Said'Imprvement to be known as SOUTH MAIN STREET TRUNK SEWER, under Improvement Resolution No. 176,in the City of South Bend, Indinana. Notice of this resolution shall be published on the l9th. day of May and on the 25th. day of May 1912, in the South Bend Daily Times. This Board will give a hearing on this resolution at its office in the City Hall on the 14th. day of June 1912 at 7:45 P.M. Adopted this 17t h. day of May 1912. Joseph V/County,Indiana :That it is desired and deemed necessary to construct a sewer in Mishawaka Avenue and between the westerly end of seid Mishawaka Avenue and the St.. Joseph River, all in said city, which,, from its size and character is not only int ended and adapted for use by property holders whose property -.buts along the line'of said sewer, but is also intended and adapted for receiving sewage from co_; -lateral drains al- ready ennst ruct ed, or which may, be hereafter constructed, and the sumo is hereby ordered in and=along the following line, in said city,towit:- Beginning on the easterly bank of the A. Joseph River at apoint in line with the center line of Mis-r;awaka Avenue if produced; thence running southeasterly in line with the center line of said Mishawaka Avenue with a sewer fifty-four (54) inches, in diameter to the center line of Eddy Street; thence still southeasterly following the . center line of said Mishawaka Avenue to a point One Hundred (100) f et east of the center line of Emerson Avenue with a forty eight (48) inch sewer; tsLence easterly along the center line iof MishawakaAvenue to the center line of Greenlawn Avenue with a twenty-fo four (24) inch vitrified pipe sewer; thence awit along the center line of said Miq.hawaka Avenue to the center of Ninth Street with a twenty (20) inch vitrified pipe sewer; thence still east along the center of Mishawaka Avenue to the center of Twelfth Street with an eighteen (19) inch vitri fled pipe sewer; thence still east along the center of_ Mish%waka Avenue to the center of Sixteenth Street with a fifteen (15) inch vitrified pips` sewer, together with the house .connections to the curb line along the line of said improvement. And to be built in accordance with the profile, specifications, detail plans, maps and estimates now on file in the office of the Department of Public Works of said Cty, which include an estimate of the proportion that the -cost. of an adequate local sewer, built along the above line bears to the cost of the main sewer; to be built as follows: The cost of an adequate local sewer, built along the above line as above described, is hereby estimated and fixed to be of the cost of the main sewer to be built along said lire as a bove set forth,which proportion as herein estimated and fixed, shall be taken and adopted in all computations requiring a knowledge of the cost of such local sewer if built along the line where the main sewer is to be built. The cost of the construction of, said sewer shall be divided as follows:. ist. So much of such cost as shall be equivalent to the construction of an adequate local sewer not adapted to receive sewage from collateral drains or sewers, if . wilt along the proposed line as hereinbefore set forth, shall be,paid for by the abutting property holders and the said city of South Bend, if it be determined that the said city is benefited by said sewer, in the same manner and to the same extent as local sewers are paid for by them, under the Statute in such cases made and provided. 2nd. the ex- cess of cost over and above what would be equivalent to the cost of a, local sewer, if `quilt along said line, shall be assessed against each piece of property in the district or area to be drained and against the said city, if it be determined that the said City 442 if it be determined that the said City is benefited by the said sewer, accordigg to the manner and method prescribed bynlaw; all of which said property. bene fi ci ally af- fected•lies within the following described +.territory in the said City of South Benq St. Joseph County, state of Indi a,na,t owit : Beginning at the intersection of the northerly bank of the St. Joseph River and the center line of the first north and south alley west of Frances Street in said City; thence running north along the center line of said alley to the center of Division Street,; thence east along the center of Division Street to the center 1 line of the Grand Trunk Western Railway Compyts Rights of.Way; thence easterly a- long the center line of said Railway' Company' s right of way to the center of Green - lawn Avenue; thence north along the. center of said Green -lawn Avenue. to the center of the road along the north line of Section 7 township 37 North, Range- 3 east; thence .east along the center of said road to the center of Nineteenth Street to a point one Hundred fifty (150) feet