All members present. 1/ Bids were opened on Grade, Curb and walk on Corby Street'$ Under Improvement Resolution No . 141 and in Niles Avenue, grade, curb and walk., Under Improvement Resolution No. 139. The sarme were. referred to the City Engineer for tabulation to be reported back on the 17th. day of May 19120 petition for pavement on Cottage Grove Avenue t.h&t.w&s referred to the City. Engineer The Board ordered placed on file. vBetition received and read asking for the opening of Linden Street from Chicago Avenue East, referred to the City Engineer for investigation. /W. A. Bugbee presented a plat for the Cityt s, approval to be known as. the W.A. BugbeeT s let. Addition to .the City of South Bend, the same was referred -to the City Engineer for investigation. Blue printaand, two propisiti6ins received from the Postal Telegraph Cable Company with regard to the proposed underground conduit on Washington Avenue, Williams and Taylor Street. The same referred to the City Engineer for investigation. STREET OR ALLEY IMPM VEMENT RESOLUTION NO. 1744, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF .SOUTH BEND, ST . JOSEPH COUNTY,STATE OF INDIANA, that it is desired and deemed necessary to improve the FIRST AT14EY NORTH OF LASALLE AVENUE FROM LAFAYETTE STREET TO THE &F FT, ALLEY WEST OF LAFAYETTE STREET, in the City of South Bend, Indiana, by grading�th� said Alley from property 'line to property lime with Brick, Asphalt, Bitulithie, or Creosoted Wooden Blocks laid upon a five (5) inch Portland cement foundation, or with Brick, Granite Blocks, Bitulithie, or Creosoted Wooden Blocks laid upon a six (6) inch gravel four datien, placing tLhe necessary marginal curb, all as shown on plans and in accordance with profiles. details, drawings and specifications on file - n-;the office of the De- partment of the Board of Public Works of the City of South Bend, Indiana. And such.im- provement is now ordered. The cost of the improvement herein provided for, except street and alley intersections, ; shall be paid by special assessment to be levved upon the property -speci- ally benefitteA, to the amount that the same may be: legally assessed therefor,, in ac- cordance with.an Act of. the General Assembly of the State of Indiana, entitled "An Act Concerning Municipal Cerporations," approved March 6,. 1905, and in accordance with and pursuant -,to the provisions of all acts amendatory and supplemental thereto. The cost of all street and alley inttrseetions, including one-half of the width of the improvement opposite street and alloys which run inxto, but de not cress said roadway herein proposed to be improved and that portion of. such street or alley abutting upon property belonging to said City, or upon property hot subject, to such assessment, shall be paid by the City in cash out of its general fund, if able to do Be or from & fund created by a special assessmenht to ;be levied under the pi visions of Section lO of the above entitled Act. Assessments of Tex dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, .with interest at the rate of Six per cent per anr.= -.,.A Bond or bolds will be issued to the contractor to the amount of such deferred assessments in pro rat& payment for such improvement. r Under no ci recumst ance s shall the City of South Bend be, or be held re- sponsible for .any sum or sums due from said property owner or owners for said werk,or for the collection of thef same, or for the payment of any bond, bonds, certificate or certificates, issued to s�i.d contractor in payment for such work, except for such moneys as shall have actually been received by the City from the assessments for such im- provement, or such moneys as said City is by said entitled Act and amendments and sup- plements thereto °required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bends therefor, shall be as provided for in said above entitled Act, and Acts amendatory there- of and supplemental thereto. BE IT FURTHER RESOLVED, That the Board of Public Works fix the 14thday of June A.D. 1912 , at the hour of 10:00 A.M. at the office of the Board of Public Works of this City, as the time and place for the public consideration of said proposed im@ provement, at which said Board of Public Works will hear all persons interested, or whose property is liable to be assessed for said improvement, and will decide whether the bene- fits to the Property liable to be &ssedsed for said improvement gill equal the estimated cost thereof. Be IT FURTHER RESOLVED, That notice of the time and place of such public con sideration be published and mailed in the manner provided by law.
