclosed Subcontractor(s). Thus, a bidder may substitute another
subcontractor for a Disclosed Subcontractor by giving the City, upon request, written notice of the
name, address, licensing status, and type of work of the substitute subcontractor.
5. The successful bidder and all subcontractors on a public works project are required to submit
certified payroll utilizing the federal form known as WH-347 or a similar form on a bi-weekly basis,
submitted within 10 days after the end of each bi-weekly payroll period. Certified payrolls shall
identify the job title and craft for each employee. Certified payrolls shall be submitted
electronically.
Please Note: Submissions deemed inadequate, incomplete, or untimely by the City may result in
the automatic disqualification of the bid.
The City, after review of complete and timely submissions, shall, in its sole discretion, after taking into
account all information in the submission requirements, determine whether a bidder is responsive and
responsible, and provide a Pre -Qualification Verification Letter. The City specifically reserves the right to
utilize all information provided in the contractor's submission and any information obtained by the City
through its own independent verification of the information provided by the contractor.