south .of the south line of Mishawaka Avenue; thence wet west parallel with and one hundred fifty (150) feet south of the south .line of said Mishawaka Avenue and Mishawaka Avenue produced to the easterly bank of the St. - Joseph River; thence Northwesterly following the easterly. bank of said river to a point in line with the center line of the first north and south alley west of Frances Street which point, is the place of beginning. And each piece of property in said district or, area, above described, including abutting property holders and the said City of South Bend, if the said city is benefited, shall be assessed,,as afore- said, to pay said excess of cost over and above what would be equivalent to the cost of a local sewer; all of which will more fully appear by reference tot he profile map,drawings and specifications now on file in t e office of the department of , Public Works of said Cityy, which, among other things, gives the exact course of said proposed main sewer, overflows, and its appurtenances, and. the district, or area which may be injuriously or beneficially affected thereby, as shown by the heavy boundary' lines marked on said map and drawings, with proper words and figures written thereon, clearly indicating what said heavy boundary lines represent, and the district or area embraced. thereby. Assessments if deferred, are to be paid in ten equal annual .installments, with interest at the rate Of six per cent. per. annum. A bond or bonds shall be issued to the contractor in payment for said vb rk, unless the property owners pay said assessments before daid bond or bonds areissued . RESOLVED by the Board of Public Works of the City o f South Bend, St. Joseph County,Indiana: That it is desired and deemed necessary to construct a, sewer in Eddy St reet ,. in said city, which, from its size and character is not only intended and adapted for use by property holders whose property abuts along the line of said sewer, but is also intended and adapted for receiving sewage from collateral drains already constructed,- or which may be hereafter constructed, and the same is hereby ordered in and along the following line, in said ci.t y,t owit : Beginning at the center of the intersection of Jefferson Boulevard and Eddy Street in srAd city, thence running south along the center of said Eddy Street to the center of Diviri.on Street with a twenty four (24), inch vitrified pipe sewer; together with the h ouse connections to the curb line along the line of said improvement. And to be built in accordance with the profile, specifications,detail plans, maps and estimates now on file in the office of the Department of Public Works of said City, which include an estimate of the proportion that the cost of an adequate sew - local sewer, built along the above line bears to the cost of the main sewer; to be built as follows; The cot of an adequate local sewer, built along the above line as above described, is hereby estimated Bnd fixed to be ��� of the cost of the main sewer to be' built along said line as above set forth, which proportion as herein estimated, and fixed. shall be taken and adopted in all computations re qui ring a knowledge of the coast of such local sewer if built along the line where the main sewer is to be buiitit. The excess of cost over and above what would be equivalent to the cost of a local sewer, if built along said line, shall be assessed against each piece of property In the di st ri ct or area to be drained and against the said, City, if it be determined that the said City is benefited by the said sewer, according to the manner and method presci"ibed by law: all of which said property.bene"ficially affected lies within the following described ter- ritory in the said City of South Bend , St. Joseph County, State of Indiana,towit:- Beginning on the S outh line of Jefferson Boulevard, in said City, 150 feet west of the west line of Eddy Street; thence south parallel with and 150 feet west of the west line of said Eddy Street to the first alley north of Quimby Street; thence west along the said alley to the east line of Frances street; thence south along hhe east line of said Frances Street to the center line of the right of way of the Grand Trunk R.R. Company; thence easterly alo g the center line of said right of way to the center line of Greenlawn Avenue; thence north along the center line of Greenlawn Avenue to a point 200 feet south of the south line of Jefferson Boulevard; thence westerly parallel with and 200 feet south of the south line of said Jefferson Boulevard to a point 150 feet east of the east line of Eddy Street; thence north parallel with and 150 feet east of the east line of Eddy Street to the South line of Jefferson Boulevard; thence west a- long the south line of said Jefferson Boulevard to the place of beginning.
