At the 5/28 Board meeting, bids were opened for the above -referenced project. Two bids were
received, with base bids as follows:
Coreslab Structures, Inc. $6,593,000.00
High Concrete Group, LLC: $8,296,000.00
The project has a TIF-funded budget of $5,000,000, requiring a payment of $1,593,000 to the
City before the project can be considered fully funded and a contract may be awarded and
executed. While waiting for the Developer, Commerce Center Development, LLC, to provide
the funds, an informal bid complaint was lodged by High Concrete Group on Friday, June 28thN
A copy of the complaint is attached.
High Concrete Group asserts that since the original project schedule (copy attached) cannot be
met because bid award cannot occur (due to the reasons listed above), all bids should be
rejected and project re -bid following resolution of project schedule issue. The City agrees due to
the change of project schedule and funding issues.
The project will be re -bid subject to assurance of full funding and finalized schedule.

Good morning. I am writing to discuss the precast concrete package for the Commerce Center
project that was bid last month. I understand that this project is currently on hold due to
financing issues and F.A. Wilhelm has actually pulled off the site.
This would definitely mean that the project schedule within the bid documents would no
longer be used and thus the bids would no longer be valid.
We were unfortunately not the low bidder for the project because we actually bid the project
schedule in the documents starting in December 2019 and finishing by April 2020, utilizing 2
cranes, 2 crews and overtime to meet the demand.
We specifically know our competitor did not
public. This is very troubling, since had we bid the project based on the same criteria, we
actually had a lower number than our competitor by more than $250,000. However, there was
no place to show that within the public bid documents or on the bid form since there were no
Value Engineered or Alternate bid locations.
Therefore, we would like to know what will be done with the bid once financing is secured
since the project was not bid according to the public documents.
We would expect, as with all other public bid openings, that the project will come back out for
bid to allow for competitive bids once again.
Please let me know what will be done so we can plan accordingly. I look forward to hearing
back from you soon.

CC. Per the schedule provided, all costs for hot/cold weather work have been accounted for and
are included. No additional funds will be provided if this Contractor incurs costs for weather
conditions that should have been anticipated at bid time.
