RESOLUTION OF THE BOARD OF PUBLIC WORKS. y On motion duly made and seconded, the following preamble and resolutions were unanimously adopted: WHEREAS. This Board did on the 10th. day of January 1912 deem it ex- pedient and of public utility to permaxently improve Portage Ave. betw**x Vidduet and Alley north sf Kinyon. Street, By paving the roadway of the same, and did on said date puss and adopt a resolution authorizing said permanent improvement, and WHEREAS. The City Engineer has prepared and filed with this Board a re- port showigg the number and location, as well as the material to be used and the man- ner tf laying the same; of,the service pipes,mains,conduits. laterals and connections which are,or will be necessary to accommodate the abutting property owners with gas, water,keat, steam or any other product for which any person, Firm or corporation has been granted a franchise for supplying the citizens of the City of South Bend,Indiana, which report is as follows: - REPORT REFERRED TO SHOWING. And be it further Resolved, that it is contemplated by this Board to improve Portage Avenue from Viaduct to Alley N. Of Kinyon Street all in said City of South Bend,by grading and paving said avenue with asphalt,Bitulithic,Creosoted Wooden block or Brick, 1 ai d on a five inch port 1 and cement gravel concrete foundation, all as shown on the plans and in accordance with -profiles detail drawings and specifications on file in the office of the Department of Public Wobk s of said City, and that it is and is hereby so declared, necessary for the Northern Indiana Gas & Electric Co. which has, and operates under, a franchise from said City to suppler gas to the Citiiens of maid City,to provide and install mains; laterals ,servicc pipers and con— nee:tions for gas in said part of said street of the deseeription,locatiox and number set forth in said report of said City Engineer, which maixs,servicee pipes and com— neetions are hereby declared necessary for the immediate use of said Company in sup— plying gas to the owners of property abutting upon said part of said street. q wa. Therefore be it resolved, That the Board after due consideration find in each case of said improvement that the benefits to the property, and to the City of South Bend, are equal to the estimated cost of said. improvement , and the same are hereby in all things ratified',confirmed and approved. BE IT RESOLVED, that notices be published in the. The Board after due consideration, resolved to rescind all foster action in this matter. ✓Hearing Given on Improvement Resolution No. 119 for the pavement of 1st:. ally North of Washington from. Resolved, that notices as to the amounts of assessments be published_ for six consecutive .days in t e South Bend Daily Tines,commencing on the -6th. dty of May 19121,stating that this Board will give a hearing on the amount of such assessments, at its office in. the City Hall on the 24th. day of May 1912 at 7:45 P.A►i. Resolved further that the entire work under the above contracts be accepted and approved and the final estimate thereon allowed. Sanders Egberts bid of Twenty seven ($27.00) per M. for Oak lumber for street purposes, and .awarded to them the contract for fur- nishing the same for the year o f 1912. /All bids for cement for the year .1912 received by the Board were rescinded. ✓The American Surety Company of New York petitioned the Board for the release from Guarantee Bonds nfiven the City for the maintenance of Bric2, pavement on. -North Eddy ° Street from Wash ngton Street to 1st. alley north -of Colfax. The same Se.ing a ten (10) year Bond and having expired. Referred to the 'City Engineer for investigatin - CURB AND SIDEWALK IMPROVEMENT RESOLUTION NO. 153. ✓ RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND,ST. JOSEPH COUNTYIST'ATE OF INDAIAN, That it in deemed necessary to improve Howard Street from Notre Dame Avenue to Eddy Street by the cunct ruction of cement sidewalks and cemet curb on both sides on said Howard Street in accordance with+he'profile ,d.etails, drawings and specifieations on file in the office of the Department of the EBoardd' of Public Works of said City; and such improvement is now ordered. The cost of said imp rovement,including the cost of street and alley intersections, shall be assessed upon the real estate abutting on said Howard Street from Notre Dame Ave. to Eddy Street, all according; to .the method and manner provided for in Act of the General Assembly of the State of In.dian&, entitled "An Act Concerning Municipal Corporaationat," approved March 6,1905, and in accordance with and pursuant to the provisions of all amendatory and supplemental acts thereto,passed by the General Assembly of the State of Indiana. JOSEPH COUNTY,STATE OF INDIANA, That it is deemed necessary to improve Howard Street from South Bend Avenue to the east line of Moreyt s Sub. Division, by Grading, said Howard. Street from property line to property line to the; established grade, and the construction of cement side walk and cement curb, on both sides of'said Howard Street, in accordance with the profile, details, drawings and specifications on file in the office of the Department of the Board of Public Works of said City; and such improvement is now ordered.
