)LUTION OF THE CITY OF SOUTH BEND DEPARTMENT OF REDE-
:)PMENT AUTHORIZING THE FILING OF AN APPLICATION FOR LOAN
GRANT FOR PROJECT NO. IND. R -57
WHEREAS it is necessary and in the public interest that the City of South Bend Depart-
ment of Redevelopment avail itself of the financial assistance provided by Title I of the
Housing Act of 1949, as amended, to carry out the urban renewal project described
as LaSalle Park Project No. 1, and bounded generally as follows:
Beginning at the point of intersection of the north right -of -way line
of L Lnden Avenue and a line which is an extension of the west right -of-
way line of the alley between and parallel to Sheridan Avenue and Chi-
cago Street; proceed east along the north right -of -way line of Linden
Avenue to a point 129.0 feet, more or less, east of the east right -of-
way line of Falcon Street; thence south along a line which is 129.0 f eet,
more or less, east of and parallel to the east right -of -way line of Falcon
Street, a distance of 388.3 feet, more or less; thence at 90 degrees in
a wE sterly direction a distance of 129.0 feet, more or less, to the east
righ -of -way line of Falcon Street; thence south along said right -of -way
line a distance of 485.7 feet, more or less; thence at 90 degrees in an
east Brly direction a distance of 129.0 feet, more or less, to the west
righ -of -way line of the alley between and parallel to Falcon Street and
Lake Street; thence south along said alley right -of -way line a distance
of 11.6. 0 feet, more or less; thence at 90 degrees in an easterly direc-
tion a distance of 203.0 feet, more or less, to the east right -of -way
line of Lake Street; thence south along said right -of -way line a distance
of 51). 0 feet, more or less; thence at 90 degrees in an easterly direc-
tion a distance of 793.0 feet, more or less, to the west right -of -way
line of the alley between and parallel to Kentucky Street and Dundee
Street; thence south along said alley right -of -way line a distance of
250.0 feet, more or less; thence at 90 degrees in an easterly direction
aloe a line north of and parallel to the north right -of -way line of
Was iington Street, to the west right -of -way line of the alley west of
and arallel to Kaley Street; thence north along said alley right -of -way
line to the south ,right -of -way line of the New York Central Railroad;
thence southeasterly along said right -of -way line to the east right -of -way
line of the first alley east of and parallel to Meade Street; thence south
along said alley right -of -way line to the center line of the first alley
north of and parallel to Western Avenue; thence west along said alley
cent gr line to the west right -of -way line of the alley between and parallel
to Sheridan Avenue and Chicago Street; thence north along said alley
rig -of -way line to the north right -of -way line of Linden Avenue which
is the place of beginning,
hereinafter referred to as the "Project "; and
WHEREAS it is recognized that the Federal contract for such financial assistance
pursuant to said Title I will impose certain obligations and responsibilities upon the
Local Public Agency and will require among other things (1) the provision of local
grants-in-aid; (2) a feasible method for the relocation of individuals and families dis-
placed fro the project area; and (3) other local obligations and responsibilities in
connectio with the undertaking and carrying out of urban renewal projects; and
WHEREAE Title VI of the Civil Rights Act of 1964, and the regulations of the Housing
and Home Finance Agency effectuating that Title, provide that no person shall, on
the groun of race, color, or national origin, be excluded from participation in, be
denied the benefits of, or be subjected to discrimination in the undertaking and carrying
out of the urban renewal projects assisted under Title I of the Housing Act of 1949,

WHEREAS the
objectives of the Urban Renewal Plan cannot be achieved through more
extensive rehabilitation
of the Project area:
NOW, THER
FORE, BE IT RESOLVED BY THE City of South Bend Redevelopment
Commission:
1. That the
United States of America and the Housing and Home Finance Adminis-
trator be and
they hereby are, assured of full compliance by the City of South Bend
Department of
Redevelopment with regulations of the Housing and Home Finance Agency
effectuating Title
VI of the Civil Rights Act of 1964.
2. That an
application on behalf of the City of South Bend Department of Redevelop
ment for a loan
under Section 102(a) of said Title I in the -amount of $2, 731, 838 and for.,_,
a project capital
grant and a relocation grant to the full amount available for under -
taking and financing
the Project is hereby approved, and that the Executive Director,
is hereby aut
orized and directed to execute and to file such application with the Hous - ..
ing and Home
Finance Agency, to provide such additional - information and to furnish
such documents
as may be- required in behalf of said Agency, and to act as the author-.
ized correspondent
of the City of South Bend Department of Redevelopment. ,

The undersigned
hereby certifies that:

duly qualified and acting Secretary of the City of South Bend Depart-
ment of Rede
elopment (hereinafter called the "Local Public Agency ") and the cus-
todian of the
ecords of the Local Public Agency, including the journal of the pro -
ceedirigs of ti
e City of South. Bend Redevelopment. Commission (hereinafter called
the "Governi
g Body"); and is duly authorized to execute this certificate.
2. Attached
hereto is a true and correct copy of a resolution, including the
WHEREAS clauses,
adopted at a meeting of the .Governing. Body held on the

3. The resolution
has been duly recorded in the journal of the meeting and is now
in full force and
effect.
4. The meeting
was duly convened and held in all respects in accordance with law
and the bylaw
of the Local Public Agency. To the extent. required by law or the by-
laws, due and
proper notice of the meeting was given. A legal quorum of members
of the Governing
Body was present throughout the meeting, and a- legally sufficient
number of members
of the Governing Body voted in the proper manner for the adoption
of the resolut
on.. All other requirements and proceedings under law, the bylaws, or
otherwise, in
ident to the proper adoption d the resolution, including any publication,
if required by
law, have been duly fulfilled, carried out and otherwise observed.
5. If a seal

Agency and was

required to have
