RESOLUTION OF THE CITY OF SOUTH BEND, DEPARTMENT
OF REDEVELOPMENT AUTHORIZING AND DIRECTING A
CHANGE IN THE APPROVED URBAN RENEWAL PLAN FOR
PROJECT, IND. R -56
WHEREAS, it is necessary and in the public interest that the
City of South Bend, Department of Redevelopment avail itself of the
financial assistance provided by Title I of the Housing Act of
1949, as amended, to carry out the Urban Renewal Project described
as the Industrial Expansion Urban Renewal Area and bounded gener-
ally as follows:
Beginning at the point of intersection of the north right -
of -way line of Cotter Street and the east right -of -way line
of Kendall Street; thence south along the east right -of -way
line of Kendall Street to a point 564 feet, more or less, to
the north right -of -way line of the New Jersey, Indiana and
Illinois Railroad; thence west on a line parallel to the north
right -of -way line of the said Railroad for a distance of
1,069 feet, more or less to the west right -of -way line of
Kemble Avenue; thence north along the west right -of -way line
of Kemble Avenue and its extension, for a distance of
330.32 feet, more or less, to the north -west right -of -way
line of Prairie Avenue; thence north -east for a distance of
265.35 feet,more or less, along the north -west right -of
way line of Prairie Avenue to the point of intersection of
the north -west right -of -way line of Prairie Avenue and the
extension of the north right -of -way line of Cotter Street;
thence east for a distance of 942.60 feet, more or less,
along the north right -of -way line of Cotter Street to the
intersection of the east right -of -way line of Kendall Street,
this point of intersection being the point of beginning.
ereinafter referred to as the "Project "; and
WHEREAS, an Urban Renewal Plan dated December 31; 1966 was
ubmitted to The Department of Housing and Urban Development and
ully approved by The Department of Housing and Urban Development
nd the Local Governing Body; and
WHEREAS, a Loan and Grant Contract by and between the United
tates of America and the City of South Bend, Department of Re-
evelopment was executed and dated July 31, 1968 in order to carry
ut said Urban Renewal Plan; and
WHEREAS, the Urban Renewal Plan so approved hereinafter call -
d "Existing Plan" contemplated the reuse and development of the
ntire Project Area for heavy industrial use to be developed by
ne developer as an expansion of existing industrial complex ad-
acent to the Project Area and that such development would require
ittle or no site improvements; and
WHEREAS, the contemplated redeveloper withdrew its operation
rom the area and from the locality thus requiring that other
otential redevelopers be sought; and
WHEREAS, a Public Offering of said Project land was made with
he approval of the Department of Housing and Urban Development
hich public offering was made subject to the installation of site
mprovements as required and necessitated by the redeveloper's site
Ian.
WHEREAS, the redeveloper has submitted a site plan which has
een approved by this Commission and which requires more extensive
nd different site improvements than contemplated in the "Existing
1 an. "
NOW, THEREFORE, BE IT RESOLVED by the City of South Bend
evelopment Commission:
That the Executive Director of the City of South Bend,
Department of Redevelopment is hereby directed to amend
the existing Urban Renewal Plan for the Project to include the
site improvements that are to be installed in accordance with the
terms of sale of land to the prospective redeveloper; and
2. That the Executive Director is hereby directed and author-
ized to submit this plan change in the form of an Application for
an Amendatory Contract to the Department of Housing and Urban
Development with any and all necessary documents pertaining thereto
including Resolution No. 285 authorizing the filing of an Amendatory
Application for Loan and Grant.
Adopted at the Regular Meeting of the South Bend,-Redevelopment
Commission held at the Office of the Department of Redevelopment,
1200 County -City Building, 227 West Jefferson Blvd. South Bend,
Indiana on the 19th day of June, 1970.
