IND. R -56 WHEREAS, it is necessary and in the public interest that the City of South Be d, Department of Redevelopment avail itself of the financial assistance provided by Title I of the Housing Act of 1949, as amended, to carry out the urban reitewal project described as the Industrial Expansion Urban Renewal Area and boun ed generally as follows: eginning at the point of intersection of the north right -of -way ine of Cotter Street and the east right -of -way line of Kendall treet; thence south along the east right -of -way line of Kendall treet to a point 564 feet, more or less, to the north right -of ay line of the New Jersey, Indiana and Illinois Railroad; thence est on a line parallel to the north right -of -way line of the said .ailroad for a distance of 1069 feet, more or less to the west ight -of -way line of Kemble Avenue; thence north along the west ight -of -way line of Kemble Avenue and its extension, for a distance f 330.32 feet, more or less, to the north -west right -of -way line of rairie Avenue; thence north -east for a distance of 265.35 feet, more r less, along the north -west right -of -way line of Prairie Avenue to he point of intersection of the north -west right -of -way line of Prairie venue and the extension of the north right -of -way line of Cotter Street; hence east for a distance of 942.60 feet, more or less, along the north fight -of -way line of Cotter Street to the intersection of the east right - f -way line of Kendall Street, this point of intersection being the point ,f beginning, hereinafter referred to as the "Project "; and WHEREAS, it is recognized that the Federal contract for such financial assistance, pursuant to said Title I, will impose certain obligations and res- ponsibilities upon the Local Public Agency and will require among other things: (1) the provision of local grants -in -aid; (2) a feasible method for the relocation of individuals and families displaced from the project area; and (3) other local obligati ns and responsibilities in connection with the undertaking and carrying out of u ban renewal projects; and WHEREAS, Title VI of the Civil Rights Act of 1964 and the regulations of the Department of Housing and Urban Development effectuating that Title, provide that no person shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination in the undertaking and carrying out of the urban renewal projects assisted under Title I 4f the Housing Act of 1949, as amended; and EREAS, the objectives of the Urban Renewal Plan cannot be achieved through more ext nsive rehabilitation of the Project Area: , THEREFORE, BE IT RESOLVED by the City of South Bend, Redevelopment Com- mission: 1. the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, assured of full compliance by the City of South Bend, Department of Redevelopment with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964 and applicable Executive Orders.
