Hearing giv, en on Niles Avenue Grade,Curb and walk,Under Improvement Resolution #139. In the abo're matter a remenst ranee was filed. THEREFORE,be it resolved by The Board of Public Works o'f the City of South Bend, Indiana that the above numbered Improvement Resolution be modified to 'road as' iolloWs:- By grading theroadw-y from Curb line to Curb line and constructing cement walks on East side an said Niles Avenue from' Howard Street to St. Vincent St reet , also constructing cement curb an both sides on Niles Avenue from Howard Street to St. Vincent St reet q THEREFORE BE IT RESOLVET), That the Board find in each and every case in said improvemerYt s t'hat th the benefits to the property, and to the City of South Bend are equal, to the estim- ated cost of said improvements and the same are in all things ratified, confirmed and approved. Be it resolved that notices be published in the South Bend Daily Times on the 29 th day of Xpril 1912 and on the 6th. day of May 1912 to the effect that this Board, will receive bids for the construction of said improvements up to 10:00 A.M. on the 14th. day of May 1912, The'Board' reserves the right to reject any and all bids. Gent lemen: - I respectfully report that I have tabulated: the bids submitted on the 1011 day of April 1912 for the paving,and Grade Curb and walk on No. Lafayette Street and find that THE WESTERN CONSTRUCTION COMPANY is the lowest and beat bidder upon TRININ TRINIDAD LAKE ASPHALT laid. upon a Concrete Foundation. Central Union Telephone Company to set poles and anchors as follows: - One pole aid one small anchor on the west side of Studebaker Court bet- ween Blayne and Division Street. Approved. One pole and one anchor in the alley between Lafayette and Franklin Sts. south of Tutt St. Approved. Forty feet from other poles in same alley. FINAL RESOLUTION DESIGNATING KIND OF PAVEI IT TO BE LAID. WHEREAS, The Board of Public Works of the City of South Bend, Indiana, did on the 12th. day of April 1912 enter a preliminary order designating Trinidad Lake. Asphalt laid on a five inch Concrete foundation, and awarded the contract to THE VIESTERN CONSTRUCTION COMPANY they being the lowest and best bidders upon Trinidad Lake Asphalt,the same to be laid. on. North Lafayette Street from Navarre St. to Foote. Street. WHEREAS ,tie petition has been filed by a majority of the number of resident freeholders, requesting that the said street be improved with another kind og pavement. THEREFORE, BE IT RESOLVED, That the preliminary order is hereby confirmed. and the aforesaid street. is hereby ordered paved with Trinidad Lake Asphalt. Hearing given on Vacation Resolution No. 15 for the vacation of an alley in the Nickel' a Addition.. A remonstrance was filed and the Board after due consideration deferred the; hearing until Tuesday May the 7th. at 10:00 A.M. ,,,-Hearing given on Condemnation No. 14 for the opening of the south end of Sherman Avenue Remmenstrat ors appeared and the Board after due consideration deferred all action until sue aday May the 7t h. 1912 at 10: 00 A.M. _,�!n the matter of the Twenty Five .Hundred Dollar& ($2500.00) Dollars withheld from C.H. De Frees on the South Michigan Street Macadam., the Board ordered that t,he.,aamme be released and paid. - vContracters Bond of C.L.Headley was approved by the Board. Petition, received and read and placed on file asking the Board.. to appropriate 7 feet off of t he we at side of Ro ek st roli & Ni cke 1' s Addition to the City of South Bend, Indiana to extend fromMichigan Avenue south to the Fsi. east and west alley for the purpose of an opening for an alley. Engineer filed assessrient roil and final estimate for Pipe Sewer on Fellows Street from L.S.& M. S.. Ry. to Brsadway,lffnder Immprovement Resolutie n No. 94. Reselved,that notices as to the amounts of assessments be published for six consecutive days in the South Bead Daily Times, commencing on the April the 29th;..19129 stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 24th. day of May 1912 at 7:45 P.M.-, Resolved further, that tree entire work under the above contracts be acc;pt, d -nd approved and the final estimate thereon allowed. Board of Public Works of the . City of South Bend, Indiana. Gent lemen: - In regard to the petitions from brick a,nd, asphalt pavements of North Lafayette Street from Navarre Street to Foote Strr et. I find there are 12 resident freeholders on the street. . Five of them,Nellie G.Paxpon,Daniel Poehlman.,George Sindlinger, M.E.Crane and Edward Galles have-. signed for brick and five, John Klein.di.nst,Anna M.Beck,N.C.Stuck. Lula B. Wiley and Thomas Staudt have signed for asphalt. Two resident property holders, Stephen F.Brown and Huldad Ann Dinnerboiler haven't signed either petition. Air. John C..Paxsen who signed the brick petition nnd. G.E. Vehlert who signed the asphalt petition are not resident freeholders. 0_ I therefore find that the brick petition does not constitute a majority of the resident freeholders aad recommend that the contract be awarded to the 'WESTERN C )NSTRUCTION COMPANY, the lowest and., -best bidders, for asphalt.
